Here are some of the precautions you can take before finalising a property deal.Check the antecedents of the vendor(s) -We all verify title deeds and all connected documents before buying the property. But we fail to verify the antecedents of the vendor(s) . It is better to verify the character and antecedents of the vendor(s) beforehand.If the vendor(s) are habitual offenders and involved in the real-estate offences or other crimes, then it is better to drop the idea of buying the property from them notwithstanding whether the title is perfect or not. If the vendor has good background; and his character and reputation are unquestionable, then the transaction will be very smooth. Even, in future, if there is any dispute regarding title or any other issue pertaining to the property, then you are dealing with a respectable person in the society; and you need not to spend your valuable money and time on unnecessary litigation. You are not facing any embarrassment in the shape of physical or verbal abuse. The issues can be resolved through gentlemen agreement without involving external forces.Check the title of the property-The title of the property forms the foundation of any contract. According to the Indian Contract Act, no seller can pass on to the purchaser a better title than what he already possesses. Therefore, the title of the seller must be clear and free from any encumbrance. Before you buy a property, verify the title of the seller. A search of the records at the sub-registrar's office may be carried out for documents that may affect the property and may have been registered .The report will show the recorded owner of title of the property and changes in the title of the property. If the land is an agriculture land then adangal/pahani/khata of that land or/and Pattadar Passbook and Title Deed can be requested from the seller.Assessment Register Ledger entry (called Khata in some parts of the country) is basically a supporting document of title. It is the entry of the present owner in the municipal/panchayat records relating to house properties. The absence of Assessment Register entry in the name of a current owner can be rectified at any time by applying for mutation. This has become important because it is required for loans, title opinions, electricity meter name change, etc. Assessment Register Ledger entry is changed after a sale deed is executed or after a property is inherited through a will, gift, partition, etc., if applied and requested for a mutation.Verify the title of the seller-The vendor may have acquired his title either by purchase, by inheritance, by partition, by gift, by settlement or by grant. To find out the source of title there must be some document like.Personal inspection of property under sale -Buyer beware is the golden mantra in the immovable property transactions. Therefore, the entire onus lies on the purchaser in verifying the title, ownership and possession of the property. He must take all reasonable steps to ensure that he is purchasing the property from a right person and also a right property. The most important precaution is undertaking a personal inspection of the property under the sale. During the personal inspection, the buyer shall inquire with the neighbours regarding the ownership and possession of the property, disputes if any, character of the vendor(s) , charges/mortgages on the property, joint owners of the property or part of the property etc. This is the most important aspect of the title verification, therefore, it is better at least three persons from buyer side shall take up this task. And they shall make discrete enquiries with various persons in and around the property like elders of the locality, longstanding property owners/tenants, workmen, etc. It is easy to undertake the inspection of site and building in the densely populated areas. It is also easy to enquire in villages where the people could identify persons by name. But it is difficult to enquire in the suburban, newly developing and agricultural lands converted as plots – where no habitation exists. In these cases a lot of effort is required to get the right answers to the questions and at times we may not get answers at all since there would be no person to contact except the vendor or his men.Sale by holder of power of attorney-If the sale documents are being executed by a person holding power of attorney on behalf of the owner, the said power of attorney should be scrutinised thoroughly. The person must not only possess the power to sell property, the power of attorney should also be validly executed. An agreement holder (as explained above) who also has a power of attorney to sell the land and/or building is normally a developer. Alternatively, a person may have paid the entire consideration to the owner and holds on to the property for some time to sell it at a later date for a profit. The sale will be effected by the power of attorney holder on behalf of the owner. Such power of attorney must be properly stamped and registered (if it is coupled with sale agreement/development agreement/given for consideration) . It should also not