If the data is publicly available then it can be scraped.The things to be careful about is images and other copyrighted material. Raw data and factual information can’t be copyrighted in the same way that other material can be.That said, expect a legal challenge if you plan to do anything big. I’m trying to mentor an ostensibly bright young lady. Recently I instructed her to update a client’s estate planning documents from several years ago. We have updated our estate planning templates and the statutory forms have also changed.She typically inserts client data into these same updated forms, so they are not new to her.The client had a new address which she also knew because we’d researched it together.When I reviewed the forms she had updated, they had the old address. Confused, I asked her about it. She immediately responded with “Well, you told me to go off the information from their previous forms.”Um…yes…but….does anyone else see a problem here?The excuse I get sick of is the one where it’s somehow always my fault. Just once, okay most of the time, I’d like to hear, “Oops I’m sorry I’ll fix it right now” or if it is my fault because I didn’t explain it well enough, then “I must not have understood your instructions.” Something that tells me she recognizes her own errors.I really like and care about this young lady and want her to succeed. I know she is sensitive so I try to tread lightly but until I wrote this I didn’t know how to tell her this.Ultimately I’d like for everyone to take responsibility for their role in the situation, fix it, learn from it, and move on.
