Notwithstanding recent attacks on the judiciary, the Law (notice the capitalization) is what preserves and protects the liberty of every citizens of this country to ask questions like whether one has to stand.It is the Law for which you show respect by standing, and the Law’s momentary representative is the judge, the lawyers, the clerks, the witnesses, and the parties. Having a free and fair judiciary is worthy of respect, as there are few nations in the world who have been able to accomplish tha* * *It was pointed out to me that I had not fairly answered the question asked - whether standing when a judge enters a courtroom was based on a statute - by not citing any authority, and that is so; my concern at the time was to explain why the querent’s postulated behavior would not accomplish her or his stated objective of expressing a negative opinion of a judge. I remedy that omission here.The short answer is there are statutes governing procedures by which a court may enforce decorum in the courtroom, as expressed in a local rule of court, but none expressly addressing a requirement of rising to a standing position when a judge enters or leaves a courtroom. There is a consensus, however, that addressing the point via a local rule is within every court’s inherent authority. That authority commonly is expressed in a local rule. Also, there is ample authority by which a court may punish as contempt any violation of a local rule requiring that people in the courtroom rise when a judge enters or leaves the courtroom. Even if a local rule is not present, if a judge noticed someone not standing, and that person was not physically prevented from doing so, the judge could order the person to stand, and again under the court’s inherent power to maintain authority in the courtroom, could then punish any further misbehavior as contempt.Every court system adopts a set of what are called local rules to govern procedure. These rules cover points which are not addressed by a state or federal statute for the particular point covered by the local rules. These rules are commonly written by members of the local bar under the direction of one or more sitting judges, and violations are punishable by a civil or criminal contempt proceeding. The procedure for contempt is statutory and the easiest place to see a good outline of that procedure is Fed.R.Crim.P. 42, applicable to all federal courts and copied in whole or part by most state courts. Where a local rule does not expressly apply to a given behavior, the judge may issue a bench order and if that order is violated, may then commence a contempt hearing, either immediately or at a later date upon notice.Nowadays, all federal and most state courts maintain websites which frequently include the text of all local rules of court. In addition, a printed copy of the local rules of a specific court are available without charge from the clerk’s office for that court. Every website I checked, state and federal, except for one Justice of the Peace court which addressed attire, but didn’t specifically mention standing, has issued a local rule of decorum that expressly requires that people stand when the judge enters or exits the courtroom. I did not attempt to review every website for this, as I am not attempting a survey, only evidence of a consensus. But I did look for the highest and lowest tier of courts in the federal and state systems.Authority for the issuance of local rules of court arises out of the inherent right and duty of every judge to maintain “decorum” in the courtroom.[1] In part, this facilitates the orderly disposition of cases and permits the judge to readily hear and see what is said. This power to maintain decorum in the courtroom reflects the presence of the inherent power of the United States, as delegated to and exercised by each member of the judiciary at the federal and state levels. For example, the local rules of court for the federal courts in the Northern District of Alabama, a state known for adherence to a certain rebellious approach to government, under the heading “Courtroom Attire and Conduct” at Item 3, requires expressly that everyone in the courtroom stand when the judge enters and exits the room. The Arizona Criminal Defense Attorney Blog had an article urging attorneys representing criminal defendants to urge their clients to stand when the judge enters and exits the courtroom, both because it is a requisite of the local rules and because the defense bar knows that judges are humans and a client who behaves rudely in court damages her or his own case by appearing immature and possibly less credible.The requirement applies at every level of the judicial system. I found similar rules for the United States Court of Appeals for the Federal District, as well as for several Justice of the Peace courts in Texas. While there is no federal or state statute that my quick survey found expressly requiring that people in a courtroom stand, the requirement is amply addressed by local rule for courts, and there are plenty of judicial decisions supporting such requirements when included in a local rule.Nor is this anything recent. In U.S. v. Hudson, 7 Cranch 32, decided in 1812 - a touchy year for the United States due to the disagreement that year with Great Britain - the Supreme Court took the opportunity to address the basis of a judge’s standing as arising in the judicial power of the United States, which the Court found was a constituent part of the “concessions of the several states” to the federal government. The Court noted that judicial power was to be “exercised