PDF Editor FAQ

Does a home health aide who provides non-medical care, such as shopping, meal preparation, companionship, computer help, etc., need to be licensed?

Not required in CaliforniaCurrently, home care aides that do not provide medical services do not require any state licensure prior to commencing caregiving services either independently, or through a home care organization. For clarification, a ‘home care aide’ is not the same as a ‘home health aide’ employed by a home health agency, who provides personal care services under a plan of treatment prescribed by the patient’s physician, and who is required to be certified by the Department of Public Health. As a side note, in each HomeHero | Senior Home Care profile, the approved certifications are shown in green. CNA and NHA here for example. However, Assembly Bill 1217, signed by the Governor on October 13, 2013, enacts the Home Care Services Consumer Protection Act, which provides, on and after January 1, 2015, for the licensure and regulation of home care organizations by the State Department of Social Services (DSS), and the registration of home care aides. In his signing message, Governor Brown indicated that the bill’s author and legislative leadership have committed to delay the bill’s effective date by one year to January 1, 2016.A brief summary of the bill’s provisions follows:Requires DSS to establish and continuously update a home care aide registry, which would include specified information relating to home care aide applicants and registered home care aides.Requires background clearances for home care aides, as prescribed, and would set forth specific duties of the home care organization, DSS, and the Department of Justice in this regard.Requires a home care aide applicant to submit to the Department of Justice a signed declaration under penalty of perjury regarding any prior criminal convictions.Requires home care aides to demonstrate they are free of active tuberculosis.Requires DSS to impose various fees to be deposited in the Home Care Fund to be created by this bill.Prescribes enforcement procedures, fines, and penalties for violations of the act by a home care organization or a home care aide.Requires any fines and penalties collected under these provisions to be deposited into the Home Care Penalties Subaccount within the Home Care Fund to be created by this bill.Provides that is a misdemeanor for a person to falsely represent or present himself or herself as a home care aide applicant or registered home care aide.Provides that any person who violates these provisions or willfully or repeatedly violates a rule or regulation promulgated under these provisions is guilty of a misdemeanor.[1] Barry Jardini State Bar of CA :: Barry Gerald Jardini

Why are many people in the helping professions diagnosed with personality disorders?

Do you know this as a fact? I’d love to see those statistics!I actually think that all clinicians who are going to become responsible for the wellbeing of other individuals should be screened for mental health issues and more, but as far as I know, nobody is unless they work in a larger institution like a hospital, and even there, they don’t get screened for mental illness or personality disorders. Therefore, it’s impossible to know if there is a correlation between therapists and mental disorders, and it’s not possible to respond to your question since you are affirming something that can’t be confirmed. We just don’t know if that’s the case.I think that screening should start before individuals get into school to get a mental health degree. Then, another one should be once they get their license as therapists. In most agencies, hospitals, schools, and places where clinicians are hired to work with children, the elderly, and people with disabilities, the screening is pretty strict and mandated. Nobody hires a person with a sex offender record for instance. I’m not saying that people that meet the criteria for a mental disorder should not be admitted to a University or to get a license, but t least they should be in therapy and provide some documentation that they are improving.I just read here in Quora that someone’s therapist is doing the Zoom meetings from bed! That sounds like depression to me, and maybe that person should be looking for help before s[h]e can help others. The same goes with clinicians that smoke weed before sessions, or examples like that. There are different types of background screening mechanisms but most of the places I mentioned do the basic and the frequently used:Basic Screening PracticesEmployment reference checks.Personal reference checks.Personal interviews.Confirmation of education.Written application.On-the-job observation.Frequently Used PracticesLocal criminal record check.State criminal record check.FBI criminal record check.State central child/dependent adult abuse registry check.State sex offender registry check.Nurse’s aide registry record check.Fingerprint background checksMotor vehicle record check.Professional disciplinary board background check.Infrequently Used PracticesAlcohol/drug testing.Psychological testing.Mental illness/psychiatric history check.Home visits. In the case of therapists that will work on their own, in their private practices, there is no screening in place because there is no regulation. The State requires a license to be renewed every 2–3 years, but there is not even supervision mandated once the clinician is licensed. Continuous education is required, but nothing else.I think that’s irresponsible of the authorities. They regulate almost everything else, but they don’t regulate what happens inside the clinician's office. The client is completely on his/her own there, susceptible to be abused, retraumatized, manipulated, or exploited. Some of my colleagues think that I am too corporate because I suggest having quality control over supervisors at the Institute where I work. I just think that it has nothing to do with having worked in corporations before. I just think that we should all contribute to the improvement of our society by monitoring the services we provide, especially if the mental stability of the clients is at stake.

A friend of mine who is even further to the left than I am claims that Bernie Sanders is in the pocket of Big Pharma, which makes him another corporate shill. Is there any truth to this?

I have looked at this question. I have found no evidence that he is in the pocket of Big Pharmaceuticals.I would look at the bills he has Proposed , Sponsored or voted on.