be revoked.Check the original documents-Always inspect the original documents of the seller and read all the documents carefully before signing them. If the vendor states that the original documents were missing/stolen/lost, then it is better to know the full facts relating to missing documents. Know whether the vendor has filed a complaint in the concerned police station and got the copy of FIR with regard to missing of documents; and/or what are the other steps he had taken to trace them as a prudent person. There is a possibility of keeping the original documents in banks/financial institutions/private lenders to create mortgage/charge over the property by way of deposit of title deeds. So it is better to get full information regarding original documents that are missing. And it is always better to give a public notice with regard to purchase of the property on the basis of certified copies of the title deeds instead of original documents which were lost.Colour Photostat copies – frauds-Today, the technology used in colour Photostat machines is very advanced one; and copies generated using these machines are of high quality. Innocent purchasers can be duped by clever vendors by delivering colour Photostat copies instead of original. Therefore, a proper check shall be done in verifying whether the documents are original or colour Photostat copies.Verify photographs and thumb impressions of the vendor-Section 32A of Registration Act, 1908 prescribes that in case of sale deeds both the vendors and buyers should affix their photographs and thumb impressions along with the document. This provision has come into force from the year 2001. Therefore, if your vendor has acquired the property after 2001 through a registered document, then you have one more evidence to check regarding the identity of your vendor. Verify carefully the photographs and thumb impression of the vendor in the registered document where he appears as purchaser.Tax receipt and bills-Property taxes which are paid to government or municipality are a first charge on the property. Hence, enquiries must be made in government and municipal offices to ascertain whether all taxes have been paid up to date. The owner should also possess the latest tax receipts, which you may inspect. While investigating in different departments of the municipality, you need to ascertain whether any notices or requisitions relating to the property have been issued and are outstanding and not yet complied. While inspecting the property tax receipt, it can be noted that there are two columns in the tax receipt.Make sure that the name entered in the owner's column is correct. The second column will be for the name of the one who paid the tax. Sometimes the owner may not have the tax receipt with him, in such cases, contact the village office with the survey number of land and confirm the original owner of the land. If you are buying a house along with the property, then the house tax receipt should also be checked. Also make sure water bills and electricity bills have been paid up to date and if there is any balance payment to be made, ensure that it is made by the seller.Encumbrance Certificate -Before purchasing the land or house, it is important to confirm that the land does not have any legal dues. Check the Encumbrance Certificate (EC) (EC) issued by the sub register office where the deed has been registered /mee seva centres (in Andhra Pradesh) , stating that the said land does not have any legal dues and complaints.Pledged land-Some people may have taken loan from the bank by pledging their land. Ensure that the seller has paid back the entire amount due. Don't be satisfied with the receipt of the payment made. Release certificate issued by the bank is necessary for all the debts over the land. You could buy a land without the release certificate. But if you want to take a loan in future, the release certificate is a must.Place a public notice-A public notice may be placed in newspapers calling for claims in respect of the property being purchased. Claims can come even afterwards, public notice helps in proving that you purchased the property bona fide and in good faith. This will prove that you have taken all measures that can be expected from bona fide and prudent purchaser thereby you will get favourable order/view from the Courts, in case of any litigation that may arise in future with regard to patent or latent defects in the title of the property.Inspect the plans-If the building is under construction then inspect the plans to check whether they have been sanctioned by the concerned authority. Also check whether the construction was done according to the plan approved by Municipal authority. If there is any deviation from the approved plan, then it is to be verified whether it can be regularized or not. In respect of deviation that can be regularized by paying penalty to the municipal authority, it is better to record, in the agreement, that who should pay that penalty to the municipal authority. If the deviation is not allowed to be regularized then the purchaser is taking the risk of demolition of the