What can I do?Please view my answer from the perspective that I am not a lawyer and do not know what country you are currently working in or their laws. That being said—Does your contract specifically state a job title? Did they provide a job description? If there is a job description and what you are now being asked to do is not part of the duties of the job you were hired to do, there is potential for breach of contract. If they hired you to be say an Accountant and you are mopping floors instead of doing accounting, they are violating the terms of your contract. If they never provided a job description with a list of duties then you need to find a widely accepted generic job description for the job title you have. Your position should be - I was hired to be a (job title). The industry wide accepted duties for a (job title) are (list them) I am more than willing to perform those duties. However, I was not hired to perform (list menial tasks) and consider this a breach of our agreement, making that contract null and void. An attorney needs to view the language in the contract to confirm that in fact changing your job duties away from (job title) does in fact violate the contract.The second issue is “punching bag”. I do not know what you mean. However, in the US there is an issue that could also nullify your contract specifically forcing you to endure a HOSTILE WORKPLACE. No one in any civilized country signs up to be abused verbally or physically. I am pretty sure that your contract does not include enduring any type of abuse.Of course, you could simply refuse to perform any tasks that are not a normal part of the work of a (your job title) but without reading the text of the contract there could be penalties for that action.While I am not sure what advantage it would have been to you to sign a 5 year contract and apparently one with no conditions under which you could leave, I am also concerned about the legality of forcing someone to perform tasks outside of the scope of work in their job description much less enduring any kind of abuse. It sounds like indentured servitude which was finally abolished in 1917.It is likely that there are penalty clauses in that contract that obligate you. So, at this point you do need an attorney to identify your obligations as well as any conditions under which the contract would be considered void. A change in the scope of the duties and the abuse sound like a good place to start.I am sorry that you are in this kind of predicament. You have learned a hard lesson about contracts.
