This actually happened to me. I got hurt at my then job at Office Max (I was walking and one of my employees asked for help, so I quickly turned and I tore my ACL - obviously not the fault of the company), where I worked as a manager, in charge of sales, customer service and technology repairs.I had to take off a couple of weeks of work and it forced me to evaluate what I wanted to do with my life. I enjoyed most of my job, but I knew that to advance my career there, I would have to deal with more and more of what I did not enjoy (sales, I liked working with people, but hated having to deal with “did we make our numbers”), so I decided to change careers and go back to working with teenagers, only this time in teaching.I came back to work and talked to my friend and boss about this. I even turned in a letter of resignation effective for when my new teacher’s license would be effective in 6 weeks.He refused to take the resignation. And it was a good thing he did.The state ran into a problem. One of the questions asked on the background check was “Was I ever fired from a job in the last 10 years”. The answer was yes, I was fired from a juvenile detention center that I worked at 9 years before after giving a client the wrong medications and not realizing it for 12 hours (long after the policy of reporting a medical mistake within 2 hours).That company was contacted to verify my story and refused to tell the State anything other than “yes, I used to work there and I was ineligible to be rehired.” When the state asked why, they refused to answer. That company took 6 months of legal issues before I was finally able to at least get them to write a letter stating their refusal, which the state accepted a week later. By the time my license was actually granted, it was April with the school year ending in early May.If my boss hadn’t refused to accept my resignation, I would have had no job for almost a year.Now, I’m sure if I pushed the issue, he would have been required to accept it, but sometimes it’s nice to have someone you trust tell you that you are being foolish and should wait.Edit 11/28/19 - For those who say I did not answer the question or have been trying to add details to my answer in the comments.No, an employer cannot refuse to accept a resignation from an employee legally UNLESS there is a written contract in place that states they are required to work on a job until a certain task is done or a certain date. Even then, they could resign (or even just leave without notice if need be) from their job, they would just have to abide by what the contract says if that should happen (ex: can’t work for a direct competitor for length of original contract).2) The person who asked the original question is NOT talking about a slavery or involuntary servitude issue. The wording of the amendment was to prevent someone from forcing you to work for them in exchange for a service without a court order to do so. This used to be a common practice. See Jacob in the Bible being forced to work for 14 years to be allowed to marry the woman he loved, Rachel. Even in American history, many poor English men would come to America and agree to work for someone (without pay) for 3-7 years in exchange for them paying for the trip to come over, this amendment outlawed that practice. At no point did they say they would refuse to pay for the work she is doing. (Unless there are details missing from the question that were once there)3) It sounds more like they just do not want her to leave and would like to try to convince her to stay. If she is resigning due to a specific issue, maybe the refusal is more “I understand you are upset, can we set up a meeting with HR, with my boss, with (name of situation), etc. to discuss how to solve this problem before you officially resign.” That is absolutely legal. Or maybe your mother did not follow the procedure set forth in the employee handbook and all she needs to do is type up a formal letter to give to HR.
