If you are not going to hire an attorney to do this for you, it’s important to draft the demand letter with a rational tone, and with little emotion as possible, which is based on actual facts.Note that after this letter is received, the relationship with this person is damaged, and might never be back to the level as it was before. If this demand letter is sent to a business, contractor, freelancer, individual with whom you may have future dealings, please consider these consequences.Structure of a general Demand letterThe first part, the introduction of the reason of the demand letter, will be a review of the facts that caused writing this letter. The facts are the important component and the basis of your demand. Remember here that you catch more flies with honey than vinegar; so you want to be polite and respectful. Considering the demand letter is by nature a threatening letter, it’s better to keep the facts straight and there’s no need to express extra aggression. The aim is to reach an agreement, which both parties can live with.Instead of threatening to take them to court, you could suggest a meeting to discuss options or perhaps enter mediation. Remember that an angry letter may bring about an aggressive response and further postponement of a resolution. I have been wanting to write this answer long time ago. Especially with the consistent release of scandals/problems this year (2020–2021) from k-pop idols and companies.Disclaimer: I do not mean to disrespect or harm any idol or fan. I am writing this answer based on my perspective— which can change and develop over time. LONG ANSWER AHEAD.(A photo of ASTRO's Cha Eunwoo’s handwritten apology letter regarding Itaewon outing) [1]Another renowned aspect that fans always demand when an idol say, act, or represent something/someone that is harmful, controversial, or problematic is an apology.You will find a lot of times k-pop fans trending on social media for a certain idol to apologize, or even mass emailing the company to issue an apology. Then get bashed or praised for it after publishing it.What I want to discuss is how us as k-pop fans are very oblivious about behind the scene process, not the fact that many of us do not work in a company or do not know what policies and contracts can have— there are limitless legal/illegal scenarios happening under the table.Recently I was reading a reddit thread discussion, about how idols/companies apologies became ridiculous—Almost every time an idol does something wrong, and they post handwritten "apology letters", or the company does it on their behalf.It's always "we are so very deeply sorry for the trouble and heartache he/she/I has caused". They apologize for offending people, not for what they did.[2]Which brings me to the main discussion is: (A) when an idol can apologize vs company apologize? And (B) when should an apology be valid or not?If we draw a scenario where a k-pop idol did something very problematic, the company takes action based on the situation— and this is what I noticed:The company releases an apology when an idol does a mistake.The company releases an apology when their staff does a mistake (that the idol represented; like a piece in a set, or clothes styled).The company let the idol apologize (Hand written letter or personal verbal public statement).The company let the idol apologize with a scripted written/verbal letter written by the company itself.No apology issued.Before I start writing about the examples/reasons/personal opinions behind each number— I want to write about what is the importance/issue of those public apologies:The Apology DilemmaAt the beginning, let's clarify two things about apologies: First, we are biologically predisposed to find reasons (or excuses) to postpone or stop saying we're sorry. Apologizing sounds awkward and vulnerable. There is a loss of power or face involved. Second, companies have a strong tendency to evaluate the situation through a legal lensI personally feel like apologies issued is based on the fandom demographic (aka psychological contract) and money. How money loss can play a role? This is when you have investors’ money at risk. What is a PR team?Public relations people working for a company may handle consumer relations, or the relationship between parts of the company such as the managers and employees, or different branch offices.[3]That is the many cases behind apologies to be honest, they are paid for it because they are good at it. A company can forbid their employee (your idol) to release a public apology. Just like the scenarios of the previous apologies, companies can forbid depending on the contract and both PR team’s advise depending on how much loses or who is in the best interest for this. Again, with the help of the PR team, the idol themselves can decide not to apologize too.Example?Red Velvet's Wendy 'mimicking' African-American people[18][19]Chen for racist comment about Blackface joke[20]NCT in many situations that I lost count of [21]At the end of this all? There are etiquette to issuing an apology from an organizational company & the employer aka idol—Like to Who, What, Where and How.