It has been reported ( Cessation and Reavailment: Could I Lose My Refugee Protection, and My Permanent Residence Too? ) that renewing one’s passport, or using one’s passport to travel (even to a third country, not the country of origin) may be considered a ground for a loss (“cessation”) of one’s refugee or protected person status in Canada. Supposedly, since 2012, that may even be the case not only for a refugee or a protected person, but even for a permanent resident of Canada whose permanent residence was granted based on his refugee or protected person status.Technically, the Canadian government may claim that by obtaining an Iraqi passport, or by traveling on an Iraqi passport, the person has “voluntarily reavailed” himself of the protection of the Iraqi state; that may be considered a ground for terminating (“ceasing”) one’s refugee or protected person status.Generally, the Canadian government prefers that refugees/protected persons/ permanent residents who have been refugees or PP only travel outside of Canada on a “Certificate of Identity” (a Canadian travel document for refugees etc: Travel documents for non-Canadian adults and children), rather than on a passport from their country of origin.However, the Certificate of Identity Office (the agency that issues those documents) is presently (summer 2020) closed due to the epidemic; this may make travel on a country-of-origin passport unavoidable for some persons who need to travel.A more detailed discussion of these issues, and the legal reasoning that can be used by the government for making a PR cessation decision (or by the individual for arguing against such a decision), can be found here:Chapter 12 - Applications to Cease Refugee Protection. Canada is currently obliged legally to provide security to ‘ Internationally protected persons,’ while such persons are in Canada. That legal obligation ceases when they officially step down from their roles as members of the R/F which is, I think, at the end of this month - therefore Canada are still currently paying up until that date when H&M’s official status changes and they will no longer be deemed to fulfil the criteria required to qualify as internationally protected persons.However, H&M have insisted in a plan published on their own website that they ‘will continue to require effective security to protect them and their son.’ The statement went on to explain why they needed to require it:“… [the] dukes public profile by virtue of being born into the Royal Family, his military service, (my emphasis) the duchess’s own independent profile (my emphasis) and the shared threat of risk level documented specifically over the last few years.Now call me stupid, but I am at a loss as to why an estimated sum of up to £20 million (cost estimated by the Metropolitan Police) should be paid by the taxpayer, particularly when any % of that is going towards ‘the duchess’s own independent profile..’. What does that even mean? That the tax payer should pay for the fact she had a part in a minor tv series, ran a website and occasionally defaced fruit with a biro before her reincarnation as an aspiring ‘nation’s sweetheart?’ That we pay for the training of British police and then take them off the streets of Britain to loiter around a film set? What happened before Harry? How did she manage to keep her independent profile and herself safe then?Equally, I was unaware that the aftercare provided by our Army, Navy or Airforce had expanded to provide ‘security’ for those no longer in the services. After all there has hardly been a finger lifted to help those veterans who are homeless or who have mental health issues due to their experiences whilst serving this country; but maybe it’s not what you know, it’s who you know.
