PDF Editor FAQ

What is the best way to stop a law from being ambiguous?

Like totally unambiguous? 100%, completely clear? Then you have to make it extremely verbose and intricate. There’s a tension in setting forth laws: on one hand, you have flexibility — which is a more positive word for ambiguity — and on the other hand, you have simplicity. You can’t have both, and often what you gain in one, you lose in the other.Take something that’s at the very far “flexibility” end of this continuum: antitrust laws. The Sherman Antitrust Act. It reads, in pertinent part:Every contract, combination in the form of trust or otherwise, or conspiracy, in restraint of trade or commerce among the several States, or with foreign nations, is declared to be illegal.Although I’m not quoting the entire statute, I’m not hiding the ball either. There isn’t some other section that defines what “restraint of trade” means, for example. The quoted part is really the full “teeth” of this act.But it can’t literally mean what it says, right? I mean, if I sign up for a 1 year cell phone contract that has an early termination fee, at least arguably, that’s a “contract … in restraint of trade,” insofar as the early termination fee discourages me from going to a competitor whenever I want. Hell, every single patent license is, at least arguably, a contract in restraint of trade. So this statute clearly can’t be taken literally. This was by design. At the time this was enacted, Antitrust law was in its infancy. Congress wanted to give the courts flexibility to proceed judiciously and, to use a modern phrase, let the development of the law be “data driven.”Now go to the other end of the spectrum: the US tax code. It’s intricate and arcane, but you can’t say with a straight face that it’s ambiguous. Every sub-part begins with a nice table of definitions (like this), and those definitions are very precise. Just as an example, here’s a definition of “miscellaneous itemized deduction”:[1][1][1][1](b) Miscellaneous itemized deductionsFor purposes of this section, the term “miscellaneous itemized deductions” means the itemized deductions other than—(1) the deduction under section 163 (relating to interest),(2) the deduction under section 164 (relating to taxes),(3) the deduction under section 165(a) for casualty or theft losses described in paragraph (2) or (3) of section 165(c) or for losses described in section 165(d),(4) the deductions under section 170 (relating to charitable, etc., contributions and gifts) and section 642(c) (relating to deduction for amounts paid or permanently set aside for a charitable purpose),(5) the deduction under section 213 (relating to medical, dental, etc., expenses),(6) any deduction allowable for impairment-related work expenses,(7) the deduction under section 691(c) (relating to deduction for estate tax in case of income in respect of the decedent),(8) any deduction allowable in connection with personal property used in a short sale,(9) the deduction under section 1341 (relating to computation of tax where taxpayer restores substantial amount held under claim of right),(10) the deduction under section 72(b)(3) (relating to deduction where annuity payments cease before investment recovered),(11) the deduction under section 171 (relating to deduction for amortizable bond premium), and(12) the deduction under section 216 (relating to deductions in connection with cooperative housing corporations).Ho hum, just a 12 part definition. And I’m not sure if this is an example, but often in the tax code, you have to go several layers of definitions deep before you have the full meaning of a term. Now, you might say this is an unfair example. After all, the tax code is important. Its scope is sweeping. So of course a lot of ink is going to be spilled writing a law like that. But I don’t think the tax code is any less important than antitrust policy. Neither in terms of its impact to the macroeconomic picture of our country, nor to its impact to those it purports to regulate. It’s just that in antitrust policy, the ambiguities in the statute were seen as a good thing, to allow a flexible and incremental development of the law. In the tax policy, that flexibility wasn’t desired, and if you peruse the tax code you see what it takes to stamp it out.Footnotes[1] 26 U.S. Code § 67 - 2-percent floor on miscellaneous itemized deductions[1] 26 U.S. Code § 67 - 2-percent floor on miscellaneous itemized deductions[1] 26 U.S. Code § 67 - 2-percent floor on miscellaneous itemized deductions[1] 26 U.S. Code § 67 - 2-percent floor on miscellaneous itemized deductions

What are some mind-blowing murder investigations?

