PDF Editor FAQ

Do the parking space clauses in the lease agreement mean that my apartment comes with a parking space, as promised verbally (London area)?

As my disclaimer says, I’m not a lawyer. Nor am I particularly familiar with laws in England. However . . .No.The clauses you highlight do not state that a parking space is included. What they’re saying—as I read it—is that if you have a car (if you’re permitted to have a car), then you must abide by those rules.I agree that the provisions are confusing. But remember: These are rules and while they may be incorporated in your lease, they’re not identifying what’s included in the lease. The most obvious “rule” that illustrates that is 15.2:To park in the car parking space, garage or driveway allocated to the Property, if applicable.“If applicable.” What’s that mean? It appears to mean that IF a a space has been allocated for a car, you agree to park the car in that space. If a space was definitely allocated, it would be stated elsewhere in the lease, not here. Further, that provision would simply read “To park in the car parking space, garage or driveway allocated to the Property.” It would not need to be limited by “if applicable.”And take a look at 15.4:To remove all vehicles belonging to the Tenant, his family or visitors at the end of the Tenancy. If 15.2 is to be read as guaranteeing a parking space, then 15.4 would be guaranteeing spaces for you, your family, and your visitors. But obviously it’s not. It’s saying that if you have one or more vehicles that are legally permitted in your lease (and maybe some that are parked in a guest area), then you agree to remove them at the end of the lease.Again, I don’t know about English law. But in the United States, a verbal promise relating to real estate isn’t enforceable. You may have been told that, and the person might have been telling the truth, as he or she knew it. But you have nothing in writing. You may not even know whether the person who made the promise had the authority to do so. (I’ve been in situations where someone has told me one thing, and later someone else takes it away, saying “XXX didn’t have the authority to make that commitment.”)So:Get it in writing that you’re paying for a parking spaceFind out if you’re required to park it in a parking space, garage, or driveway.

When requesting to add a roommate, how often would a landlord/property manager then hike the rent up upon doing so?

If your landlord is willing to add an additional occupant on the lease and handles his/her rentals professionally, you can expect that the new occupant will have to pass all the same requirements as you did in your initial application (credit and background check, etc.), pay whatever fees are incurred in that process (credit report, etc.), sign onto the lease, and you will likely have to pay a higher rent. How much higher depends on whether or not any utilities are included and whether an additional parking space must be made available to the added occupant. If utilities and parking are not included in your lease, then the extra rent should simply be a small amount for added wear and tear on the unit (more people tracking in dirt and wearing out the carpet and floors, using the appliances and fixtures, smudging and scratching the walls, cabinets and counters, using the septic system and well (if the property has those, etc.).Some cities and towns have ordinance restrictions on how many unrelated people can occupy a single-family residence and/or how many parking spaces must be made available per adult tenant, and some rural rentals on septic tanks and wells have limitations on how many people those systems can handle, so even if your landlord wants to allow another occupant, it might not be possible.

Why are people in the UK with disabled badges/permits allowed free parking? It cannot be financial, as they can afford a car.

The two aren’t connected. The disabled badges/permits are issued by the local authority council. They are only awarded after strict review of medical records and disability benefits of the applicants. You don’t have to own a vehicle to apply for or use one. The permit is awarded to the disabled person to use with any car they may have, or travel in regularly such as a relatives or carets. It can only be used by the disabled person to whom it is issued. A son may drive his mother around and if taking her somewhere she can use her badge on his car WHILST SHE IS THERE, but he cannot use that without her being there.Financial status has nothing to do with it. If you have mobility issues that would qualify you that badge, you can use it on a Rolls Royce if that’s the vehicle you travel in.The badge is generally awarded for a period of 3 years at a time and costs a small administrative fee. After that time you can reapply but the whole process of reapplication and examining your medical records happens every time. The blue badge generally will give you access to parking spaces closer to your location, which given you have to suffer mobility issues to apply for it, makes sense. It does not mean you have free parking wherever and whenever you feel like! The rules of the highway still apply, and a lot of car parks still require a paid ticket, but have bigger and closer parking bays. There is no financial connection to the award. Anyone thinking it will save them money is missing the point, it’s to give the help, support and convenience to the people who desperately need that extra help. You may be getting confused too with the Motability Scheme also run in the UK. Again, you have to be receipt of the highest disability mobility benefit to even be eligible to apply. You can lease a car through the scheme but it does cost money (approx £50/60 pw) and this money is taken directly from your disability benefit payment. It is only available through particular dealers, and again only for a period of 3 years at a time.Hope that clarifies things a bit more!