building partly/fully by the municipal authorities.Payments of stamp duty-Always verify documents of title to check payment of stamp duty. If the ownership of property has changed hands more than once, examine all the documents for payment of stamp duty by the predecessors. Today, many States (including Andhra Pradesh and Telangana) have amended the Stamp law providing for creation of charge over the property in case there is any deficit stamp duty in any document relating to property. Therefore, the present owner of the property obliged to pay the deficit stamp duty and penalties, if any on the documents registered earlier notwithstanding whether he is a party in it or not.If the property belongs to a minor-In case where the property is owned by a minor, prior approval of the court is required to enable the minor's other/natural guardian to sell the property. In the absence of such permission, the sale could be voidable at the option of the minor on attaining majority. Or otherwise, soon after attainment of majority, the sale has to be perfected by obtaining a registered ratification deed by the person who was a minor at the time of sale.Check the minimum tenure of land if taken on lease-If the flat that is being purchased is in a building built on a land which is given on lease, lease rent would have to be paid for the land by the flat owners. If the lease is to expire shortly, it is possible that the lease rent may increase substantially. Hence, the terms of the lease must be verified before buying the flat.Engage a competent lawyer-There are several laws involved in immovable property transactions. Therefore, it is better to engage a competent lawyer to investigate the title, possession, ownership and other aspects.Reputed attesting witnesses-The attesting witnesses are the persons who actually witness the signing of the sale or any document by the parties and sign as witnesses on the document. It is always important to have reputed and respectable people as attesting witnesses.Check whether the flat/portion is mortgaged to Municipal authority-As per the municipal regulations, the builder/owner shall create charge over 10% of the area under construction to ensure compliance with building regulations. So it is necessary to verify whether the flat/portion of the building under sale is mortgaged to the municipality.NOC of the society-It is advisable to obtain a no dues certificate and no encumbrance certificate from the society (if the property is in the society) to ensure that all dues are paid and no mortgage is registered with the society in respect of the property being purchased. In case the property is in a society, check that all the society forms are duly filled and signed.

Okay, I have to put a plug in for one of my personal favorites.I think that pretty much anyone from the Wu-Tang Clan could fit the bill, but my personal favorite is the Abbot himself: the RZA.(Image Credit[1] )Although his stubbornness and refusal to relinquish creative control of his sound has driven wedges between the members of the Wu-Tang Clan and was a major force in the groups de facto sort-of-breakup, there is no doubt that RZA is one of the most important and influential producers of all time and I rate him as just about the most interesting lyrical composer out there, though that opinion depends on what one finds interesting.The thing I find most fascinating about RZA is that, even while he was leading one of the most historically significant rap groups of all time, reestablishing the prevalence of the East Coast in a period dominated by the West, and (re)inventing hardcore and horrorcore rap, he never stopped being a total, unrepentant nerd.In college, I remember discovering, whilst searching through a used DVD store that had no order whatsoever to its stock, a copy of the Kung-Fu classic The 36th Chamber of Shaolin (which was the direct inspiration for the first Wu-Tang album, Enter the Wu-Tang (36 Chambers)). I bought it immediately and it was not until I got home that I discovered what would be my favorite thing about it: the fact that it included full commentary from Andy Klein “film editor of City Beat in Los Angeles,” and the RZA. That’s right, an old white film critic at a freaking rapper.The funny thing was that the rapper knows absurdly more about the movie than the film critic. In fact he knows more about the film than it makes sense for any human being to know. He can be one of the most spiritual or most worldly rappers ever depending on the record in question, and his verses range from deeply intellectual to childishly silly.His intellectualism and vocabulary may be best exemplified by his verse on the track Impossible, from the second LP of the 1997 masterwork Wu-Tang Forever. The number of both animated and live-action TV shows, movies, and comic books that he references in almost every line would take dozens of footnotes to properly annotate, and the rhymes are folded and refolded on top of each other into a continuous meshwork. Many others might find it ridiculous but I find it totally exquisite.The shortest and simplest example of RZA’s ability to seamlessly