PDF Editor FAQ

If two "professional" boxers give consent to not sue each other civilly or seek a prosecution for assault, how is it legal? Why doesn't the prosecutor bring charges regardless? Is there an exception for entertainment or sports?

A boxing match is not a street fight. It is not the same as two neighbors having a “beat down”between each other. There is no aggressor in a boxing match. Both parties are licensed in the locality and state (if held within the United States) wherein they will hold their match, and hold any such contests by license and mutual agreement.Any contract/agreement between the two boxers is drawn up and approved by their respective lawyers and MUST contain a ‘release from liability clause', which is what you mentioned. Soldiers sign an enlistment contract upon joining the United States Armed Forces, and the contract also contains such a ‘liability' clause, which holds harmless the United States government for any injuries or the death of the individual soldier/aspirant. Medical treatment for any member of the armed forces is also included in the contract, as well as the right of access to the Veterans' Administration Benefits System of any honorably discharged sailor, soldier, airman or Marine.Such clauses are perfectly legal due to a recognizable need by the nation for freedom from liability for such things, otherwise we could not maintain or field the armed forces necessary to our very national existence. Boxers accept the risks inherent in their sport because if they did not, boxing matches could not be held. In our litigious society, we have found it necessary to have such clauses as a result of junk lawsuits arising out of a desire by people injured in such endeavors to “cash in” by simply raising the spectre of such a lawsuit. This clause, mutually agreed to and thus completely enforceable in a civil court or in a criminal court of any state of the United States, becomes absolutely necessary, as the clause negates the possibility of such lawsuits.

What kind of contract do the leads of The Bachelor and The Bachelorette sign?

Most contracts for reality tv are far over-reaching for the sheer effect that it discourages litigation. Since a lot of money goes into shooting and the air dates are so far away, these contracts can sound awful, but they are necessary to keep the secrets that make the shows so watchable. Here are the highlights:Paid $10k for the “exclusive” to keep quiet.Option to appear on other shows, they are guaranteed a feeIf they make it to the final four, they are paid extra. They are explicitly told they are filmed 24/7, they could be embarrassed, edited in a negative light, edited in a manner that is not true for dramatic affect, etc.Highlights Part Two:If they appear on Extra TV as a host, they can be paid $150k per year.ABC hold the “exclusive for two years if they final contestants get married. This means they can’t sell photo deals to People, US Magazine, etc. Also, they will be paid a compensation fee if they get married on TV.They have a non disclosure agreement and can be sued for up to $5 million dollars if they disclose ABC secrets, go on unapproved interviews, etc. etc.If lawsuit goes to arbitration, ABC is guaranteed $250kHere is the main portion of one contract:Below, are portions of the Bachelor/Bachelorette contracts that contestants sign. The original document is 22 pages long and certain clauses of the contract have been highlighted to view. (Caveat: My 100 page reality tv contracts that I was supposed to have all my contestants sign, I edited out the portions that I as talent could never sign. As a producer I would never ask my talent to do anything I wouldn't do. That is not looked upon well by the attorneys that don't like their shackles watered down).“THE BACHELORETTE” RELEASE AND WAIVER, AGREEMENT NOT TO SUE, INDEMNIFICATION AND HOLD HARMLESS AGREEMENT, AND PARTICIPANT AGREEMENTI ____________________(“I”, “me”) and AND Syndicated Productions, Inc. Why is Trump picking a fight with Canada? Don't Canadians get along with everybody?

