PDF Editor FAQ

How we can file a case in court without any lawyer? Is it possible?

It’s really not that hard to do. I fought three separate lawsuits by myself. Check out Tatum v. T.L. Rosario, et al., Tatum v. Pliler, and Tatum v. Dr. Sogge.First it depends on what kind of case you’re talking about. If it’s a lawsuit filed under 42 U.S.C. 1983 that is a civil proceeding. There is a specific way to do that, a specific order with respect to the filing of documents and motions and specific courts within which you would have to file your paperwork. If it is a criminal case…same thing. If you are in Criminal Court and you have no lawyer I would advise you to get one. The Court will assign you one if you are indigent. If you ain’t makin’ HELLA chips you are entitled to one. GET ONE! There’s an old saying. He who has himself for a client has a fool for a client.I’m paraphrasing but it’s something like that. The reason is that if you lose you will have no one to blame but yourself. You won’t even have action at a decent appeal because YOU are the one who made the mistakes. That’s not smart. I handled a lot of criminal appeals in my time in there and I can tell you that every single time I’ve read someone’s transcripts I was able to discover NUMEROUS constitutional errors. So you get an attorney only for his ability to relay your desires to the court if you don’t trust them. But if you do this you’re gonna have to do a whole lot of reading and writing. Then you’re gonna have to write out or type out everything yourself so that you can be sure the court is receiving what you want.An example of a couple of pretrial motions are a “motion to dismiss” or a “motion to suppress evidence”. The motion to dismiss would be based on what the D.A. and State are required to show in order to have you found guilty of the crimes you have been accused of.The motion to dismiss that you would file would point out that with respect to your specific crime it is necessary for the jury to find all of these specific elements. It would point out further that the District Attorney has not proved that all of the elements that he was required to find existed and that therefore your case should be dismissed prior to trial.A motion to suppress evidence would be filed if the prosecution went about obtaining evidence in an illegal way. Like through an illegal search and seizure. Same drill. You showing that the evidence was illegally obtained. Bad stop. Illegal entry, invalid search warrant, etc…Then come ex-parte motions for appointment of an investigator, motion for experts, motion for funds, motion for competency exam, motion for disclosure of prosecutions expert witnesses and the data to be relied upon, motion for disclosure under Brady and Kyles, motion for hearing on voluntariness of any admission or confession whether written or oral, motion for hearing on admissibility of enhancements, motion for hearing to determine competency, motion for pretrial hearing, a motion to discover criminal histories of witnesses and also, you guessed it, a motion for substitution of counsel.None of these motions mean anything to you right now, but if you want a good chance at winning you will have these motions constructed before you ask for another attorney. That way the attorney knows you know what you’re talking about and won’t try anything underhanded.Constructing the motions is actually very simple and doing them correctly is crucial to your winning your case. There is a format or template for all motions. The format you will find if you google criminal law motions in Texas. Or whatever state you are in. Might not be the same exactly but it will be similar enough that you will get the idea. If you are in pro per the court is required to give you wide latitude, but you are still required to know what to file and when.Anyway, this is just a short answer. If you need some more specifics and if you can give me some more specifics about the state you’re in and the charges you’re facing (and maybe some of the surrounding circumstances), I might be able to give you a little more direct advice. Hope this helps.

According to evolution, we all originated from a single bacterium. Is this true?

