Say a minor was accused of a crime, but authorities decided he should be put in a mental institution. How would that play out immediately after his arrest?
If police officers think someone meets certain, very specific, criteria for mental illness, then we can take that person to the nearest emergency room, fill out a sworn statement about the facts which led us to that conclusion, and leave the person there (adult or juvenile doesn't matter). After that, the medical professionals take over, and a judge reviews the case. From that point forward, it's mostly about the opinions of the doctors, overseen by the judges, and eventually a jury can even get involved.The criminal charges mentioned in the question can wait until after the person is released from the hospital, or an arrest warrant can even be obtained so that the person can go directly from the hospital to jail (yes, the hospital can cooperate in this regard without violating privacy laws).This, of course, brings up questions of whether the person was “not guilty by reason of insanity" or is even mentally fit to stand trial. When those questions arise, there is a whole different set of hearings which take place as part of the criminal case. In some scenarios, the person can be judged unfit to stand trial, sent to a secure psychiatric facility for as long as it takes for treatment to make them fit, and then stand trial afterwards.Keep in mind that “unfit to stand trial,” “not guilty by reason of insanity,” and the standards under which an officer can do an involuntary admit all have very different definitions and requirements. It's absolutely possible, even common, to fit into one of those categories without fitting into the other two.In short, if the hypothetical juvenile from your question really needed to go to the hospital for a psych eval, then he probably wouldn't be arrested in the first place.
