Kerala has declared Coronavirus a "state disaster" after three confirmed cases. What happens now?

The state of Kerala has declared Corona Virus impact as State Calamity (A State of Health Emergency ) by invoking the provisions of Sec 2(d) of the National Disaster Management Act 2005.With this the state has many executive powers to coordinate and work upon with this calamity. As reclarified by State CM and Health Minister, the decree is NOT MADE TO MAKE PEOPLE PANIC, rather to ensure effective coordination of state resources to fight against the deadly viral attack.Isolation wards set up in major hospitals of the state with WHO protocols of personal protection being observed.So far, only 3 cases are reported which is still minimal, but Kerala expects more cases as nearly 2400+ people are under medical surveillance and 84 quarantined across the state, due to their case history of visiting China and likely chances of being affected.With this official decree, the state administration has sweeping powers to do anything to control this disaster.The entire leaves and holidays of medical staff and doctors has been cancelled and all being asked to report to duty.Private hospitals, clinics and diagnosis centers were instructed to feed all data they have into DHS Central Surveillance system to moinitor any remote chancesCollectors, Subcollectors and other administrative officials who were about to go on annual training at Civil Service Academy in Mussoorie has been recalled and asked to report back to dutiesThe entire medico fraternity has to attend all mandatory training in handling and treating NCoV viruses as per WHO protocols.It now became mandatory for all people to cooperate with State Health Inspectorate. Hiding any information from Health Inspectors or Social Medicine Doctors on visit, is a criminal offence.The Health Inspectors now have powers to inspect all private premises even without a warrant.The govt has notified Police department to arrest any one and forcibly admit in authorized NCoV treating hospitals, in event the person showing symptoms and refraining modern treatments.The police also been ordered to arrest anyone under Non-Bailable charges in event of spreading misinformation about Corona Virus, that can create panic or misguides public.The State Medical University can legally mobilize 1 Lakh (100,000) medical student fraternity for mandatory NCoV public surveillance and treatment support areas. The university has now ordered for so which will be part of their mandatory duty.Collectors now have powers to restrict movement or close any area, if deemed unsafe by DMOs, in event of any chance of epidemic. Using these provisions, movement into Kerala from Wayanad border has been limited by Wayanad collector and blanket ban has imposed for any sort of group activities like picnics, excursions, study holidays etc by educational institutions.Collectors to daily chair District Medical Committee meetings and DMOs are required to update the progress of surveillance and details of observations to the collectors. This will be evaluated at State High Power Committee for Healthcare affairs on weekly basisDistrict Education Offices are now advised to conduct regular programs in schools across each district to train students, teachers and parents in sanitizing their environment, body and use of masks etc, apart from general medical awareness of NCoV.LSGs are now legally mandated to conduct regular clean ups and public sanitation programs to avoid any remote chance of epidemic. Its now a legal offence for anyone on surveillance or quarantine to discard the incubation period. Out of 60 who came directly from Wuhan to Kerala and kept under surveillance, 2 have escaped and fled to Saudi Arabia. The DHS has informed Immigration Bureau and Ministry of Foreign affairs to reciprocate the matter with Saudi counterparts on the same.These are the current implications of declaring this as State Calamity. The government also activated the SOP to prevent outbreak and coordinating well with NCDC of Indian government.The state has deployed nearly 200 Health Inspectors and 171 Social Community doctors as part of surveillance and social counselling. In this year of severe drought I am reminded that insanity is doing the same thing again and again while expecting a different result.So we can expect an economy that is being hammered by COVID to be hammered again by wildfire.In Marin County, Mt Tamalpais hasn’t burned in a hundred years. At the base of the Mountain, on the down wind side, is the “theme park village” of Mill Valley, where every house is worth at least a million dollars and many houses sit empty, as investments, while appreciating in value.Empty bedrooms don’t feed kids into the schools, which have been starved for cash for decades.At some point you’d think that the schools would take it upon themselves to produce the intellectual muscle that would synthesize a new solution to the wildfire problem.But then there’s Catch 22.Every elementary school has a fire alarm system with a FACP (fire alarm control panel) in the administrative offices. This system is inspected every year by a facilities & operations staffer and then by the