I hear this argument all the time and it is wrong. I live in Illinois and I have lived in Indiana. I walked in and said I wanted to purchase said rifle. I filled out the background check and purchased the rifle.His eyes went wide when he realized I was correct in saying that I had to complete a background check and then provide a dealer to have said rifle shipped to.A couple of days later I picked him up yet again and drove him to my local gun store to pick up the rifle. Before I could though, I had to fill out another background check for this dealer. Then I was able to leave with the rifle. It took a TOTAL of 3 DAYS for me to get the rifle.The same is true the other way around. I know this because of a previous purchase when I lived in Indiana and had purchased something I liked in Illinois. Now, criminals do not complete background checks or go through these steps. They purchase guns that have been stolen or through other illegal means. It is not logical that this happens at all because it doesn't happen.*Edit*Ok I just received a comment that someone could lie about where they live and still get the gun. In order to purchase a firearm you have to show a driver's license or state ID. On it is your address. Also for people who live in Illinois you have to show your FOID card which is formally called a Firearm Owner's Identification card. You have to have the second ID to purchase and own a firearm and both have to have the same address on them. Also for those who think I went to Indiana to purchase this rifle because it was illegal in Illinois, this is what it looks likeThey are perfectly legal to own. The stores I went to in Illinois near me did not have them in stock so I drove 30 minutes away in Indiana to a store that had one and followed the laws of both states and the federal laws to the letter.*Edit 2*I am willing to have a reasonable debate with people. This ‘’”common sense” gun control measure is completely lacking in common sense and it seems it is mostly the people who have a clear understanding of guns, gun laws, and how criminals operate are the ones who get it.I live in California and do my best to be a lawful gun owner; this becomes increasingly more difficult every year as the state passes more gun laws that are even more confusing and poorly written that even attorneys cannot figure out what they mean. We have to wait years for the courts to iron things out so we do our best to not become the test case and have our life ruined to be the test case for the courts to take their time to figure things out.I am not familiar with the Oregon law, but here are some issues with universal background checks. First there is a legal distinction between transfer of ownership of the property and the temporary transfer of the property so another person can borrow it to use. A temporary transfer can occur when the owner and borrower remain in each others presence (I let you shoot my gun at the gun range and I am with you the entire time) or I loan the gun to you to take to the gun range for the day (I do not go with you). In this second case, the loan can be a few hours or a few days or months. Do both types need a background check. Why do you need a background check if you are going to shoot my gun at the gun range when I am with you? In CA now, that is required and then I have to go through a background check to get it back, and both require a 10-day waiting period before the gun can be transferred. How does that improve safety?What about a situation where my friend is going overseas for work for a year. He wants me to store his gun in my gun safe because he has not other place to store his gun and the country he is going to will not allow him to take his gun. I will store it but not shoot it. Oh wait, I need to go through a background check to have it registered to me even though he is the legal owner. When he returns, he will have to undergo a background check to get his legally owned property returned to him and have to wait 10 days before he can pick it up. How does that make any sense. All the UBC does in encourage him to do is store the gun in a less secure storage facility where it is easier for criminals to break in and steal, or do something illegal like violate the rules of many banks and bring it into the bank to store in a safe deposit box.The other alternative is to violate the law and give it to the friend and hope nothing happens that causes law enforcement to have any reason to search the house and get a warrant or have a legal reason to get access to the gun vault. Of course, the law does not make sense and many do not keep up with the large number of laws and first learn about them when they are being placed in handcuffs. They were arrested because some unrelated issue brought law enforcement into their life and the officer just happened to noticed a gun related problem. This is why so many gun owners refuse to let law enforcement officers into their homes, refuse to let officers voluntarily search their vehicles and will never answer a question from law enforcement officers without an attorney present. We have known too many gun people who do everything they can to be law abiding all of a sudden get put through the legal grinder because one cop noticed one thing he or she thought was not right.As for the pastor in Oregon, his intention was to remove the AR-15 from the streets. He did not want to have it at his house, so he had a gun person he knew store it in his safe until the pastor could arrange to have it destroyed. Basically, he was not following the letter of the law, but was attempting to act responsibly to ensure the gun did not fall into the wrong hands, which is in keeping with the spirit of the law. The DA probably declined to prosecute because that would create bad publicity which he does not need if he wants to be re-elected (the downside of the office of DA being an elected position; decisions are often made based on politics and not justice).Depending on the area of Oregon, it could be very difficult to find a jury to convict anyone charged with violating this law. I have spent significant time in eastern Oregon. Last year, while traveling through eastern Oregon, I had the opportunity to speak with the Sheriff of one county and he basically said he refuses to enforce such a terrible law and the citizens and 2 FFLs in the very large county know this. Some people would have to drive 3 or more hours to conduct a background check in this remote area so nobody cares what Salem wants. Even if he tried to enforce it, no jury in the county would convict. It would never make it to a jury because the DA would never bring charges, that is if he wants to be re-elected.Finally, I can assure you that criminals are still getting their guns without background checks. It seems like the gun control crowd forgets the most important fact, criminals are criminals because they do not care about laws, they have no problem breaking them. Add to that the fact that black market guns often cost 10 to 50% the amount of legally purchased guns, why would a criminal pay more for a legal gun when he or she stands a chance to fail the background check?I work at a high school with a significant amount of gang activity. We find at least one student with a gun a week. They are all prohibited because they are under 18 but they all were able to get their guns and all avoided the background check. The majority come from homes where parents do not own guns and are flabbergasted that their kid has a gun. A search of the house usually turns up a few more guns stored in the kid’s room.When I want to gift my son a .22 rifle for his birthday, he has to undergo a background check. Fortunately, CA allows me to give him the rifle and then we send in the paperwork with the money and they conduct the background check after the transfer has been made. If my son were to fail the transfer the state would send a letter letting us know that and then I would have to take the rifle back or we would have to turn it in to the police. If I took it back, I would have to send in more paperwork and money to undergo another background check even though I went through one when I first bought the rifle.All universal background checks do is bleed money from legal gun owners, make people feel they are safer, and then when the next mass shooting occurs and shatters the fantasy, there will be calls for yet another law that will not make us any safer.Guns are here to stay. They are simple to build. They do not require special tools or parts. I have built 4 from scratch myself and though they ended up costing more than buying a manufactured one, I also had the pride and satisfaction that comes with making a rifle with my own hands, taking my time to make one that was of much higher quality than any I could have bought at my local gun store. If I can do it, a majority of people can.Realize also that where ever drugs are sold one can find guns. If the local drug dealer does not have a gun to sell you, he will certainly be able to connect you to a person who can. The two are often trafficked together. We all know that the war on drugs has been so successful at stopping the flow of illegal drugs into our communities (sarcasm for those that have a hard time recognizing it).
