Memorandum of Understanding (MOU) is a document containing the terms or agreement between two or more parties. MOU or Agreements are made when the parties intend to create a legally binding contract between them and when the document fulfills the requirements of Stamps Act and other requirements for which it is intended, becomes a legally binding agreement.If the parties are stating that the MOU or an Agreement is just a gentleman Agreement and parties do not intend to enter into a legally binding agreement, the same cannot be enforced.
