I’m being bullied at work after whistleblowing. HR are not being helpful and my union rep sounds like he wants me to F off when I ring him to ask him for advice. What should I do? I don’t want to leave. I love my job and the kids I work with.

(My advice applies to Australia and my understanding of bullying and harassment in the work place. It's up to the individual to follow up the laws in their jurisdiction and not rely on my advice alone. I am not giving legal advice.)Start documenting everything that happens after it happens. Ensure it is dated. Even better if the bullying is done via email or phone.Ensure you avoid being one to one with the bulley. Ensure where possible there is at least another whitnessIf possible and when you are required to speak one on one behind closed doors, calmy inform the bully you'll be recording the meeting.If there are any friends you trust ask if they would be willing to be your whitness.Then go to fair work and put in a formal complaint.It won't cost you anything and the onus is not on you to prove the bullying exists. Its on the employer to prove there is no bullying and harrassment. This is going to be hard for them to do as you have a timestamped diary, emails and text messages. Fair work will be a pain as they go through everything.And yes the diary does carry some weight in court even though this is a she said he said situation. You look believable siting from your diary compared to the other person unable to answer questions because “they don't know, don't remember or it didn't happen...”I believe here bullying is considered a criminal offence now and a person can do jail time. This law is due to people who have been bullied in the work place committing suicide.Even if you decided not to put in a formal complaint fair work should be able to inform you of your rights and what you can do.One note, I'm not sure if the formal complaint can be traced back to you and if it will affect future job prospects. This seems to be something said via heresay. I have no idea if this is fact or myth. My thougts are a work culture thats afraid of a formal complaint to worksafe and so chooses not to hire you is probably not a great work culture to work in.I also suggest looking for a new job. It's going to be awkward working for the same employer who has been ransacked by fair work.Last thing, I don't know what happens if your complaints are found to be unreasonable or false by fair work. I'm not sure if there would be legal repercussions. I would presume there would be legal repercussions for false accusations. I have made the assumption the op is ernest and is not an individual who takes neutral situations personally and causes trouble by getting upset at things that aren't actually bullying or harassment.

My perception, based on relatives in the US and UK, that job security in Australia is stronger than in the US, and comparable to the UK.Employment is under the jurisdiction of the Fair Work Commission, which allows many - though not all - employees to seek redress with regards to their dismissal, if the dismissal:was an unfair dismissal - which includes:dismissals based on performance where there wasn't a genuine opportunity for the employee to improve performance,being dismissed on the grounds that it was a redundancy, when it wasn't genuinely a redundancy (e.g. sacking somebody as "excess" then immediately hiring somebody to replace them), orbeing dismissed without a valid reason generally.breached "general protections", such as the dismissal being based on:discrimination, orin retribution for industrial action or a complaint against the employer.The FWC also ensures that employers don't use "sham contracts" to try and treat employees as contractors, and thus negate their obligations.I perceive that employees in Australia have about as much institutional and legislative power as any country that I'm aware of.
