What was the most life-changing experience you had in India?

Going anonymous because I might get a lot of hate for this.I am an Indian and have been living outside India for the last 10 years. I visit India every year and have been exploring shifting back to India in the last 2–3 years until the below incident happened.I had purchased a 2 bedroom apartment in India about 3 years back. I had to use up all my hard earned money and also take a home loan to purchase this apartment. Since I live outside the country, I rented it to a local acquaintance whom we knew for the last 20 years. This guy kept paying the rent regularly and would always answer my calls. After about 2 years of renting, I had to ask him to vacate the house since I had to accommodate my in laws in my apartment. The tenant requested for an extension of 6–7 months to which I agreed, he was in touch with me through out this period and at the end of it he also gave me a date when my in laws could occupy the premises. The tenant went incognito about 2–3 days before he was to hand over the keys, when all my calls went unanswered I asked my in laws to visit the apartment and meet him in person. That’s when we realised that this tenant had illegally leased out my apartment to someone else and has gone absconding, it turned out that he also had conned a lot of other people in the area and run away with cash amounting to about 10 crores. We approached police on this matter and they refused to file a complaint, they asked us to approach a lawyer since according to them this was a civil case. At this point we approached the most famous lawyer in my city, he took his own sweet time to serve a eviction notice on the illegal tenants. It would take hours to meet this lawyer and he seldom updated us on the progress, he confirmed serving the notice and advised us to wait till the eviction notice period ended for the next steps. We were in for a rude shock when we went back to the lawyer’s office after the eviction notice period ended, he informed us that the tenant never received the eviction notice and the notice cannot be deemed served. He now wanted us to take this matter to court and told us that it would take a minimum of 2 years to get the illegal tenants out.It was close to 5 months after the matter was discovered and we were fed up of running from pillar to post on this matter, we decided to approached a relative who was a police commissioner for advise. Things changed as soon as he made a call to the local police station, the illegal tenants were immediately summoned to the police station and asked to vacate or file a complaint on the man who conned them. The illegal tenant apologised and left the station and he started pestering me to settle the matter between ourselves.During my interactions with the illegal tenant, I realised that the lawyer I had approached was his acquaintance and both of them had plotted to drag this matter in the court for as many years as possible. He also knew the exact details of my rental agreement with the original tenant and wanted to exploit any loop hole in the agreement. It also came to my notice that the fake lease documents for the illegal tenant were prepared in the office of the lawyer I had approached. The illegal tenant is now trying to force my hand to file a police complaint, he calls me in nights and claims that I have been threatening him, he has openly told me to approach the courts so that he can stay in my apartment without paying a dime. This is the sorry state of affairs in India, it is a appalling to noteAll the people I have been dealing with are educated, they are either graduates and double graduates. Yet they believe in conning others and taking them for a ride, none of them want to make a honest living. They would rather get a free pass on others than work hard.Police and lawyers are supposed to be safeguarding the society but yet they seem to be the first hurdles for any problem resolution.Even though I am legally correct and have all the right documents, the system is Indian sub continent still protects the wrong doer. The illegal tenants living in my apartment are least bothered about the amount they lost to the conman, but they are hell bent on wanting to create trouble for me. Instead of frowning on such an act, this undeserving society even has lawyers who support such crooks. This is what happens to a society when you choose crooks as your elected representatives. When you let people like Vijay Mallya, Nirav Modi off the hook you are setting a example for the society where everyone thinks that they too can get away with such things. There is a inherent belief among Indians that anyone living in the west earns in dollars or pounds and should be milked well. This is a horrible attitude, a lot of us work really hard, we go to office in freezing temperatures risking our lives and we work doubly hard because we cannot afford servants in the west. Attitude of entitlement is one of the worst Indian traits, what is the use of a rich culture and spirituality when every second thought in your brain is about how to con others or create problems for others. You can brush this under the carpet all you want, but deep down you know that given a chance many of you will be happy to take a free ride on others. The epidemic of conning others and getting away with it is becoming rampant in India as the employment rates plummet, every other day there are people coming out with similar stories. This was not the India I grew up in, I hope they wake up before it is too late.

Why do some landlords feel that their tenants unfairly took advantage of the COVID-19 moratorium on evictions when it was meant to be used for financial relief?

On September 15, I was told that my eviction would NOT likely get looked at until December 31, 2020. I am also not getting paid rent. Let that sink in for a minute. If this ends up being the case this will be a loss of income to me of over $3500. Add on top of that property taxes that I must pay even though this income was not received. Also add to that, I pay the water bill at this location (it is a duplex) and it can be over $400.My eviction has very little to do with COVID. The tenant has been paying rent late and in pieces since November 2019 (they moved in in July 2019). No one has been sick, no one has lost hours or a job. Of the couple (the tenants), I have seen the wife unable to maintain a job but it again was never about COVID. My reason to evict was just that, I won’t chase them down every month to drag their rent out of their hand. They managed to convince the 211 folks to give them rental assistance. I was told (by the tenant) I would receive my missing piece of July, and also August and September. “Perfect,” thought I, we can be done as tenant and landlord. They will have time to gather money and go to another place. My brain knew that any other attempt to ask them to legally move on would accomplish me not receiving rent for a while.I received that July late portion and nothing more from 211. Luckily I had already given them legal notice to move. September 1st I was in the courthouse filing the eviction and paying the court. This was ahead of the moratorium on September 4th. I actually was not aware of the upcoming moratorium at that moment. September 3rd they were served eviction papers. Thus far I have received nothing for August and nothing for September. However guess which tenants just bought a car?I also served the tenant an “incurable notice” because of a dog they have, even though my rental agreement says “no pets.” Also, on this notice the fact that the dog has caused numerous disturbance calls to the police and animal control, also against my rental agreement. This alone is also reason enough to evict and again has nothing to do with COVID. It is not covered under the CDC guideline.Of the guidelines #5 would be the only reason a judge would have for not looking at my eviction request. It mentions if the eviction would render the tenant homeless or “couch surfing” (to paraphrase). These are risks to public health. To this I say, “yes they are.”However, it does not take into account that the tenants themselves sometimes have their grown sons and their girlfriends stay overnight. For weeks at a time. That is as many as six adults and a five year old they have in my 550 SQ FT one bedroom apartment. So much for social distance. Why did I take these guys as tenants? I didn’t, it was illegal sublet and for the sake of the five year old, I went with it.Are these tenants taking advantage? I can only say, what is obvious, they saw it coming from a mile back. And we are all stuck pandering to it.The CDC guideline does mandate that tenants try and keep up and pay what they can. The entirety of the missed rent is due at the end of the moratorium, per the CDC. Back rent will be a civil suit for another day.Temporary Halt in Residential Evictions To Prevent the Further Spread of COVID-19~stay well~

My landlord says he’s charging me extra next month because I often bring guests over to my apartment. Could he do this if it wasn’t on the lease?

My landlord says he’s charging me extra next month because I often bring guests over to my apartment. Could he do this if it wasn’t on the lease? In general, a landlord can’t change the amount of your lease payment without signing a new lease with you, or a lease addendum which again, you both must agree to.Unless there is some clause in your lease agreement which allows the landlord to charge you for guests, then usually he can’t change the monthly rent amount without changing the lease itself. If you have a month-to-month rental agreement instead of a full lease, the landlord can change the rent every month. You might advise your landlord that he probably can’t charge you more without amending your lease. Assuming you’re a good tenant (you always pay on time, you don’t break things, you don’t cause other trouble, etc), you should be able to use that to your advantage when you talk to your landlord.
