Oh boy there is a lot of misinformation in the answers to this question especially in the top answer :( So the right to an assurance animal in no-pet housing is governed by a federal law so everyone saying that it varies from state to state is incorrect. Filing a complaint with HUD is the way to go since they are the authority on disability rights in housing. For housing there is no legal difference between an ESA, a service dog in training, or a full service dog. The rental must fall under the law that governs disability rights otherwise the property owner DOES have the right to refuse an assistance animal or to charge fees. If they must have 4+ units that they rent out (or if they have less units but use a property leasing agency) they are subject to disability laws. You must request reasonable accommodation for the assistance animal BEFORE it is brought in to the property. It is best to have the request and approval written into your lease before you sign it. The property owner may request documentation from your mental health provider or forms to be filled out verifying your need for this animal and establishing your disability. However, they may NOT charge you pet fees, deposits or any kind of extra funds due to the assistance animal nor can they require any kind of ID card, certification, or other “verification” of the individual animal (these are illegal scams anyways). They ARE able to charge you for damages that your assistance animal causes, but they must be able to prove that the damages are from the animal, not preexisting before the rental occurred (this is why you should taking pictures as soon as you move in), and in excess of normal wear and tear. They may not preemptively charge you for damages under the assumption that the animal WILL cause damages. The property owner IS able to evict you if the animal is shown to be dangerous, destructive, or a nuisance (such as excessive barking etc.). The animal must be judged on its own merits/behavior NOT on the property owners previous experience even if it is with the same breed/kind of animal. The property owner is further able to deny your assistance animal IF they are able to show that the accommodation would not be reasonable. This is harder to do than you might think. Examples could be things such as allowing a Great Dane in a studio apartment or a restricted breed IF by allowing the restricted breed the property owner can show that they would either lose their property insurance or that it would raise the cost to a prohibitive level AND they can not find comparable insurance.As far as your actual question, assuming that you have correctly requested the accommodation and have otherwise followed your landlord’s requests (that are within the law) and that there is a legitimate need for an assistance animal (in other words prescribed by a treating physician/therapist), your next best step beyond the complaint with HUD is to contact a disability advocate in your area.