Donald Trump can't pick a fight with Canada as a whole. Canada is a political entity, an abstract political concept. It does not have emotions or participate in fights.Donald Trump, as President, and the head of the United States administration, could take an oppositional stance towards the Government of Canada. (That is, the Canadian federal government.) He could, if he wished, identify other governments, sections of governments, individuals or groups in Canada that he wishes to criticize or be abusive to. For instance if he strongly feels that the Canadian supply management system for dairy products is wrong, he could criticize the Canadian Dairy Commission or the provincial governments who participate in dairy supply management, for example, the Government of British Columbia which participates by means of the British Columbia Milk Marketing Board. If Donald Trump read some piece, in a Canadian newspaper, by an economist or in an editorial, justifying Canadian dairy supply management, and he disagreed with it, he could Twitter-castigate the writer. However, it doesn't matter whether Canadians are nice or not. The very great majority of Canadians are not involved in the dairy industry and are not officials in dairy marketing boards.Normally, the administrations of countries avoid getting too specific about who or what in a foreign country they disapprove of. The problem is that, dropping this approach could be come reciprocal. So, for example, if Donald Trump criticizes the attitude of Ben Janzen, the Chair of the British Columbia Milk Marketing Board, then why should any prominent Canadian withhold their criticisms of Judge Brett Kavanaugh, President Trump's favoured nomination to the United States Supreme Court?Donald Trump could, if he wanted, externd himself and criticize what he believes are the attitudes held by many Canadians. For example, does he really want to say that most Canadians have an exploitative, unfair and disrespectful view of the USA? He has the right of free speech, so, if he wants to issue his analysis of those Canadians, he could do so in a set of Twitters.Donald Trump, His Base and Their Evil EnemiesIt is very evident that Donald Trump likes to deal with American political issues by castigating and ridiculing individual Americans that he does not like, a Democratic female Senator, or a White House staffer who has disappointed him, or a football player who participates in the knee bending ceremony at NFL games. This approach goes down very well with Donald Trump's base. I don't think it is just a tactic. I believe Donald Trump is honestly reflecting a common point of view in the United States. This is the view that America's political, economic, social and international problems are caused by individual evil actors or groups of such evil actors acting together, who judge and disrespect average Americans, and plot to disempower them, disadvantage them, provoke and punish them. They also believe that there is no excuse for “weak actors”. It is not who they represent, it is who they are. They are contemptible and deserve to be defeated.According to this theory, the evil actors who are not weak, benefit their own lives by enriching themselves and expressing their presumed superiority. (I am going to move my factory from Indiana to Thailand, where wages are low and I can make a better profit. And further, the workers of Indiana deserve it, because I despise the traditional American family and I strongly believe the state should indoctrinate and control their children.)This world view is, in a way, the extension of the belief that, everything happens for a reason. That is, abstract economic and demographic matters are insignificant compared to the volition of individual human actors. I think this is what Donald Trump and many of his followers believe. What happens when you take this attitude to a foreigner? They are not a part of American society. They might have socialistic or alternative lifestyle beliefs, without any accountability to Americans. If they would like to enjoy themselves by expressing scorn for average Americans and denigrating their values and so, insult the USA, what can an American do? That foreigner is beyond your borders, accountable to some alien society in a foreign place.Because You're Mine, I Cross the LineThink of the frustration of Donald Trump and his advisers. They are presented with tedious analyses of issues affecting the internal trade of the United States. But they know, the real issue in America's foreign trade are bad foreign individuals, who dislike America, wrongfully and willfully choose to disagree with the policies of Donald Trump, disrespect him and do not do as he says. The bad attitude of those bad foreigners, towards Donald Trump, of course extends to Donald Trump's base. So, we have the evil Justin Trudeau, who, as one of President Trump's advisers said, richly deserves the lowest level in hell. According to this line of thought, Justin Trudeau must be a sly, immoral man, who delights in beggaring average American dairy farmers. Then there is that awful Angela Merkel and that nasty Theresa May, with her snobby accent. It is quite probable that, in order to fully carry out his negotiating style, Donald Trump would like to extend his critiques beyond other national leaders. For example, he might like to single out Ben Janzen in some of his Twitters and tell his base about this enemy of the American farmer, who will be dealt with accordingly. He could warn his base about the terrible editorial board of the Toronto Star, propagandists for the anti-American Liberal Party of Canada. Certainly they must all be close, personal friends of Ben Janzen. The special temptation for an American President to rag on individual Canadians, is that most of them speak English, they are right next door, and have the right of free speech, so you can see