Can a person with a Medicare Part D plan switch plans midyear if her original plan stops covering a needed drug?

Unfortunately, unless you qualify for low income subsidies or move from a plan’s service area, you cannot disenroll midyear and switch to another plan.That being said, Part D plans are highly regulated by Medicare and cannot just remove a drug from the formulary midyear. The only exception to this rule is if a brand drug has a generic equivalent released. If that is the case, plans can remove the brand drug from the formulary and replace it with the generic drug ( generally on a lower tier=lower copay). They would have to give you 30 days notice before no longer covering the brand drug.Most states require that pharmacies fill prescriptions with a generic equivalent ( if there is one available ) unless the doctor states otherwise. So the chances are good that your pharmacy would dispense the generic anyway. Meaning you wouldn’t see any difference in coverage other than possibly a lower tier and/or co-pay.It is possible that you cannot take the generic drug for some reason, possibly due to an allergy or something like that and if that is the case you can petition your plan to pay for the brand drug. Your doctor would simply have to submit a coverage determination request. He would have to demonstrate that the covered drug does not work for you. Chances are good that they would cover the brand drug in that case. You would pay a higher co-pay however.Of note, Part D plans just don’t arbitrarily make decisions to remove or change the coverage of drugs. As I stated initially they are highly regulated by CMS and have prohibitions on what they can and cannot do.Specifically, there are rules about six classes of drugs where every single plan has to cover “all or substantially all” drugs within six classes: immunosuppressants ( transplant rejection), antidepressants, antipsychotics, anticonvulsants, antiretrovirals (AIDS/HIV), and antineoplastics (anti-cancer).Additionally, they are required to cover at least two drugs in every therapeutic class. If the therapeutic class only has one drug they are required to cover that drug.There are several types of drugs that they are not allowed to cover unless they have an enhanced benefit. These types of drugs include cosmetic drugs, weight loss drugs, fertility drugs, vitamins and minerals, drugs to treat cough and cold symptoms and OTC drugs.And to circle around to the original question, they are not allowed to make negative changes throughout the plan year except in cases where a brand drug go generic as stated in my example above or if a drug is recalled due to safety reasons. They cannot add a utilization management rule or move a drug to a higher tier.They can however add drugs to the formulary, remove utilization management rules and lower the tier. These are called positive changes.
