Yes they can all provided that they can show that they delivered the original. If you have a payroll service (e.g., ADP or PayChex), you should able to go on line and get a duplicate in PDF form at no charge. Most places (e.g., you’re applying for a loan) will accept that format.Another point to consider is that your employer doesn’t have a copy of the original. It’s a multi-part form that’s printed once and mailed or handed to you. There’s no duplicate set made. Therefore, if you want to replace the original as it would have been done, someone has to re-print the whole thing.I’ve worked for a payroll company for 30 years and for three, I was in charge of our year end processing. The only time we’d have your original is if the mail was returned to us. In that case, we’d send it to your new address at no charge when you contacted us.But if you got and lost what we sent, we don't have a spare set. You can get the PDF on line at no charge. To get a true original set, we’d have to contact the W2 processor and they’d have to print a new set. They charge us for that (I think it’s $25 for a two week response and more for a rush order or something like that). So why would we eat the processor’s charge because you lost the document?And why would the processor charge? Because they have to load your record, verify it, put a blank original form in a printer, print it, verify the copy and mail it out. This also means that they have to record the operation (their employees don’t work free) and update their records. Now you might argue “how could it take $25 for a staff clerk to roll a blank W2 form into a printer, bring up your record and press print?”It probably doesn’t but this will also involve other staff. And yes, there’s a “lets discourage this” factor because you could have gotten the PDF on line free.

Your employer takes your payroll taxes out of your W2 income every time you get a paycheck (and sends them to the IRS quarterly, as is required by law), and with your spouse being self-employed, that makes them responsible for sending their payroll taxes off to the IRS every quarter. If they didn't do that, then taxes on that income AND Social Security/Medicare tax will be owed at the end of the year (and perhaps with a penalty for not being filed quarterly, as is required).HOWEVER, having an earner in your household (filing jointly) that is self-employed gives you tax flexibility you wouldn't get from just being someone else's employee. See, when you make your annual filing, you add up your income as an employee (W2 income) with your spouse's income from their business (1099 income + sales revenues, if any), and then, after any applicable additions and/or subtractions get made to that combined income figure, the resulting amount is your AGI (adjust gross income). Now your spouse has to file a Schedule C form "Profit or Loss from a Business" which is a good thing, because your spouse can write off all their expenses related to doing their job. Employees can't do this.For example, you commuted five days a week, all year, at 10 miles per round trip. Unfortunately, you can't write off any of that mileage (at over $0.50/mile), none of your tolls (bridge or road), none of the parking (if it cost you to park at your job), and none of the real expenses associated with your car. Your spouse, however, can write off every mile driven to any work-related location, plus the tolls and the parking too. Or, they can write off the actual annual expenses to keep the car in service for the business: repairs, gasoline and registration. They can even claim the car as a depreciable expense, bought for the business.Another example is office supplies, including computers, printing (ink), pens, receipt tablets, and oh so much more (literally anything purchased that's used in the business) can all be subtracted out of your spouses gross income. Cell phones and service count too - even if they're used only partially for business. The business portion of the expense is a write off. Interest paid on business loans can be written off as well. And so can meals and entertainment - as long as they're business-related.There's so many ways to reduce self-employed income through accurate expense tracking, it's worth it for your spouse to be diligent about it and keep all their receipts. Once their expenses are subtracted from their income (on Schedule C), it's THAT number that will be added to your W2 income and then be on its way to determine your income tax. If your spouse takes a loss, that would lower your combined gross income, and have the potential to lower your liability.One thing to note though: the self-employed have to pay a tax on top of their income tax to fund the Social Security and Medicare coffers. The employed do it when their payroll taxes are withheld. Social Security and Medicare taxes are a combined 7.65% of everyone's income.Being self-employed allows your spouse to potentially write off AS MUCH AS or MORE THAN they earned. So if you have a savvy tax professional, they'll help you get the business expenses in order. I recommend you get a good Licensed Tax Preparer or a CPA to help you prepare for your filing this year. They're worth every penny to hire, for sure.
