But how to get the Colonel’s signature with him being 5,000 miles away?I didn't know anyone who could forge a signature, and I sure wasn't going to do it myself. But I *did* have plenty of samples of the Colonel’s signature on other docs around the office. I found a good, clean one and went to work.What I ended up doing was putting the Colonel’s signature on a sheet of plastic (some call them ‘transparencies’ or ‘acetate’) and then copying the signature page *with the transparent page containing the signature overlaid on it* so the result was a ‘signed’ page. I did that one evening after everyone had left, replaced the unsigned pages with signed ones in the packages (for about six or seven guys) and then filed them back in the NCOIC’s inbound work binder.Then I destroyed the plastic sheet and kept my mouth shut. Nobody ever asked about it (if SFC Newguy ever wondered how they got signed, he never said anything) and everyone who was PCSing or ETSing got out and on their way.I rationalized it as ‘hooking my buddies up.’ I helped the guys who were leaving, I kept my NCOIC from a CSM asschewing and I didn't benefit from it.

In essence, this argument is that Stormy and Trump did enter into an oral contract, and that contract was terminated by mutual performance. This unsigned written contract, however, was not the contract that was agreed to. The $130,000 served as consideration for another contract, not this written unsigned one. This one is essentially a “draft” that never became effective, obviously, because one party never manifested its agreement by signing it.If Stormy’s argument (that I just made up) is accepted, she could now capitalize and sell her story to the media. If her argument is rejected and this unsigned contract is the operative contract, then she could be liable for mega damages for selling her story. But until a court decides, she won’t know if her argument is a good one.The solution to her problem is to file suit. If she wins, then the written contract and its liquidated damages clauses and assignments would be ineffective, and she can publish at will. If she loses, then she simply retains her silence without breaching the contract. In the meantime, there is a lot of collateral publicity that happens to be outside of whatever her agreement was. That is not necessarily an undesirable outcome from her point of view.That’s why the lawsuit was necessary for Stormy.
