What species of grass? What equipment are you using? If an issue is decided “with prejudice,” it sort of means “end of discussion.”It’s probably best to explain with reference to a couple examples. Consider the dismissal of a litigation, once without prejudice and once with prejudice:Example 1Let’s say I’m mowing my lawn one day, and you’re my neighbor. You look at me funny, and I just don’t like it. Since I have a lot of spare time on my hands, I decide to sue you in court for “impugning my honor and psychic well-being by making a hateful face in my general direction.”You move to dismiss. The technical phrase you’d use in your motion to dismiss is that I “fail to state a claim upon which relief may be granted.” In other words, you don’t necessarily have a factual dispute with me. You don’t disagree that I was mowing my lawn on the day in question, and you don’t disagree that you looked in my general direction. You don’t even disagree that you made a face of some sort.But even if all the facts are as I allege them to be, the conclusion I seek to draw is invalid. The law simply doesn’t provide a remedy under these circumstances.This case will be dismissed with prejudice. There’s nothing more to talk about. If I subsequently try to re-file the case, I’ll get sanctioned.Example 2Let’s hypothetically say I’m a US President shortly after my re-election bid. News outlets reported that I lost. I sue a state in its respective state court, alleging massive voter fraud and seeking to have the allegedly-fraudulent votes deducted.Pause a sec. So far, so good. This is a serious allegation, and it’s exactly the kind of thing that should be argued in court. The facts as alleged would support the remedy sought. But let’s keep going…In a subsequent evidentiary hearing, the court asks me what proof I have of the alleged fraud. I say “don’t worry, your honor, we have plenty of proof. Perfect proof, believe me.” The judge says “I do worry. I’d like to hear the details of this perfect proof, and then if appropriate, I’ll believe you.”I hem and haw, perhaps saying “well, the thing is, I can’t tell you what the proof is right now. For the safety of… the… it’s national security or something. But this is the most massive fraud ever perpetrated, and I will prove it later. Just give me my remedy now, and I’ll prove it later. Okay?”This is the kind of case the judge could reasonably dismiss without prejudice. If I’m saying “I have evidence, but I can’t tell you right now” then a charitable judge could reasonably say “okay, then you can re-start your case at a time when you can show your evidence.”If I subsequently try to re-file the case, the case will proceed.
