PDF Editor FAQ

What was your most memorable situation as a tenant with your property manager?

It wasn’t a manager, but the owner. I had no off street parking access. I understood this and didn’t consider it to be a deal breaker when I signed the rental agreement.Street parking can be a pain in the winter months. In order to get to work, you had to dig your car out from the curb whenever it snowed. The next morning you would have to do it because the city had plowed the snow. Every time a snow plow went down your street, you had to shovel your car out! But, this is Iowa. I grew up here. At that time I hadn’t experienced anything else.I was prepared for the snow. My landlord’s paint spraying however, I was not.I had gone out of town with a friend. I left my little Ford EXP where I parked it every day. I didn’t tell my landlord that I was going to be gone, I didn’t see the need. I would only be gone overnight. We had a weird relationship. I rented the first rental property he had ever owned. He lived right next door. He and his wife, their 3 older kids, and their dog watched me constantly. My living room windows were facing their living room windows. I would glance out the window and see the curtain in their window jerk back into place. I caught them peeping out at me enough times that I took a drastic measure. For the first time (not the last) I hung a blanket over my windows. It was effective in stopping their surveillance and turned my living space into a cave. This seemed to enhance their desire to spy on me.I was fairly routine in my comings and goings. I also brought work projects home with me frequently. My arms would be loaded when I did. I have always tried to make only one trip carrying stuff in. I would, and still do, almost kill myself making one trip to avoid making two.Every day I had an audience. The entire family convened on their front porch, or in their front windows, to watch me come home. I got so I hated this time of day. No one spoke, so neither did I. There were no offers to help, just snickering if I dropped something.Ok, to the point of your question. He had decided, while I was gone for that overnight trip, to spray paint the house that I rented. There must have been a fairly good breeze that day. He spray painted my black car. With white house paint.Little white dots covered it. He hadn’t said a word about his plans to spray paint. I would have moved my car.He didn’t say a word when I returned from being out of town. Strangely, no one but their yapping dog was there to watch me as I got home. No one answered the door when I knocked or the phone when I called.I had to take him to small claims court. The white paint had to be professionally removed from my car. $300! A friend of mine was a well known local attorney and he went to court with me. Pro bono. The landlord decided to present a bunch of perceived infractions on my part in his defense. The judge shut him up in mid sentence. He told the landlord that if he felt he had a case, to go file his own paperwork. He was not listening to his complaints during my proceeding.I won. $300.00 and he had to pay court costs. Had I been retaining my friend as my lawyer, he would have had to pay his fees, also. He was pissed!I moved to Dallas, Texas with in the next few weeks. I couldn’t get out of there fast enough!

My neighbouring family keep claiming that they had a verbal agreement with the previous owner to use our swimming pool and don't take any subtle hints. How can I stop them from using without involving any police as we are outside HOA?

The last house we owned the neighbor informed us she had an agreement with the previous owner to use our driveway, and remove the fence so she could access her backyard and park her trailer behind her house.I told her that was nice. I locked my gate and said it was my house now. It never came up again.Stand up for yourself and your home. Tell this neighbor that the agreement with the previous owner ended the day you took possession of the house and property. There should be no subtlety about it. You will be legally liable if someone gets hurt or drowns in your pool. Once you have told them and placed a lock on the gate to the pool and yard they are trespassing if they enter without your permission.A neighbor that insists on entering your property based on the permission of a previous owner is not someone with whom I would associate. If they persist in using your pool, then you definitely have every right to involve the police and get an attorney to assist you in taking legal action against them.

Is it within my legal rights as a tenant to send packers and movers to vacate my apartment if the landlord is against it?

It depends on the circumstances. If you are being evicted for non-payment of rent or if you have not given the landlord proper advance notice of your intention to vacate or if you are on a lease that is not near the end, then yes, the landlord may have a legitimate problem with that. Whether or not it is legal for you to vacate depends on the terms of your rental agreement and whether you have complied with those terms. If you are moving legally, then the packers and movers have to comply with the on-site rules for parking, access and procedures for minimizing the disruption and disturbance of other tenants in the complex. You should ask the landlord why he is against it.
