It did not take long before the threat made its initial appearance.When states in the North began using the plain wording of our Constitution to outlaw servitude, the more heavily agricultural states in the South that employed slavery and their northern sympathizers formed the Democratic Party (1828) to pursue a democratic reading of the Constitution that would permit slavery to be maintained.Slavery was a fractious issue in the United States, as everyone knows, but why was democracy seen as the protection for it? Majoritarian democracy is also known as “two wolves and a lamb voting on what’s for dinner.” It permits majorities to impose their will on minorities.In republican government, any law that prejudices any right of any individual is automatically null and void. Voting is used only for election to office and in limited ways for even that. In democratic government, fifty percent of the vote plus one can determine the scope of freedom of the losing side.That first assault on our liberal heritage resulted in the Civil War, in the wake of which, a series of constitutional amendments [XIII, XIV and XV] were passed to make it clear the Constitution applied to all Americans and was incumbent on the states as well as the federal government.Before the war Southern Democrats had reannointed themselves the Conservative Democrats to denote they wished to conserve the right of states to go their own way with regard to law and custom. Reconstruction was imposed on the South from 1865 to 1877, but Conservative Democrat resistance became increasingly bolder. No jury in the South convicted a white man for killing a black or a Republican. Whites would make blacks small loans, encourage them to drink, and when they couldn’t pay the loan back the next day, they’d be impressed into work gangs. After all, even the Constitution permits servitude as punishment for crimes.No sooner did Reconstruction end than the whole North too flipped. Blacks had been arriving from the South and farm boys from the Upper Midwest, both looking for trade and factory work. The Eastern Seaboard had begun filling up with “new immigrants,” now Jews from Eastern Europe and Catholics and Orthodox from Southern Europe. Chinese were becoming an increasing concern on the West Coast. The progressive movement had been taking hold, here and there, a result of Otto von Bismarck’s statecraft in uniting the many German principalities under Prussian King, now Kaiser, Wilhelm I. He then astonished the world further by stealing social democracy from Karl Marx and implementing it in the name of the Kaiser. The High Modern State, the world’s first paternalistic welfare state, had been born.The progressive movement emerged as a native-stock reaction to protect Anglo Saxon Protestant (and overwhelmingly male) privilege. It quickly latched onto the new monarchistic social democracy as the ideal way to protect that privilege. There were probably very few politicians around the world not impressed by and jealous of Bismarck’s ample power to bring about change, and American progressive politicians were far from immune.It grew to include some four-fifths of Anglo-Saxon Protestants, who, at the time, constituted some four-fifths of the US population, yielding a super-majority (when the seamlessly allied Conservative Democrats are included). The fact of that majority led progressives to double down on democratic methods. Soon, at the federal or state levels, there were ballot initiatives, referenda, recall elections, direct election of Senators and other ways for the progressive majority to impose its will on minorities. Harvard, Yale and other law schools devoted themselves to more intensely democratic parsing of our Constitution.By 1889, Wesleyan professor and football-team coach Woodrow Wilson had published The State in which he rejected the separation of powers and checks and balances stating instead that “Government does now whatever experience permits or the times demand.” He also stated, “The competent leader of men cares little for the internal niceties of other people’s characters: he cares much–everything–for the external uses to which they may be put…. He supplies the power; others supply only the materials upon which that power operates…. It is the power which dictates, dominates; the materials yield. Men are as clay in the hands of the consummate leader.” In his Constitutional Government in the United States of 1908 (which was an attack on same), he claimed, “The President is at liberty, both in law and conscience, to be as big a man as he can. His capacity will set the limit.” (No wonder Freud later published a psychological study of Wilson.)The strong preference of progressives for the Bismarckian social democratic welfare state was not limited to Democrats. Theodore Roosevelt, a Republican progressive, preceded Wilson to the presidency, where, from the White House, he excoriated our Constitution as a relic document that needed to give way to modern statecraft. So enamored was he of Prussian statecraft that he even emulated their highly un-American imperialism, acquiring the Philippines and helping to cleave Panama away from Colombia.So, what was this new form of state that urgently needed to supplant our constitutional republic? When Bismarck started hiring Marx’s loyalists away to government jobs, he scathingly predicted [Critique of the Gotha Programme, available online] that Bismarck’s version of social democracy, dependent as it was on providing state aid (as welfare was called until the 1930s), could never produce a class-free egalitarian society but must inevitably result in a permanent dictatorship of a bourgeois elite justifying its rule by maintaining an underclass.Does not sound promising. The Obama administration attempted to nudge that process much further along with the passage of the ACA/Obamacare.Indeed, it is starting to come out that the Obama administration together with the Clinton campaign were busy writing “checks and balances” and limitations on government entirely out of the picture in the expectation that back-to-back progressive Democratic administrations could complete the Blue Model, effectively ending our constitutional protections.It has become clear that the State Department, the Department of Justice, the White House, the FBI and other high administrative and political offices and officials have conspired toConduct a Potemkin investigation whitewashing Clinton and her campaign from clear criminal activityUse false pretexts to receive a warrant to spy on the opposition political campaignWhen the opposition candidate was nevertheless elected (against all insider expectation), use a known false report as the basis to conduct a criminal investigation of the incoming administration in order to de-legitimize it (and, likely, to forestall the favor being deservedly returned)This is on a magnitude of Watergate cubed. It represents high-level collusion to corrupt constitutional processes for political rivals and to impose statism on all of us. From the cocksureness that Clinton would prevail and the shock when she did not, it becomes reasonable to assume that the confidence owed to election-manipulation mechanisms that succeeded in the prior, 2012, election. The shock probably owed to the realization they were now unable to control the situation and had become vulnerable to discovery.It would appear that a pitched battle between conservatives and the greatest threat we perceive will shortly commence. It will be instructive to see just how tenaciously conservatives join this battle. It will be instructive to see how Establishment Republicans (semi-statists themselves) approach the issues and how firmly they come down on behalf of constitutional government.