slide between gangster and geek might best be shown by the opening lines from the second verse of Must Be Bobby, off his 2001 album Digital Bullet. I don’t know a single other rapper who could pull of such a shift so naturally:I eat rice soaked in coconut milk mixed with tofuSit in the sun six hours and I charge up like GokuFrom Dragonball Z.Imagine you were raggin’ me?That’s like walkin’ through a Blood hood flaggin’ a C.That’s right. He just rhymed “Dragonball Z” with a reference to gang violence, all after talking about his vegan diet. Think it’s easy? Try to do it yourself.Like I said, how interesting a rapper’s lyrics are depends on what the listener finds interesting. As a lifelong nerd with a love of esoterica, I find the RZA’s work continually engaging.He’s not as profound as Kendrick nor as conscious as KRS-One, and his vocabulary isn’t as expansive as Aesop Rock’s. Risk in Construction field can be in Five category as given below .(A) Risk factor of an Engineer from Client Side , while managing construction .( B) Risk factor of a Site In -Charge in Construction Company .Risk factor of an In-Charge from Client Side, while managing construction . The project chief of all BOT road project between Delhi to Kolkata to Chennai to Mumbai to Delhi was killed when Atal Bihari Vajpayee was the PM . This project chief from Government was the department Head of Civil in IIT .Client side engineers in top position should have good relation with every political party and should have personal security guards. We all have to behave like a matured politician to survive in this society , if it is from Client side / Contractor Side. Lobby of contractors and political leaders will disturb the client side engineer in chief for the allotment of work to a particular contractor by leaking the rates of first lowest contractor and Cancellation of Tender. Political leaders / Local political leaders will approach for party fund and engaging their Contractor for supply of labour . They may ask to give job to some of their engineers also .When I was the Resident Engineer for the construction of all buildings for a University in Hyderabad, the construction company have done manipulation to the tune of 38Lakhs in the supply of electricity from us . According to the agreement we have to give electricity to contractor at the same rate of AP TRANSCO . But the company done manipulation by changing the electricity Meter at three official taping points and the accounts department was deducting only the cost of 5000units of electricity , when the actual consumption was 56000units . One my junior and two electricians were in the pay roll, of that company . Every month I have to certify the electricity bill for the payment to AP TRANSCO in every month . I was certifying the electricity consumption of all staff quarters, Canteen and all buildings including six hostels . I was aware of this corruption and collecting evidence / proof . One fine day the finance manager submitted the electricity bill of TRANSCO to V.C without my signature . VC blasted the FM and called the electricians in the chamber and threatened them . After half an hour VC called me . When I reached there , seen my electricians are crying and VC told me Prove this corruption with clear evidence within 24hours or go to Jail . He has given me the electricity bill of that month . I have seen the amount in the bill is Rs 1,95,000/=( in 2001 ) . Normally our bill will be Rs 1,15000/= to Rs 1,35,000/= . But all students are out on placement for 45days and canteen also functioning to prepare food for ten people . Electricity bill of that month is supposed to be about Rs 25,000/= only . In that night I prepared the statement showing the excess electricity consumed by contractor for the last three years . God has directed me in the correct route to prove the corruption , which can't be denied by any court in the world . Next day everybody were laughing at me, as there is no evidence to prove this 36months old " Bofors "type case !!!! . But after my report is submitted, FM received a letter from VC to deduct 38Lakhs from the Bill of contractor. Some of the higher officials of that Construction Company threatened me like " eliminating me & family " . Remaining In-Charges like Engineer from Client / P.M.C Engineer / Architect / Structural Engineer can escape from the responsibility by giving a statement .Risk of an In-Charge in Construction company while managing a project are given below . ( 1) Theft of materials from site with the support of company employees . (2) Weighment of steel and other materials in weighbridge and unloading apart of the consignment before the vehicle coming to site with the planning of store in-charge .When I was managing the construction of a township of 1560 nos flats in Hyderabad,( South part of City ) i came to know that every day theft of steel is happening to an approximate quantity of 500kg . Within Six months I catch hold of our Security Guards & the third party operating from outside of site .Risk factor of a Construction Company Site In-Charge, in north part of Hyderabad city.