UPDATE 7/29/19 - The IRS issued a Private Letter Ruling (“PLR”) on May 16, 2019, to a taxpayer who requested a legal answer to this question (and likely paid tens of thousands of dollars - see description of PLR applications here, and therefore I suspect 23andMe helped with the filing) which determined that a portion of the 23andMe genetic test, when used as part of a health testing product (see website), can be considered a qualified medical expense (“QME”). As a QME the expense would be reimbursable under an HSA program. 23andMe has developed an online expense receipt generator and cost allocation calculator to help customers determine how much, pro-rata, is allowable.Some feel this may open the door to other consumer oriented health products not currently considered a QME, but you shouldn’t rush out to buy your Apple Watch having already booked your tax savings…ORIGINAL RESPONSE:Let me start by saying I’m a big fan of both HSA’s and the potential of genetic testing to improve our health. Companies like 23andMe, Ancestry.com and others will play a bigger role in wellness as time progresses.However, for now the answer seems to be no. That said, a little more detail may be helpful because the answer could change.As Wiley indicates in his response, HSA funds are designed to be spent on health expenses. The details are contained in two IRS publications, IRS Pub 969 Health Savings Account and Other Tax-Favored Health Plans and IRS Pub 502 Medical and Dental Expenses. Pub 969 describes how HSA’s work and references Pub 502 for a description of what the IRS considers “qualified” medical expenses.Specifically, Pub 502 says medical expenses are:“the costs of diagnosis, cure, mitigation, treatment, or prevention of disease, and the costs for treatments affecting any part or function of the body. These expenses include payments for legal medical services rendered by physicians, surgeons, dentists, and other medical practitioners. We do not provide medical advice and the service has not been approved by the FDA for diagnostic testing. If you have concerns or questions about what you learn through 23andMe, you should contact your physician or other healthcare provider.”Having previously been the CFO of a venture-backed software startup, I’m 99.9% certain the general counsel drafted this language. It’s certainly how I would have responded were I managing enterprise risk exposure on behalf of my investors.Does that mean you cannot claim the $199 charge by 23andMe as a legitimate health expense?I agree with Wiley. While this is a gray area a stronger taxpayer argument - should you ever by challenged by the IRS - includes taking the recommendation of your doctor that it would be useful to prevent or avoid some future, unknown health condition.
