If it’s not true it’s a deadly response.I once asked the opposing party if he remembered pleading guilty to a felony.He “didn’t recall.”That allowed me to refresh his recollection by showing him the guilty plea form which had his signature at the bottom and his initials at the end of about 10 statements.The first statement: “I understand I am pleading guilty to a felony.” I read each of the statements to him and asked if he had placed his initials next to the statement.There was a paragraph where he, in his own handwriting, was required to describe the crime (embezzlement from his employer) in detail. I asked if that was his handwriting.My cross examination on this subject took about 10 minutes and I offered the form into evidence at the end. Most of what was on the form was irrelevant until he stated he “couldn't recall.”If he had answered “yes” the nature of the crime would not have been admitted into evidence.In another matter, the plaintiff was asked if he had represented “X income” (his true income) on a home loan application.He answered “I don’t recall.” Another long series of questions asking him about the income actually reported on the form and whether he had ever actually earned that money and whether that was his signature acknowledging his income representations were made under penalty of perjury.Obviously neither jury believed anything these guys had to say after these examinations, especially if they answered, “I don’t recall.”

It was misdemeanor arraignment Court. Judge F had just accepted a guilty plea form Danny Defendant and sentenced him. Obviously Danny hadn’t expected the type of punishment that was handed down and turned away, muttered under his breath “You fat SOB!” Judge F didn’t do or say anything and Court continued.After a recess, when Judge F took the bench, he announced “Did anyone hear Danny say anything as he walked away?” Everyone in the Courtroom nodded. Judge F continued “Well I didn’t hear it. I assure you I would have dealt with it had I heard it.” He stood up to his full 6’3″ stature. He was a former college football lineman. “I wasn’t upset by the second part, but, by golly, I just lost 40 lbs.”“

New York has been forced to pay as much as 15 times the usual price for equipment.