by Courts organized for the purpose, and brought into existence by an effort of the legislative power of the Union”. Thus, behavioral defiance of a person refusing to follow judicial standards of decorum accomplishes nothing, certainly does not diminish the court’s authority in any way, but does give the judge the impression that the person is trying to pick a pointless fight.A display of disrespect to a court is an attack, however minor and meritless, upon the United States as a whole. In the 1812 ruling mentioned above, the Court concluded thusly: “To fine for contempt — imprison for contumacy — inforce the observance of order, &c. are powers which cannot be dispensed with in a Court, because they are necessary to the exercise of all others: and so far our Courts no doubt possess powers not immediately derived from statute; but all exercise of criminal jurisdiction in common law cases we are of opinion is not within their implied powers.” [Emphasis added.] There are 2,744 citations by other courts citing the authority of the Hudson ruling.Should a court determine that an example is required, it has the authority to commence a civil or criminal contempt proceeding against a person who offends the court’s judicial power. In a case of criminal contempt, where imprisonment is a possible penalty, the court is to hear the case presented by a prosecutor and the alleged contemnor is entitled to a jury trial because such a proceeding is likely to result in more than a tap on the contemnor’s wrist.In 1987, in Young v. U.S. ex rel. Vuitton et Fils S.A., Supreme Court of the United States May 26, 1987 481 U.S. 787 107 S.Ct. 2124 95 L.Ed.2d 740, the Supreme Court decided, in an 8-1 ruling, that a court could appoint a private attorney to prosecute an alleged contemnor for criminal contempt if, for some reason, the US Attorney’s office could not do so.As one basis for its ruling, the Court noted that the ability to punish disobedience to judicial orders is essential in ensuring that judiciary has means to vindicate its own authority without complete dependence on other branches of government. Without going into a long disquisition on the procedure for criminal versus civil contempt, either can be summarily punished on the spot if the contemptuous act is committed in the court’s presence (Fed.R.Crim.P. 42(b)) but even then, most judges will set a hearing date with notice to the now-defendant and if the sentence might be imprisonment for a period in excess of six months, will appoint a prosecutor. The procedure for criminal contempt is the same as for any crime, so rights, such as one to trial by jury, are applicable. The practical purpose of this delay in a hearing date is mostly to give the alleged contemnor time to see that there is no upside to contemptuous behavior, and for the judge to be sure she or he is impartial. All of the defendant’s civil and constitutional rights will be observed. The procedure for criminal contempt is statutory (see 18 U.S.C. §§ 401-402, 3285 and 3691). These procedures represent a codification of pre-existing procedure, as the Supreme Court noted in Cooke v. U.S. Supreme Court of the United States. April 13, 1925 267 U.S. 517 45 S.Ct. 390 69 L.Ed. 767 and other decisions.Penalties for civil contempt can include short-term incarceration, generally until the contempt is purged by some act by the contemnor expiating the contempt, but most penalties for civil contempt are confined to money paid over to the court’s clerk for the benefit of the United States. The penalties for criminal contempt can include a fine, but often include imprisonment for a specified term. If the sentence of imprisonment is or may be for a period longer than six months, the individual can have a jury trial upon demand. The longest sentence I am personally aware of was 2-1/2 years, which meant removal from a county jail to an actual prison since county jails are not used for such long potential sentences.When contemplating an intentional contemptuous act, the actor should keep in mind that the person who is going to suffer if contempt is found is the one carrying out the contemptuous act, and any dependent of that person - not the judge or any member of the court’s staff, law enforcement, the attorneys or any other person or entity involved in the underlying proceeding. Being jailed for contempt does not in any way lessen the dignity of the court. Inviting contempt is a silly action that confers no benefit on the contemnor unless she or he wants to be fined or incarcerated for some reason. While I was sometimes held in contempt, I was just not recognizing when to shut up - a lifelong failing I suspect.It is true that I was occasionally held in civil contempt of court, but for arguing with the court’s ruling then rather than taking a long and expensive (to my client) appeal. I was thus over-zealous, but never disrespectful of what the judge stood for. I never insulted a judge; indeed, I believed I was doing the judge a favor by pointing out the error. As I admit, I was annoying, but that is a long way from being disrespectful. I always stood to address the judge because I respected what the judge stood for, and it was indeed that very respect that led me to believe that, if I adequately pointed out what I perceived to be an erroneous ruling, the judge would correct it on the spot. I have had no problems adjusting the look of my forms, and have been able to easily add them to web pages when necessary. I also love the options for sending email notifications when a form is completed - this is really great to keep our team informed.
