What happens if a lawyer left a firm before the case has finished?

This kind of thing happens all the time, at least in large firms. Roughly speaking, there are three “levels”:If the outgoing lawyer is junior, the client probably doesn’t care, and in fact might not even know. At most, they’ll get an email from lead counsel or a lieutenant-level lawyer along the lines of “Effective immediately, John Smith has left the firm. Jane Doe is taking over for John Smith, please feel free to contact her for any questions you may have previously sent to John.” The client will (maybe) email back “Jane, nice to meet you,” and that will be that.For medium-seniority lawyers, it will be a little more of a transition. The client or the other lawyers on the team may still want the outgoing lawyer involved the case, at least for the short term. For example, when I left the world of large law firms, the largest case I was on was heading to a critical phase of trial. I agreed to continue my responsibilities on that case from my new firm, up through the end of that critical phase. (All in all, it was a couple months I think.)But there was never a question of me taking over the whole case. I didn’t have the expertise or the manpower at my new firm.Now, if the outgoing lawyer is senior enough that the client might want to follow the lawyer, the client will get a different kind of message. It will typically be a joint letter (or I guess, joint email?) from the outgoing lawyer and the leadership at the firm. The upshot of the letter will be along the lines of:Dear Client, as you may know, Lawyer McFancyPants will be joining the law firm Bob Lablaw and Associates effective January 1, 2022. We both want to continue working for you, because we both like how you pay your bills on time. But we’re reminding you that the choice of who represents your interests falls to you. Let us know which of us wins our fight for your cash.Once again, it’s possible for the outgoing lawyer to continue working with the prior team for a while, as responsibilities transition. This is, in fact, the most likely outcome in the short term.
