I would suggest that you ask for the name of the insurance company, then notify your insurance company of the damage and let them do the work of getting payment from the tenants’ insurance.Issue two, their withholding rent. However, the tenants have no legal right to withhold payment of their rent - only a court can order that, and in a circumstance such as this, withholding rent would not be allowed.So. If you do, and your tenants behave badly, get your attorney involved rather than getting upset by them. It’s amazing how huffy tenants put a muzzle on when the laws are explained to them by a lawyer. Well, some aren’t that bright and might take a while to settle down, but lawyers are used to that. A good attorney is better than antacids, tranquilizers, and headache remedies to make you feel better.Good luck. These tenants don’t sound like winners - get this settled and then get rid of them as soon as legally possible.

Some landlords do require that you carry tenant insurance as part of your lease agreement. If there is a requirement in the lease, your landlord probably can't evict you for it, but there are legal ramifications if you have an insurable event (like a fire) and any of the other tenants suffer damages.
