Thank you for asking me this thought provoking question.Policy PerspectiveAs a matter of policy, it is important to consider the consequences of a proposed policy.Thus, if courts were to adopt a volunteer-only jury system, and either no one or an insufficient number of people volunteered, then trial courts would be unable to administer the right to trial by jury.The right to trial by jury is not simply an idea. The right to trial by jury appears in the text of the federal and state constitutions. Therefore, courts and lawyers take the right to trial by jury seriously.The foregoing policy perspective explains why courts probably eschew the idea of a volunteer jury.Practical PerspectiveI am the Immediate Past President of my Kiwanis Club, an all volunteer civic service club. In addition, I have also served as a blood drive coordinator as a member of the Sons of the American Legion (SAL) at Post 133 in Woodbury, New Jersey. These experiences provide a practical perspective on the challenge of finding volunteers.Kiwanis Club PresidencyDuring my presidency with the Kiwanis Club of Woodbury, NJ, Inc., I witnessed how the club struggled to recruit new members. People with jobs had difficulty attending our lunch meetings. After all, their obligation to their employers took priority over volunteer work. Similarly, they were unable to attend volunteer events during the day for the same reason. I own my law practice so ordinarily I had some flexibility. Even so, I missed many volunteer events because of professional commitments.Additionally, retired people did not join in record numbers. Perhaps it was due to other commitments, like family, friends, health, involvement in other volunteer work, or anything else one might imagine.Volunteer organizations must anticipate a prospective member's desire to know, “What's in it for me?” How would the government attract volunteers in sufficient numbers that would make volunteering for jury service more attractive than any other option for spending their time? I address this question again near the conclusion of the answer.Red Cross Blood Drive CoordinatorAs a member of the Sons of the American Legion (SAL), I was responsible for coordinating an annual blood drive with the Red Cross. Aside from some assistance setting up and cleaning up on the day of the drive, I single-handedly managed everything else.This included social media publicity, creating and maintaining a database of media contacts, preparing and distributing news releases and public service announcements, following up with media contacts, creating and managing a database of SAL members and past donors, personalizing and distributing recruitment letters to SAL members and past donors, distributing personalized follow up letters and email messages to donors, attending the blood drive, overseeing the setup and cleanup, and anything else involving the blood drive.Like recruiting club members, recruiting blood donors required me to address the question of, “What's in it for me?” Donors were motivated only partly by altruism. They also wanted to know what they would get in exchange for their time and their donation. That is why the Red Cross offers a free haircut, a coupon for Dunkin Donuts, t-shirts, and other incentives. Additionally, donors would shop the different drives to compare incentives.Based on this, I expect the government would also struggle to find volunteers to serve on the jury. I strongly doubt that either federal or state governments would offer a tax incentive for jury service when the current system works without cutting into their cash cow. This goes for any incentive because the current system works without requiring the government to bargain for volunteers.Both organizations emphasized the importance of personally asking for volunteers and asking for blood donors. The government is not in the habit of simply asking and getting no for an answer. Instead, the government is a residuum of power that commands compliance. You can also contact voluntary societies like the Kiwanis Club, or neighborhood organizations that do park cleanups, beautification projects and the like.You want to find a volunteer job that suits your interests. If you’re very high energy and need to do something physical, don’t volunteer to read to senior citizens or small children. If you enjoy art, find something that suits your talents in a positive way, perhaps volunteering at an after school program to make art with kids. If you like sports, find some way to do that. The better the community service job aligns with your interests, the more you will get out of it, and the less bored you will be.
