My employer in California is telling me I can't take a paid sick day on Christmas, even though I would be recovering from surgery. What is the law behind the denial?

I agree with Ed McManus’ question: your employer isn’t obligated to pay you twice for one day off. If your employer ordinarily pays one holiday at Christmas, and you qualify to take paid holidays, then you should take Christmas as a paid holiday, period, . . . and see whether you can carry over any sick leave into next year. If you have sick leave and cannot carry it over, then perhaps you try to arrange to take off a number of days between Christmas and the weekend after Christmas. Or days between Christmas Day and New Years’ Eve.If your employer does not offer to pay their employees for a Christmas Day holiday, or if you do not qualify for that paid holiday, AND if you are entitled to paid sick leave as of that day, then you should be able to take it as a sick day after surgery. Get a note from your doctor, identifying the illness or injury for which they’re treating you, the nature of the surgery, and their recommendation that you take that day off.
