Madhya Pradesh was a bimaru state, just like today's UP, Bihar and West Bengal. Corruption and favouritism was so rampant that there was no proper system for recruitment in state government jobs. Today, there is uninterrupted supply of electricity, clean drinking water is available, there are good roads in most part of state, there is not only proper drainage system, but it is also covered (I consider it a big big achievement). Just one thing? I’m a certified middle-aged curmudgeon. I could go on for pages about all the things that are wrong with the way society is going. But I’ll pick just one for this answer, lest I make everyone hate me.And, ironically, that’s one of the biggest problems with society today: the inability to tell the truth for fear of offending people.I see this all the time in education.Before I was a teacher, I spent some time as a special education assistant for a public school in a wealthy suburb of Chicago. It was there that I first saw the lengths teachers and administrators had to go to avoid stating the obvious to a parent, lest that parent get offended and/or threaten to sue the school.Your child has severe emotional and behavioral disorders and if you, the parent, don’t get some outside help for your kid, your kid is likely to end up in jail. Your child’s problems are beyond the abilities of the school to help at this point.We could never say that to a parent, no matter how true it was.I saw it even more when I became a teacher.If a student has an attitude problem, I can’t just tell the parent, “your kid was giving me attitude.” I have to document exactly what was said, the context, why I felt it was offensive, and what I think should be done about it. Then I have to wait before I tell the parent, and re-read my documentation to make sure it doesn’t sound offensive. Most of the time, when a student is giving me attitude, I know that the student’s parents won’t do anything about it anyway, so why bother documenting it and punishing the student, when it won’t change the behavior? As a former overweight child (now overweight adult), I thought this was a good idea. It is not an empty threat. The short deadline for compliance is proof of that. When the federal government issues letters such as the one it sent to North Carolina, it has almost complete discretion as to how it sets the deadline for compliance. If the feds are willing to compromise on the issue, or if they think the state has a credible argument for why what they're doing is or should be permissible, the feds will give the state weeks or months to respond. But in this case, the feds gave them less than a week. That signals that the relevant federal authority is convinced that North Carolina does not have a legal leg to stand on.I reasonably believe, and therefore assume, that if North Carolina does not comply with the instructions they were given by the Department of Education's Office of Civil Rights, the Department of Education will begin the process of terminating North Carolina's access to federal funds. This will probably take several weeks to implement, and probably be fully in place by the end of summer absent court action preventing it. The main impact will be that North Carolina's public schools will receive no federal education assistance of any sort. North Carolina, in 2015, spent about $8.95 billion on education, with $891 million of that coming from the federal government (not including nutrition funds, which are administered by the Department of Agriculture and would not be immediately affected by action taken by the Department of Education); thus, this will represent a 10% cut in their education funding across the board. In addition, no student attending a college, university, trade school, or other postsecondary institution in North Carolina will be eligible to receive a Pell Grant or participate in the Direct Guaranteed Student Loan Program, which will probably cause enrollments at North Carolina colleges and universities to plummet in the fall. (Unfortunately, the data portal at the Department of Education that would allow me to determine how much money the feds send to North Carolina as part of the student loan program is down for maintenance today.) All of these effects can probably be put in place in time for the start of the 2016-2017 school year in August, assuming that North Carolina is unable to get a court order prohibiting such action, which they will no doubt try very hard to do.The Department of Education does not have to sue North Carolina before it can terminate access to federal funds; the decision to do so is an administrative one that falls within the competent authority of the administrative officers of the Department. North Carolina has avenues available to demand both administrative and judicial review of that decision, but the process of terminating funding will continue while those reviews are being conducted, until and unless a judge orders otherwise.
