How has Israel used UN Security Council Resolution 242 to legitimate its political power over the West Bank, the Gaza Strip and the Golan Heights?

The UN adopts Resolution 242 on November 22nd, 1967.Myth busting Res 242!UN Resolutions come in two flavors: Chapter 6 and Chapter 7. Those passed under Chapter 6 deal with the peaceful resolution of disputes and entitle the Council to make non-binding recommendations. Those under Chapter 7 give the Council broad powers to take action, including war, to deal with “threats to the peace, breaches of the peace, or acts of aggression”.So, it is important to understand that Resolution 242 pertaining to Israel is of the Chapter 6 variety, NOT Chapter 7. A Chapter 7 UN Resolution was adopted when Saddam Hussein’s Iraq invaded Kuwait. By imposing sanctions against Iraq, but not against Israel, the UN was acting in accordance with its own rules. Israel was not given special treatment.Another long-standing myth is that Israel has not acceded to the recommendations made by Resolution 242. However, Resolution 242 cannot be implemented unilaterally, even if Israel wanted to do so! Israel’s legions of critics claim that the Resolution requires a complete Israeli withdrawal. But even if this were so, the Resolution cannot be implemented without arriving first at a negotiated agreement, as per the Resolution. For example, the Resolution calls for a “just” settlement of the Palestinian refugee issue. Meaning what? The Palestinians say that the UN General Assembly Resolution 194 of 1948, gives all the Palestinian refugees of 1948 the right to return, or to get compensation. Israel, denying responsibility for their flight, says that the same Resolution stipulates that these refugees must be willing to “live at peace with their neighbors” and that the Palestinians, having rejected the UN-sanctioned partition of Palestine (Resolution 181), proves beyond doubt they were not prepared to live in peace with Israel.10,000 rockets launched by Hamas at Israeli civilian centers serve to substantiate Israel’s claim!Another myth is that Israel's occupation is “illegal”. Kofi Annan, a previous UN Secretary-General, once called Israel's occupation illegal; but in the view of Sir Adam Roberts, Professor of International Relations at the University of Oxford, it was a “serious mistake” to describe the occupation in this way. In a subsequent letter to the New York Times, Mr Annan's spokesman made what amounted to a public apology. The Secretary-General, he said, had not intended to refer to the legality of Israel's occupation of the territories during the war of 1967, only to breaches of its obligations as an occupying power. And don’t forget that it was the Arabs who rejected Resolution 242 in 1967! But they accuse Israel of not abiding by it!Another important myth to ‘bust’ is the call for Israel to return the land it won in 1967 while defending itself in a defensive war. The aggressors were the Arabs.This is what the myth-makers just don’t get! If country ‘A’ attacks country ‘B’, and country ‘B’ captures areas of ‘A’’s land, then heeding the call to return that captured land would send a rather disturbing signal. It would mean that any country could embark on a military adventure, because losing the war would not matter. The land lost would be automatically returned and the status-quo reestablished. In effect, the UN would be encouraging conflicts, not resolving or preventing them! That’s why returning land captured in Israel’s defensive war is linked directly to negotiations to agree to end the aggressor’s belligerence and to reassure the injured party, Israel, that such events will not occur again.In brief, if the Arabs want to live in peace with Israel, they simply have to pick up the phone and tell Bibi they are willing to drop by for a chat. They will find the Israeli government ready and willing to discuss any outstanding matters pertaining to Resolution 242! Shalom!