(b) Theft of materials by local white collar thief.When I was Project Manager for the construction of 290nos Independent houses near Kompally in 2006 , our security guards noticed a group of people shifting G>I water supply pipes from our land and loading in a Truck waiting in the nearby road . Within one week our security guards catch two thieves when all others vanished in the Truck . At 5am in morning I received the phone call " that a crowd of more than 50 people from the near by Village came and attacking our security guard to release the the thieves in our custody . I given clear instruction to protect them for Ten more minutes by telling that " after 9am in presence of our Engineers we will release them ". At the same time I asked the security to be in line and I dialed 108 and informed about the emergency . You will not believe in the 4th minute two petrol vehicles of Police reached there and I was able to hear the siren in the phone . These thieves are given in to the custody of Special Branch , as there are similar organised theft from Kompally to Bachupally area and up to Kukadpally area in Construction Project sites . When interogated they cofessed that they are being mobilized from villages ( Ex Thieves ) in different districts at rate of Rs 250/day + Biriyani and Liquor and free accomodation . Location and method of theft will be finalized by their leaders . According to the information from these thief police in normal dress picked up four people of that area . All four are now having a property worth above Ten Crores because of increase in the rate of land . All four are the members of old High Way Robbery in Highway . They are known to everybody in that area and having fleet of all kind of vehicles . two were having political influence . But after this incident all the thief in that area were silent and afraid of Our Project Site .Risk factor of a Construction Company Site In-Charge, in the interior locations in district of any State.(c) Gundagiri & Vassooli by local lobby / Union of material suppliers and politicians .In 1997 I was managing the construction of a Convent, Prayer Hall and School Hostel in West Godaveri district of Andhra Pradesh . From starting of project itself the local labour increased the daily wages by Rs 20 to 25 per day and behaving like rowdies to the employees of contractor . When I reached the site I was the only person able to speak Telugu . We were doing the bottom slab of an overhead water tank . But by 6pm all the labour has gone . As it is the bottom slab of water storage tank we should not stop the concrete by creating a construction joint . So we all the employees continued the concrete and finished by 11pm . At that time one load cement has come . We arranged light in the passage of store , which was shifted for tank concrete work even though we all are in an extreme tired condition I asked the store In-Charge to count and unload and taking rest in a wooden plank in the First floor of the building . I slept , and was hearing the commotion between the unloading labour and our employees like a dream and finally got up . From that level i can see near the office a crowd is there in a circle and one man hitting our store In-Charge . I came down immediately and hold both of them with an intention to separate them . But that fellow started hitting me . Till that time all our employees were silent , when I started fighting back scenario changed . All the unloading labour run away from our site to the road we chased them up to Two Kilometer and blasted everybody . We used Bricks , Stones , Stick, Iron Bucket , Chain with lock on one end and Nanchaku.All these problem started when , the truck driver asked the receipt for the supply of 200bags cement , after unloading only 195bags . From Vijayavada Godown the cement is transported to our site without any Tarpaulin Cover and seal . Five bags of cement they unloaded some where .Next day the panchayat member call us to office . When we reached there more than one thousand people is there around the panchayat office . How we escaped from there unhurt ? and how we postponed our appearance in presence of elected panchayat members is in the History of that village !!!!. From that day we ( Eleven members ) were being treated as Number One Rowdy Heros of that Panchyat . A number of people including our material suppliers, workers and neighbours . I the presence of the Panchayat members I told everybody that " if anybody is repeating this in future that will be horrible than this , as we all came here to Fight & Die" . When we are here for doing a work for the development of your Panchayat you should co-operate with us .Panchayat tried pass a Stay Order to stop our project , but we have taken the approval of panchayat six months ago by paying the official fees these . I was having three copy of drawings Stamped by the Panchayat Executive officer .NoteWill be edited after 1.30pm todayNext " Risk of Boundary dispute with the adjacent land owner"and Construction without having any approval from City Town planning officer in Hyderabad , in a land which is having three cases pending in High court !!!!.