According to evolution, we all originated from a single bacterium. Is this true?Yep. It is true. Is that all you want?I suppose you DO want some evidence. Okay, I’ll give you some. This is relatively long, but I think it explains things fairly well. There is ‘No question’ about it. Genetics provides irrefutable evidence that we are descended from a single common ancestor of all life. The Genetic and DNA evidence for Evolution, and most especially for a Common Descent from one ancestral organism is incontrovertible.I don’t think there is any other possible answer, if you understand the genes.I love genetics and I think that ANYONE who has an interest can learn and understand the genetic evidence enough, to know that there is no other scientific explanation, AND there is amazing, undeniable evidence that this works. If you can understand the rather long details, below, you can at least know that there is overwhelming scientific evidence that we all evolved from a common ancestor. You don’t need to have a doctorate to understand this. The first place you should start is with the Genetic Code itself. Learn what it is, how it works, and how we have Protein Machinery to transcribe it. And then realize there is no other explanation for ALL LIFE to have the same Genetic Code, unless we all came from one original source. The Genetic Code and Protein Transcription Machinery literally could have taken trillions and trillions of different forms and combinations, if it arose separately in different life forms. But it didn’t, and we all use the exact same code and system, because it only arose once, and everything is descended from that one original DNA based life form. When it comes to Genes, the Genetic Code, DNA, and our whole DNA/Protein Transcription Machinery, there is more than just SIMILARITIES between different species. There are EXACT, word for word (gene for gene) copies. You just cannot get the exact same genetic correspondence, word for word, in the genes, and in the system in general and the protein transcription machinery, unless they all came from one original life form.Let me give you an example, but instead of using Genetic Words (codons) and DNA/Protein Transcription machinery, I will use something else that might give you an idea of exactly HOW similar all DNA and Protein Transcription Machinery is:Suppose you were an alien, and you came to earth and looked around. And you noticed that everywhere that you saw a printed document, printed page, printed book or printed sign, the document would always start out written in English (at the beginning of the document), using the Modified Roman alphabet in a Baskerville typeface, and you noticed that it was always printed by a Chandler & Price ‘Gordon style letterpress,’ and it always started with the words, “Once upon a time in a land far far away . . . .,” before it went on to say whatever else it said in the document. If you saw all these things and you went on to study the details, you might determine that the ‘template’ for ALL printing only originated in one place at one time and ALL printing most likely started in the United States, quite possibly in Ohio, and that it started after the mid-1860s but probably well before the mid-1960s. You would also realize that there MUST have been precursor printing techniques, possibly using different languages, different typefaces, different press machinery (Gutenberg press) and different words, but in our example, none of those other techniques survived and EVERYTHING is based on the one single pattern.I kid you not. THAT is how exact the DNA code is between organisms, in ALL life forms, AND the protein machinery which translates/transcribes that DNA code.Let me give you some more reasons why all life comes from one source. Not only do we use the same DNA, we use the same proteins, and the more closely related we are, the more nearly identical are our proteins. If you compare the proteins in the human body with the proteins in Chimpanzees, you will find that we share pretty much ALL of our proteins with them - somewhere around 10,000 proteins. The average length of those proteins is about 435 amino acids. And of those 435 amino acids, only 1 or 2, TOTAL (out of the 435) is different between the two species, on an average. This means that less than 1 percent of the amino acids in the proteins have been changed between us and chimps. Essentially, there probably is not a SINGLE protein in the human body that you couldn’t swap straight out for the corresponding Chimpanzee protein, and not even notice the difference. How do you get that without a RECENT common ancestor? And not only that, but when you go look at the GENETIC CODE that was ‘transcribed’ to make those proteins, you would see that not only did humans and chimps use the same Genetic Code, with the same base pairs (DNA letters) in the Genetic Code, but we used the same codons (genetic Words) made out of those base pairs, each representing the same 20 amino acids, AND whenever ‘Redundant Codons’ were used, (and there are 2 to 6 Redundant Codons for every amino acid, except Methionine and Tryptophan, which each have only ONE codon,) almost always it is the SAME redundant codons that are used, in the same places, in the same proteins (when different redundant codons would have done just as well and given the exact same protein. I suggest anyone interested in evolution look at Redundant Codons, and try to understand how it is possible that we all use the same ones in the same Genetic Code, and then the same ones for the same amino acids in the same places in the proteins. If you go look them up and understand them, and the Genetic Code, you will understand why ALL life came from one original source.Anyway, the RANDOM chance that even ONE SINGLE PROTEIN would use the same redundant codons at 400 of the 435 amino acid positions (and the actual number is higher than 400), WITHOUT BEING RELATED AND DESCENDED FROM A COMMON ANCESTOR, is a chance of: 1 in 2.582249878086908589655919172003e+120, which, for those of you who don’t usually deal with base notation is a chance that they each arrived there randomly, without being related, of 1 in 2,582,249,878,086,908,589,655,919,172,003,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000,000That is a REAL figure. And it is