What is the motive behind the Durable Power of Attorney that Jehovah Witnesses are asked to sign and have on file at their Kingdom Hall? Why?
You have already had a coupe of responses. The legal document as stated by Mark Baker, and Sergio Saavedra, is so that someone else can speak for you if you are unable to speak, especially in a medical emergency.A JW is not forced or coerced into signing such a document. It is highly recommended thou that we do. In fact it is recommended that every person no matter what their beliefs have such a formHere in Australia every state has different laws and requirements in this regard and the forms used are different. Were I live it is called Advance Care Directives. It is now a 4 A4 page form. The laws in this state in regard to powers of attorney all changed on 1 July 2014. Before that we just had a singed card in our wallets that gave the name of a person to contact and saying that we would not have blood. With the change in the law that was no longer good enough. This is what all JWs used to carry until laws changed in various placesFrom the following USA web page you can see the general effects of having or not having a medical power of attorney What Happens if you Don't Have a Power of Attorney? There are certain medical procedure that are up the conscience of each JW. The Durable Power of Attorney outlines just what medical procedures a particular JW will or will not have. Some JWs will give a DNR (Do Not Resuscitate) order on their form depending on their age and state of health at the time they signed the form. The form names at least two people that can be contacted by medical staff who have agreed to act on your behalf. Each person is to have a certified copy of the Durable Power of Attorney to show medical staff what the our wishes are. Here in Australia the KH has a copy because there are times when anyone mentioned on the form may not be able to get their copy of the Durable Power of Attorney. Having a secured third person copy means that a copy is always available.Mark Jones, saysmembers should choose another Jehovah’s Witness as their power of attorney and not a non-Witness relative. Because a non-Witness is likely to try and save your life with blood. This is what The advice given to JWs isTo help ensure that his wishes are honored, a publisher may choose to appoint two of Jehovah’s Witnesses as his health-care agents instead of non-Witness family members. If this is done, [that is, appoint fellow JWs] it is both prudent and a kindness for the publisher to advise his non-Witness family members of this.I do have a non JW relative as a contact on my form because i trust that the person will abide by the legally abiding form
What is a durable power of attorney?
It is a legal document that allows a person to choose who will make health care (and sometimes financial, depending on how it's drafted) decisions for them if they become incapacitated. Usually, this is paired with a set of advanced directives (most states have a form you can just fill out). Advanced directives instruct your doctor as to your wishes should you end up on life support, severely brain damaged, etc. Some people choose to have all life saving options applied to them. At the other end of the spectrum, some people ask that no extra measures be taken (e.g. no respirator, do not resuscitate order, etc.). Many people have chosen to create advances directive orders once they get older because the doctor is legally required to follow the wishes of the patient and no decision has to be made by family members. Sometimes family members will disagree. Sometimes it's just a matter of guilt or false hope. The Durable Power of Attorney works well for health care situations that are not quite this dire, but someone still needs to make a decision. This may come into play if the person giving the power ends up with Alzheimer's or dementia. They lack capacity to make decisions, but it's not time for them to go, either.
How does a durable power of attorney work?
A power of attorney authorizes someone else to do something that the maker of the POA could otherwise do themselves. However, such a document is easily revocable at any time, or when the maker dies. A “durable” POA is an attempt to make the POA last past death sometimes, or to prevent its easy revocation. How well that succeeds depends on what supports the “durable” idea, and whether the maker of the POA has clearly agreed to the duration. A POA doesn’t become durable just by putting a word in the title; it takes something extra.I excerpt the following from Durable power of attorney :“Powers of attorney are routinely granted to allow the agent to take care of a variety of transactions for the principal, such as executing a stock power, handling a tax audit, or maintaining a safe-deposit box. Powers of attorney can be written to be either general (full) or limited to special circumstances. A power of attorney generally is terminated when the principal dies or becomes incompetent, but the principal can revoke the power of attorney at any time.A special type of power of attorney that is used frequently is the "durable" power of attorney. A durable power of attorney differs from a traditional power of attorney in that it continues the agency relationship beyond the incapacity of the principal. The two types of durable power of attorney are immediate and "springing." The first type takes effect as soon as the durable power of attorney is executed. The second is intended to "spring" into effect when a specific event occurs, such as the disability of the principal. Most often, durable powers of attorney are created to deal with decisions involving either property management or health care.Durable powers of attorney have become popular because they enable the principal to have her or his affairs handled easily and inexpensively after she or he has become incapacitated. Before the durable power of attorney was created, the only way to handle the affairs of an incapacitated person was to appoint a guardian, a process that frequently involves complex and costly court proceedings, as well as the often humiliating determination that the principal is wholly incapable and in need of protection. With a durable power of attorney, on the other hand, a principal can appoint someone to handle her or his affairs after she or he becomes incompetent, and the document can be crafted to confer either general power or power in certain limited circumstances. Because no judicial proceedings are necessary, the principal saves time and money and avoids the stigma of being declared incompetent. The concept of the durable power of attorney was created in 1969 when the National Conference of Commissioners on Uniform State Laws promulgated the Uniform Probate Code (U.P.C. § 5–501). Ten years later, the provisions of the code dealing with the durable power of attorney were modified and published as the Uniform Durable Power of Attorney Act (UDPA). All fifty states recognize some version of the durable power of attorney, having adopted either the UDPA or the Uniform Probate Code, or some variation of them. Versions of the durable power of attorney vary from state to state. Certain powers cannot be delegated, including the powers to make, amend, or revoke a will, change insurance beneficiaries, contract a marriage, and vote.”
