But I also wanted to point to the reason pilots check control surfaces prior to takeoff.5 years ago, a Gulfstream 4 was leaving Hanscom Airport (KBED) outside of Boston. It accelerated to 129 kts but never left the ground and ended up next to the parking lot where I worked for 5–6 years. The three person crew and 4 passengers were killed.The reason was simple - the flight crew failed to disengage the gust lock on the G-4 and failed to test the control surfaces prior to takeoff. The NTSB summary follows…Vice Chairwoman T. I will suggest checking with the Attorney that filed a petition on your and employer behalf.Another way to do it:Assuming your H1 will start from 10/1/2019, your spouse may leave the USA, get h4 visa (stamping) and returns to the USA on H4 statusYou can file Change of Status (CoS) using form I-539[1]. Though it may take time, but you can use option 1 anytime. When your spouse leaves the US, his/her I-539 Change of Status application will be automatically abandoned.As longs as your spouse CoS application should reach USCIS before your F1 status expiry date, you are fine.
