As someone who has solved two significant property disputes within the last year, one residential and one commercial, I can say without a doubt, don't take this lightly. Don't wait. Act immediately. The first step should be to do research. Start online by searching your county assessor, auditor, and treasurers offices for any and all info regarding the legal description, plat maps, and surveys for your area. Gather all information that pertains to your land, their land, and the surrounding properties. Try to find any information pertaining to easements with the city engineering department. Next, go to your county tax assessors and study the physical plat maps and surveys. Make copies. Scour the land for survey markers and official bars and caps. Measure out the land based on all the relevant information. Determine, based on all the measurements, where you think the property line should be. Take photos and make documention of your process. Locate any features and markers, fences, rockeries, other landmarks that may be grandfathered as boundary designations.That whole process should take you no more than a few days. If you decide that you are still sure, based on the data, that the neighbor is infringing on your land, you can do two things. Build your own fence, wall, or rockery where you determine the property line is based on the data. Schedule a survey immediately. Scheduling a survey is the absolute number one priority. In one case, nothing else would dissuade the neighbor until the survey was complete. Since then the hostile neighbors haven't made a peep. In the other case, throwing the county records in their face was enough to discourage them.Feel free to call the police or raise hell with the city. Neither will do a thing. The police won't get involved because they are not experts on property lines. The city will probably tell tall tales about old water main bursts and ancient stories of havoc wreaked on your street by plugged drain culverts. In some cases they will even make “I thought this" or “I thought that” statements that will do you more harm than good. Only approach the city for permitting concerns and/or city easement questions.If you prove your side but they still persist, your only recourse is the courts.Good luck!Edit: I wanted to add that once the official bars and caps are in place, police might be willing to give them a verbal warning. If the neighbor persists, post no trespassing signs and have the cops approach them for trespassing.Edit 2: I wanted to make also mention that all survey records will be marked with the date the survey was done. It's important, because more recent surveys typically hold more weight compared to older surveys, especially if they refer to bars and caps that are consistent with other surveys in the area. The surveys will also contain the stamp and information of the surveyors. These are very powerful people to have on your side. Their word holds a tremendous amount of weight. Always treat them with respect. Contact them and ask them if any of the surveys have been challenged there, to their knowledge. Ask them if the surveys of relevant plots done in specific years are correct to the best of their knowledge. They will help you, with it in mind that you might bring them business. Ask them if any other surveys are currently scheduled on that plat. All that information can help you determine your approach and will help you win.
