You agree to take sole responsibility for any activities or actions under your account, whether or not you have authorized such activities or actions. We encourage you to use strong passwords (passwords that use a combination of letters, numbers, and symbols) with your account. You must immediately notify FashionTIY of any unauthorized use of your account, or if you have reason to believe that your password was lost, stolen, disclosed to an unauthorized third party, or otherwise may have been compromised. To the maximum extent permitted by applicable law, FashionTIY's total liability to you for any damages (regardless of the foundation for the action) shall not exceed in the aggregate the amount of fees actually paid by you to FashionTIY during the month immediately preceding the act allegedly giving rise to FashionTIY's liability.Order AcceptancePlease note that there may be certain orders that we are unable to accept and must cancel. FashionTIY reserves the right, at sole discretion, to refuse or cancel any order for any reason. Some situations that may result in your order being canceled include limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or problems identified by our credit and fraud avoidance department. We may also require additional verifications or information before accepting any order. We will contact you if all or any portion of your order is canceled or if additional information is required to accept your order.Both parties agree that, following order dispatch, transportation is the sole responsibility of the third-party logistics company. No instance of waiver by FashionTIY of its rights or remedies under these terms and conditions shall imply any obligation to grant any similar, future, or other waivers.Customer Code of ConductAt FashionTIY we take pride in providing class-leading customer service and will do our best to resolve all issues to customer satisfaction. However, we will not tolerate any unacceptable or unreasonable behavior towards our Customer Service Team members.Unacceptable behavior directed towards Customer Service staff or FashionTIY may, for example, include any of the following:Aggressive, abusive, and threatening behaviors, including any and all direct or implied threats on any communication channel; intimidating language; personal and verbal abuse; sexist, racist, homophobic, or derogatory remarks; rudeness; inflammatory statements; swearing; and unsubstantiated allegations.Persistently making habitually demanding or vexatious complaints, despite the matter having been fully addressed; similarly, repeating complaints persisting despite reasonable and fair solutions being offered in accordance with our policies.Asking, expecting or demanding staff to breach established company policy guidelines, e.g. refund amount, time-frame, special compensation, etc.; similarly, seeking an unrealistic outcome beyond the scope of our own policies and procedures. By default, the refund amount cannot exceed the original order amount paid to FashionTIY.Repeatedly changing the nature (or focus) of a complaint or the desired outcome, part way, after a formal response has been provided.The excessive number of complaints compared to the total purchase value history.For such behavior, complainants may be advised and formally notified of the following:Their language is considered offensive, abusive, threatening, and wholly unacceptable.They must refrain from using such language, intimidation, and threats.There will be no further exchange of correspondence on the matter if they persist with this behavior.FashionTIY reserves the right to no longer accept orders from the customer in the future without further notice.ChangesNotwithstanding the provision regarding changes to these Terms in the “Entire Agreement” section below, if FashionTIY changes this “Dispute Resolution for Consumers” section after the date you first accepted these Terms (or accepted any subsequent changes to these Terms), you may reject any such change by sending us written notice (including by email to [email protected]) within 30 days of the date such change became effective, as indicated in the “Last Updated” date above or in the date of FashionTIY’s email to you notifying you of such change. By rejecting any change, you are agreeing that you will arbitrate any Dispute between you and FashionTIY in accordance with the provisions of this “Dispute Resolution for Consumers” section as of the date you first accepted these Terms (or accepted any subsequent changes to these Terms).Entire AgreementThese Terms and the FashionTIY Rules are the entire and exclusive agreement between FashionTIY and you regarding the Services, and these Terms supersede and replace any prior agreements between FashionTIY and you regarding the Services. These Terms apply only to FashionTIY and you. These Terms are not intended to, and shall not, create any third-party beneficiary rights, except as expressly provided in these Terms.We may revise these Terms from time to time. If we make any material changes to these Terms, we will notify you of such changes by posting them on the FashionTIY website or by sending you an email or other notification, and we will indicate when such changes will become effective. By continuing to access or use the Services after those revisions become effective, you agree to be bound by the revised Terms.