what obnoxious things they are saying. Also, if your underlying belief is that Canada has no right to exist, as some Americans clearly do believe, then Canadians should just be Americans and think and act like good Americans, particularly Donald Trump's base, his advisers and his appointees. It feels good to lash out at and decry bad people. However, lashing out at individual foreigners, as opposed to their national governments, entails some risks. They are not as easy to intimidate because they live in other countries and are subject to another set of primary intimidators. (So, telling Irene Gentle, the editor of the Toronto Star, that she has blown her chance for a Supreme Court nomination, is unlikely to cause her to Twitter out an abject apology and beg for reconsideration.) Given that they are aliens, they may not care what you say. Or, they might bask in the negative attention and go bragging about it to the other aliens. In effect, you are enabling and encouraging that alien to be even more attention-seeking and disrespectful. However, there is another effect, if you personalize your critiques of aliens. You run the risk of internalizing them into your political process. You make their names known to your own public. Particularly if those aliens have American-sounding names, you could elevate them into being domestic political figures. If they speak English, then they can Twitter right back, or issue a media release, and undermine you own arguments and your credibility, and hurt you with your electorate. They government of a foreign nation won't do that.Does Donald Trump Have a Critique of Canadians?I could expand this somewhat more, do Donald Trump, his advisers, other members of the Republican Party, including members of the House of Representatives and Senators, have a critique of Canadians as people? Does that critique make them see Canadians as morally deficient, inferior or unreliable?I believe that Donald Trump and some of his supporters have identified most Canadians as being auxiliary members of the Democratic Party. They perceive Justin Trudeau as a younger Bernie Sanders Democrat. They believe that most Canadians strongly support those parts of the Democratic platform and mentality that Donald Trump and his supporters find the most offensive, the most ignorant and the most dangerous to America. Effectively, they have been making all of Canada a part of American domestic politics. This sharply contradicts what has for many decades been the traditional stance, by most Americans, on Canada and Canadians. That is, they are harmless, they are generally unimportant and what little that needs to be done about them is adequately dealt with by the United States Administration, without wasting the time of Congress. However, according to Donald Trump and some of his advisers or supporters, Canada is not simply another country that should be dealt with in the customary nation-to-nation way, with negotiations, bargaining, compromises, agreements and treaties. It means that Canada and Canadians ought to be held to account. Can Donald Trump Change?I think Donald Trump honestly believes in his “evil actor” interpretation of life. It has driven his business and political career. How can he give it up?However, this interpretation does not work for America's trade and other international relations. The United States is not really dealing with individual bad foreigners, it is dealing with the national governments of various countries. These national governments are legal and political entities but they are not people. They don't have bad. They don't have evil.An evil dictator might be able to get hold of an individual foreign government, staff that government's senior positions with other evil people, and order the armed forces of that country to do evil things. But, when it comes to America's foreign trade relations, Donald Trump isn't dealing with Adolph Hitler. He is dealing with national governments that don't have any Hitler to direct them. Donald Trump has not suggested that the Government of the People's Republic of China is Hitleresque, not even them.Justin Trudeau is mostly unlikely to care about the personal opinions of his character, put out by Donald Trump and his supporters. (Except that, the nastier they are, the more he will get sympathy from the Canadian electorate, and the more likely the Liberal Party will be to win the October 2019 federal election.) Justin Trudeau will keep on reading reports and analyses and discussing them with his Cabinet at their regular meetings. He will make administrative and policy decisionsOther, individual Canadians might feel angry it they get Twittered from Washington, D.C. , but it won't effect what they do in their business lives. Your personal life stops when you walk through your office door. There, you are the corporate you, not the you, you. Personal evil actors in the workplace get reported to Human Resources. Any corporate rebuttal to those Twitters will be a news release and new pages on their website. If the employer permits it, the denigrated Canadian might enter into the domestic American political process and launch a critique of their own.Donald Trump has boxed himself in. He won't get dramatic interpersonal clashes and victories. He will get one foreign governmental response after another. Those responses will be structured and contained, some concessions, some demands, suggestions to organize negotiation meetings, etc. The more this goes on the angrier and the more frustrated he and his supporters will get. They will miss opportunities for some real gains.Sooner or later it will become obvious to individual Americans that nothing good will happen and, in fact, a lot of things will get worse. Donald Trump will sit there in the White House, with his advisers, running out of ideas and without any more dramatic things to say.Martin Levine