conservative. I used base 2 to the 400th power, instead of base 3 or 4 to the 400th power, as I could have, because of how many redundant codons there are. That nearly infinite number, above, is the RANDOM CHANCE that humans and chimpanzees would share the same Redundant Codons in the same places in the same single protein, UNLESS they both came from the same ancestral organism that had the DNA that passed on those proteins made by those Redundant Codons. This number is larger than the number they call GOOGLE. This number is larger than the total number of particles in the universe. If the universe was a chalkboard and all the particles in it were chalk, and you started to write out that number, in words, on the chalkboard, you would run out of chalk before you could finish writing that number. That is the ODDS that humans and chimpanzees ARE NOT descended from the same ancestor, and that is in only ONE SINGLE PROTEIN, from one DNA gene. So how much higher is it when you multiply it by all 10,000 proteins in the human/chimpanzee body? So, I have a question for you. “Why do we accept that DNA evidence can solve court cases and find the true murderer? Why do we accept that DNA testing can prove who your father is, and your sister and your cousins, BUT THEN why would we REJECT the DNA evidence that shows that Chimpanzees are also our cousins, though slightly more distant!” 96% to 98% identical DNA. That is what we share with the Chimpanzees. Your DNA only differs from other Modern Humans on earth by a similar very small percentage. You are 99% identical in your DNA with other humans. Horses and Donkeys and Zebras, which are obviously related, also vary from each other by a similar genetic difference of only 2 to 4%, similar to how much we vary from Chimpanzees. If you want proof of evolution, then genetics is all that you need.If you want to verify it for yourself, and understand how the Genetic Code shows we are all related, then please just go:Learn the Genetic Code, and understand that we all use the same genetic code and the same protein transcription machinery, when there is no reason for ALL LIFE to happen to use the same Genetic Code by chance, unless we are all descended from the original organism that used the original Genetic Code.Learn how the same 20 amino acids are used over and over by all of life, when there are millions of potential amino acids, and there is no reason we all use those same 20 amino acids, and don’t use ANY of the other millions of potential amino acids, unless we are all descended from the original organism that used the Genetic Code.Learn that the Genetic Code has Redundant Codons built into it. Meaning that there are anywhere from 2 to 6 ways for the Genetic Code to ‘write’ for any one amino acid (except Methionine and Tryptophan), and ALL versions of the Genetic Code (there really is only ONE version, but in ALL different life forms) use the same genetic letters for the same Redundant Codons, coding for the same amino acids in the same place in the code. And this could not happen unless we are all descended from the original organism that used the Genetic Code. You should also learn how, when we make a protein and a chimpanzee makes a protein, we use THE SAME Redundant Codons to specify the use of THE SAME amino acids in THE SAME places in the protein. The chances that this would occur by random chance, without being descended from a common ancestor, gives you the number I wrote, above. A number that is, essentially, an infinite probability AGAINST such a chance occurrence. When you compare our Redundant Codon ‘choices’ to the analogous protein in other, more distantly related species, such as Horses or Whales, or Lizards or Fish or Insects or Fungi or Bananas, you find that the more closely related we are (the more recently we shared a common ancestor) the more of these Redundant Codon Choices we share. This would not happen unless we are all descended from the original organism that used the same Genetic Code, with the same Redundant Codons and the same amino acid choices in the proteins.Learn that we share at least 96 to 98% of our DNA with Chimpanzees, and around 75% of our DNA with Horses and Dogs, 60% with insects, 45% with fungi, and 40% or so with plants, and about 30% with bacteria. How is it possible to account for this genetic similarity/genetic correspondence, unless we are descended from common ancestors, and isn’t it interesting that the exact amount of genetic similarity is determined by exactly how recently our common ancestors lived. At least 80% of our DNA is relatively useless ‘Junk,’ but we share the exact same junk with related species. Learn that even ‘Useless’ DNA/Inactive DNA/’Junk DNA is conserved across species, again, to the exact degree they are related, and this shows up in us all having the same ‘genetic errors’ in the same places, and the same ‘Ghost Genes’ in the same places and the same ‘Fossil Genes’ in the same places. This can ONLY happen if we inherited this material from our common ancestors.Learn that approximately 10% of our DNA is ‘inactivated viruses’ that have inserted themselves into different places in our DNA, often many hundreds of millions of years ago, and all life descended from those creatures that caught those initial viral infections still has the same inactive viruses in the same places. How could we possibly have the same ‘dead’ viruses in the same places in our DNA, unless we descended from a common ancestor? So, really, THIS is irrefutable evidence that we are all descended (evolved) from one ancestral organism that started it all out, at the very beginning of life.IRREFUTABLE. So, let me hear ANYONE try to refute it.Unfortunately, I will tell you what will happen. Rather than trying to learn and understand, and try to refute it, the Creationists will just ignore it, deny it, and say, “There IS NO EVIDENCE!” Just like they always do. It is easy to ignore things if they contradict your belief, and easy to deny the evidence if you refuse to learn it in the first place. In essence, considering that almost all of our important genes, proteins and biochemical processes were developed in the original bacteria, and then just modified slightly as we ‘progressed,’ you probably should just think of us as big, overgrown bacteria.
