Nearly every comment insisted that this was “pandering” and that she should only have been convicted of manslaughter.Let’s be clear. The state of Texas does not require premeditation to meet the threshold of murder:(b) A person commits an offense if he:(1) intentionally or knowingly causes the death of an individual;(2) intends to cause serious bodily injury and commits an act clearly dangerous to human life that causes the death of an individual;Texas Penal Code § 19.02 | FindLawDid she knowingly or intentionally cause his death? Well she very deliberately used lethal force against him. Even if you tried to make the argument that she wasn’t trying to actually kill him, then we have #2. At a bare minimum, she intended to cause serious bodily injury, she committed an act clearly dangerous to human life, and that caused the death of Botham Jean.The only way that you could dispute that her actions qualify as murder would be:You believe that Botham Jean is actually alive.You don’t believe that she intentionally pointed the gun at him and pulled the trigger even though she has admitted to such. Perhaps you think this was her way of trying to start a tickle fight.You don’t believe that shooting someone is an act “clearly dangerous to human life”.Personally, I wonder what those same commenters would have to say if Botham Jean had entered Amber’s apartment and killed her. Somehow I think that rather than crying that he got convicted of murder instead of manslaughter, they’d be insisting that he get the death penalty.EDIT: another clarification for those unfamiliar with Texas law. Texas doesn’t use the term “first degree murder”. It has “murder” and “capital murder”. The latter has additional criteria which were not present in this case. She was convicted of murder, not capital murder.EDIT AGAIN: There is a difference between an accidental death and an intentional death in unintended circumstances. An accidental death (which would be manslaughter because there was no intent to harm or kill) would be something like a vehicular accident where there was negligence involved (such as if the driver was intoxicated). This was not an accidental death. The circumstances were unintended (she went to the wrong apartment) but she didn’t accidentally shoot him. That was done with complete intent to harm or kill him.I’m just glad to see the jury reach the correct verdict, especially in a case of a white female police officer vs a black male civilian, which is about as much of a disparity as you can get when it comes to societal biases.Note: a few people have expressed concern at this meme. Look, it’s a shitty situation all around and I get that. This isn’t to make fun of her specifically because it’s not a funny situation, it’s to draw attention to the fact that there are real issues with police accountability in the US.