Location: Tamil Nadu, IndiaYear: 2005A former minister, belonging to the State Party that was in power at that time, was fatally shot at point-blank range. His sons were grievously injured, his wife’s hand was broken, and his house was burgled. [1][1][1][1]The Police investigations had only one major evidence: the fingerprints found, matched those from numerous other barbaric murders and robberies that had happened for nearly 10 years in the State, between 1995–2005. This one murder case opened a can of worms. Yet, there were no identity records of the culprits, and no weapons left behind except a bullet shell. Also, despite the security checkposts, the group somehow moved across these highways - targeting affluent houses that were remote from towns. In all, between 1995–2005, this group was responsible for:18 deaths (including a schoolgirl, and 3 politicians).64 injuries.200+ break-ins/robberies.[2]Note that this was a period when there was no computer-based database of criminals, crimes, prints, and such. So, with no other better alternative and with minimal financial support from the Department, the Police team’s fingerprint experts then traveled thousands of kilometers to numerous police stations across various states in the country, looking at dozens of ledger books for a match. And, they found one in a state that was 2000 kilometers away from Tamil Nadu.[3][3][3][3]Operation Bawaria:The Colonial remnant - Criminal Tribes Act:The fingerprint was of one suspect, who belonged to a tribe - a semi-nomadic group known for dacoity for over 400 years across North of India. They are believed to have been blamed and pushed into exile by other groups of a major clan after a loss in the war against Mughals in the 1600s. They have been living in forests since then, through the British Colonialism and even until the 1900s as they weren’t accepted as part of the society. In the colonial era, this group, amongst others, was branded under the Criminal Tribes Act and hundreds were either jailed or killed by the British. The English words that specify these groups - thugs and dacoits, have their origins from Hindi words (or related languages) used to describe them. [4][4][4][4]Independent India abolished the Act that secluded these groups and harmed even the innocent people. But, many rogue members of these tribes still continued to engage in dacoity as part of ‘Lorry gangs’, while most others have moved on to establish villages and involve in agriculture.2. ‘Lorry gangs’ and their modus operandi:The Police deduced through various other case files of the prime suspect and known associates that this specific lorry gang has been involved in dacoity through at least 9 states in India as shown below marked by red:The modus operandi of these ‘Lorry gangs’ is to deliver their assigned shipments to their destinations across the country. And on the way back from their legal work, the ladies and kids of these groups, on the pretense of selling miscellaneous items, do reconnaissance of the areas near highways and choose the target houses that are remote but affluent. At nights, the men use weapons such as country-made guns and iron rods that are part of their lorries during their break-ins (hence difficult for the police to find them) and strike anyone and everyone, even if the victims submit to them robbing their homes. They don’t hesitate to kill too. Some groups resort to sexual assaults and are known to leave behind human feces in the crime scenes.[5][5][5][5]3. One fingerprint match tracked to over 2000 kilometers away:Beginning in 2005 with just fingerprints, the Police team, led by DGP S.R.Jangid and ADGP Sanjay Arora, tracked the accused to belong to the tribe. And with support from the various states’ police, 10 arrests were made and 4 trucks were seized over the course of next few years. This resulted in a stark reduction in dacoity crimes across the country4. The brilliant move:Since the groups of the tribe that were involved in dacoity were almost nomadic, it was highly difficult to track the suspects. They just kept moving hundreds of kilometers at every whiff of police. So, the police team then cultivated informers within the tribe and across the key towns and villages, helping them track the prime accused to Kannauj, a town in UP. With the help of local police, they arrested the prime accused - Oma Bawaria, and his wife. Though they reportedly attempted to escape. After more such arrests and two encounters with the gang members that resulted in the deaths of two dacoits, and multiple rounds of scrutiny from Human Rights departments, they finally arrested the remaining members of the gang from Rajasthan. The two prime accused - Oma and Ashok Bawaria, were found guilty by the justice system and sentenced to death by hanging. After this, there have been close to no such crimes happening in Tamil Nadu due to the rogue members of the tribe. This case served as an inspiration for a Tamil movie ‘Theeran adhigaaram ondru’. Albeit a few filmy exaggerations, the movie is a good watch.Reel version of DGP S.R.Jangid on the left:The police team involved in the investigations:Footnotes[1] Gummidipoondi MLA shot dead[1] Gummidipoondi MLA shot dead[1] Gummidipoondi MLA shot dead[1] Gummidipoondi MLA shot dead[2] Operation Bawaria[3] Theeran Real Case Files Revealed! | Mass Hunt for the Bawaria Gang | Jangid IPS[3] Theeran Real Case Files Revealed! | Mass Hunt for the Bawaria Gang | Jangid IPS[3] Theeran Real Case Files Revealed! | Mass Hunt for the Bawaria Gang | Jangid IPS[3] Theeran Real Case Files Revealed! | Mass Hunt for the Bawaria Gang | Jangid IPS[4] Criminal Tribes Act - Wikipedia[4] Criminal Tribes Act - Wikipedia[4] Criminal Tribes Act - Wikipedia[4] Criminal Tribes Act - Wikipedia[5] Ruthless, organised and disgusting: All about the Bawariya gang behind Bulandshahr gangrape[5] Ruthless, organised and disgusting: All about the Bawariya gang behind Bulandshahr gangrape[5] Ruthless, organised and disgusting: All about the Bawariya gang behind Bulandshahr gangrape[5] Ruthless, organised and disgusting: All about the Bawariya gang behind Bulandshahr gangrape

I work in NY but live in NJ. Which taxes are supposed to be taken from my pay check?

As an employee of an employer in New York, NY State income tax is withheld, plus other miscellaneous items like unemployment insurance. You will eventually file a NY State Non-Resident tax return, then use that information to complete a New Jersey Resident return. New Jersey’s return will show your New York State income, and that will be used to compute your tax for New Jersey. But, you get a credit for taxes paid to other jurisdictions, prorated as per the share of total household income for the year.New York has higher tax rates than NJ, so the credit basically leaves you paying NJ income tax just on non-wage income.
