So this 16 year old kid was about to rob someone of their livelihood because he used a fake ID. The police sided with the tattoo artist and the kid was taken into custody and charges were pressed against him.Can you prove that the tattoo shop knowingly tattooed a minor? A reputable shop would do paperwork of some kind for a legal release form. I can’t imagine paperwork was done for a minor if they knew it was a minor. At that point it would be your kids words against the shop. The burden of proof is on you.Did another legal adult sign on their behalf? Not all state laws are black and white about who is allowed to be the responsible party. If someone else made that decision, it might fall on that person and not the Shop at all.I’m sure there could be more factors to take in, but you have to be sure. I was involved in a car “accident”. The other car never touched my vehicle but when the driver lost control due to hydroplaning during a rain storm he cross into the median strip. I guess he must have had his cruise control set and when his tires lost traction the throttle when full on. When he crossed into the median with me directly passing behind him, his car threw up a tidal wave of gravel, dirt, and grass. The impact of all the debris actually exploded my driver-side window and the expanding glass and gravel then hit me. To explain how serious the impact of all of this debris was, it did over $6000 of damage to my vehicle.I received a very small cut on the back of my upper arm that was barely a scratch. An ambulance had arrived to treat the other driver and until the police officer said something about the blood on my arm I didn’t even know I had been cut. The EMT wiped it with an alcohol and put a small bandaid on the cut. I guess the deputy must have noted the cut on the accident report because about 3 days after the accident I received a call from the other driver’s insurance company offering to pay for my injuries. I’m not greedy, there was no sign of an infection, I didn’t have PTSD as a result of the accident or anything so I told him that really hadn’t suffered any injury and had not been charged for the minor treatment I had received from the EMT. He still insisted on compensating me and told me they were forwarding me a check for $350. In part the payment required me to sign a release form. When I got the release form I DID modify the wording to state that they would still be liable for any infection or complications that might arise as a result of the injury.So that was it…$350 for a scratch that was far less than I had received from picking roses or playing with a cat.

If the image was taken in a public place and you are not making money off it, you generally don't have to get permission, but it is smarter to do so, especially with children. I find parents get quite upset if you use images of their children without their consent. I cannot say I blame them.I think the wisest course is to always get the parents to sign a release form. You should have a lawyer write the form for you so you make sure it is properly done.
