Without discussion and paperwork signed by the two people (photographer and model), here is the legal situation:The model has no usage right on the photos at all. They are protected by the photographer’s copyrights and permission would be required for any posting, printing or other use. All they can do is display the physical prints they got, with no other reproduction or digitization allowed.The photographer can display, post, reproduce, print and whatever other use they want, with one clear exception: without a model release, they cannot make a “commercial use” of the image. But here, that term has a specific meaning. It specifically refers to advertisement or promotion of a product, business, organization or cause. The photos CAN be sold as art prints, digital downloads, etc. They can also be sold to a newspaper or magazine for “editorial use” (which common English includes in “commercial use”, even if the law doesn’t).Both people are being VERY unprofessional if they are not talking about the usage rights of the photos. The model should be expecting to sign a model release giving the photographer the rights to use their image in just about every way, if he/she can actually manage to sell the image to someone that wants to use them. That’s generally the whole purpose of modeling in the first place.And the photographer should be expecting to grant usage rights for portfolio, personal prints, social media, and other related uses. Ideally these usage rights and physical prints (or at least digital images) are granted and agreed to in the same model release. Do I have a model sign a model release if they paid for the photoshoot?

They paid you, you can not use the photos to promote your business unless they sign a release. Many models do TFP (trade for portfolio) work in which you take their photos for free, give them copies, and both of you are able to use them to promote yourselves.Having a model pay for the shots AND asking for a release is a bit over the line in my opinion. Maybe offering a discount would be in order. Whatever you do, make sure anything you agree to is always in writing.
