It has now been revised to Rs. 8.04 apiece.As a result of this judgement,many companies which used to sell variants of the condoms will be forced to sell condoms at the price fixed by DPCO.The NPPA notification ensures that the manufacturers comply with the regulation otherwise they will be "liable to deposit overcharged amount along with the interest thereon under the provisions of the Drugs (Prices Control) Order, 2013 read with the Essential Commodities Act, 1955."This decision led to many major condom manufacturing companies filing a case in the High Court. The more surprising fact is that these companies were represented by none other than the great (pun intended) Kapil Sibal who argued that “condoms may be for common use but pleasure condoms are not for common man” and there was a difference between “ordinary” and “pleasure” condoms. Arguing that even though the Essential Commodities Act covers foodstuffs, it would not cover all kinds of food, he said “Why would you not control the price of cheese?