[22]However, with apology or no apology, we should ask a critical question: Is the company or idol willing to commit to change? In my opinion, if idols/companies can’t or don’t want to do things differently in the future, the case for making an apology is weak. There is one recent study showing that the Obamacare insurance mandate saves lives.BackgroundWhen the US Congress was still debating the Affordable Healthcare Act some conservatives argued that providing health insurance to low-income people may not improve their health. Maybe, for example, low-income people couldn’t afford the sizable co-pays or maybe they aren’t diligent in taking prescriptions.Some of these conservatives might raised these arguments insincerely but the claim isn’t entirely crazy. Many people won’t make the best use of modern medicine if it’s costly.[1] The least expensive family plans under Obamacare have an average out-of-pocket maximum of $15,800.[2] Even with the new law, many Americans skip prescriptions on account of cost, especially low-income people that Obamacare was intended to help.[3] So, there’s a real possibility that Obamacare might not be as effective as it’s advocates wished.There isn’t much hard data showing that giving people health insurance or encouraging them to buy it, enhances health. The Oregon Health insurance study couldn’t detect an effect:[4]We did not detect significant changes in measures of physical health including blood pressure (systolic or diastolic), cholesterol (HDL or total), glycated hemoglobin, or a measure of 10-year cardiovascular risk that combined several of these risk factors. Nor did we detect changes in populations thought to have greater likelihood of changes, such as those with prior diagnoses of high blood pressure of the portion of our population over age 50.A review of the literature on health insurance coverage for prescription drugs concluded that “evidence is insufficient to draw conclusions about the effect of policy interventions on clinical and economic outcomes…”[5]The ideal way to test the effectiveness of a policy is to do an experiment. The US IRS recently conducted an experiment in which people were encouraged to get health insurance.The studyIn 2017, the IRS sent an informational letter to a sample of households telling them about the penalty for not having insurance and providing information about getting insurance. The total population had 4.5 million households (8,897,821 people). These households were randomly assigned to either receive a letter (86%) or not (14%).The experiment was done by mistake. The original intent was to send the letter to all households in the sample but the IRS ran out of money so the control group consists of people the IRS couldn’t send the letters to.ResultsThe effect on insurance coverage was modest. People who got a letter were 1.2% more likely to get insurance coverage in that year compared to the control group mean of 69%. Expressed differently, the letter reduced the share of the sample without any insurance coverage by 2.7%.The investigators looked at cumulative mortality in people 45−64 years old. The effect looks small but that’s because the treatment only increased insurance coverage slightly.If you plot the data as a difference, it’s easy to see that the effect is statistically significant by the end of the study.The authors compared the change in insurance rate to the mortality rate and concluded that “each month of coverage induced by the intervention reduced mortality by approximately 11.9% during our sample period.” That’s a sizable effect.ConclusionsThe authors of the study reached strong conclusions:We found positive effects of the intervention on subsequent coverage enrollment decisions, particularly for taxpayers who were uninsured in the year prior to the intervention. We also found that the intervention reduced mortality among middle-aged adults in the subsequent two years, which we attribute to the additional coverage the intervention induced. Our findings thus provide strong empirical support, and the first experimental evidence, for the hypothesis that health insurance coverage reduces mortality.LimitationsThe study did not show statistically significant effects for people younger than 45 or older than 54. That’s probably because it lacked statistical power to detect effects in other age groups.The problem of deductiblesStill, Obamacare may be inadequate. Deductibles are high in many Obamacare insurance policies. That probably discourages people from getting the care they need. That may be especially true for taking prescription drugs for chronic conditions. More than a third of Americans making less than 40,000 a year report that they find it difficult to afford their prescriptions.[6] Many Americans report postponing needed health care on account of cost.This chart suggests that Obamacare’s passage in 2010 may have stopped the growth in people delaying/going without but the problem is still large.[7]Medicare-for-all is a popular solution but it has large deductibles and only provides very limited prescription drug coverage unless one buys supplemental insurance.[8]CommentPresident Trump signed into law, in 2017, a repeal of the Obamacare mandate, so people who do not get insurance coverage do not pay a penalty.