Fire Marshal. If a red light is blinking on the FACP, indicating a “trouble” (a short or open in the circuit) then a Fire Alarm Technician has to diagnose the problem and fix it. This labor is expensive.No school administrator wants to antagonize a Fire Marshal by supporting a fire safety video that doesn’t toe the official line. Every Fire Marshal wants to deliver that message on camera and enjoy 15 minutes of fame by being the talking head in a fire safety video.So what happens when a video script comes along that would encourage kids to get into the training and education pipeline for the jobs of tomorrow that will help us prepare for, prevent and mitigate these trillion dollar suburban forest fires?The schools don’t have the political capital nor the life safety system repair and improvement funds to write the “letter of interest” that will open doors for funding from an unlikely corner of County government…. a citizens’ advisory committee on fish and wildlife related issues, appointed by the County Supervisors and with money available from the game wardens’ fine money fund. This Committee has the power, to create videos on the “scientific principles of conservation” for “formal supervised curriculum” in the schools, under the terms of the California State Fish & Game Code section 13103(a). (You can Google this.)So how do you know when your schools are really broke and the educational mandate has been broken beyond repair? When the schools can’t afford to lend moral support to a “shovel ready project”, 25 years in the making, while kids who are supposed to be doing distance learning at home, for lack of motivation, can’t or won’t study and do homework.Here’s an example. In Sonoma County, which has been hammered by trillion dollar suburban forest fires three times in three years, the Assistant Superintendent of Schools, Kim Vallee, agreed to watch a one minute movie trailer of the Sonoma County Middle School version and then clawed it back…. when she knew that letter was the sole remaining prerequisite for video production funding from the County Fish & Wildlife Commission (Chaired by Crystal Norris). How is the Juvenile Justice Act implemented in India? What measures could be taken to improve it?

The department has already taken the following initiatives for Implementing the Juvenile Justice (Care and Protection Of Children) Amendment Act 2006:Delhi Juvenile Justice Care and Protection Rules 2002 have been notified on August 19, 2002 u/s 68 of this Act.One Juvenile Justice Board as per Section 4 of JJ Act 2000 has been notified on 10/4/2003 vide notification no. F.61 (SC)/DO-I/DSW/2003-04/3709-727. After the completion of the term of the Juvenile Justice Board for three years a fresh notification dated 10/4/2006 has been issued.Four Child Welfare Committees have been notified u/s 29 of the Act. The offices of the Committees are located at Kasturaba Niketan Lajpat Nagar, Nirmal Chhaya Jail Road, Sewa Kutir Kingsway Camp & NPS Mayur Vihar.Three Observation Homes have been notified u/s 8 of the Act for the Juveniles in conflict with law. One of the Observation Homes at Delhi Gate is being managed by an NGO, Prayas, under an agreement with State Govt. One Observation Home u/s 8(1) for boys is being run by the State Govt. at Sewa Kutir, Kingsway Camp & one special Home U/s 9(1) is being run at 1 Magzine Road, Delhi and Observation Home for Girls is being run at Nirmal Chaya Complex, Jail Road, Delhi.a) Eleven Children Homes have been established by the Govt. for the care and protection of the children during pendency of inquiry and subsequently for their care, protection, education, development and rehabilitation vide notification no. F.61 (NOH)/DO-I/DSW/2002/5218-236 dated 10/6/2003 u/s 66 and 56 of JJ Act 2000. In these Homes apart from boarding and lodging the children are provided vocational training, recreation and counseling facilities which is required for their emotional, social and psychological development. b) Out of these eleven Homes, three are exclusively for the mentally challenged children. In the case of girls, after attaining the age of 18 and if they are not restored, they are sent to After Care Institution for their rehabilitation and when marriage is possible to be arranged, the same is also organized.Ten District level Visiting Committees have been constituted vide notification no. F.61 (NOH)/DO-I/DSW/2002/5358 dated 12/6/2003 for all the Districts to inspect the Children Homes advise and guide for their improvement and development.Six Homes run by NGOs have been notified as Shelter Homes to provide immediate care and protection to the children in need of care and protection.Eleven NGOs are recognized as Adoption Agencies. Foster care services are carried out by the Department itself. The department is also managing two After Care Homes; one for Girls at Nirmal Chaya Complex, Jail Road and another for Boys at Narela, Delhi.JJ Fund u/s 61 has been created recently with a corpus of Rs. 10 Lacs. This fund shall be administered by the State Level Advisory Board which has been notified u/s 62 of the Act vide Notification no. 61(AB)/DO-I/DSW/2002/11901-956 dated 24/12/2003 for a period of three years.
