What is the fodder scam of Lalu Yadav?

Twenty-four years ago, on January 27, 1996, a raid on the offices of the Animal Husbandry department in Chaibasa unearthed the Rs 950-crore fodder scam that embroiled then Bihar chief minister, Lalu Yadav, in a lifelong tussle with the CBI. Large-scale embezzlement of government treasury funds given to non-existent companies for purchase and supply of cattle fodder in Bihar in the 1990s was the highlight of this scam.Image: Lalu convicted in the Fodder Scam by a special court in 2017, embezzlement of more than 900 crores.The fodder scam started with small-scale embezzlement done by low-level government employees to show the transfer of some fake funds. When it grew, it also started to include businesses and politicians, increasing the amount of money embezzled. The then Comptroller and Auditor General of India, TN Chaturvedi, noticed delays in submissions of monthly accounts of the Bihar treasury and warned of possible laundering of funds in 1985. The Animal Husbandry Department had made fraudulent withdrawals of big bills of Rs 1,000 crore in the name of medicines during the chief ministerial tenure of Lalu Yadav. However, the raid only happened in 1996.Image: T.N. Chaturvedi, a scholar in bureaucracy and politics, was one of the first people to notice anomalies in the Bihar treasury that led to the investigation and uncovering of the fodder scam.In March of the same year, the Patna High Court directed CBI to investigate the scam.As the investigation progressed, the CBI formally requested the then Governor of Bihar for permission to prosecute the CM. In June 1997, the CBI filed charge sheets against Lalu Yadav and 55 other co-accused. The accused had 63 cases registered against them under three sections: IPC Sections 420 (forgery) and 120 (b) (criminal conspiracy) and Section 13 (b) of the Prevention of Corruption Act.Lalu Yadav resigned as chief minister as his then party Janata Dal pressured him to not hold office while being under criminal prosecution. He dissociated from Janata Dal and formed his own party Rashtriya Janata Dal, He resigned in July due to mounting pressure but installed his wife Rabri Devi as the chief minister who won the vote of confidence in July 1997.Image: Rabri Devi, the first female CM of Bihar, also the first and only illiterate CM of our nation, responsible for jungle Raj in Bihar. However, Rabri was able to get bail while Lalu Yadav stayed in jail. A month later, Patna Hight Court granted him bail which was extended several times.By this time, the new state of Jharkhand had been formed and the fodder scam cases were transferred to Ranchi. A special CBI court in Ranchi acquitted both Lalu and his wife on December 18, 2006, in the DA case.In 2012, nine years after the charge sheet against 44 people was filed in a cased related to the multi-crore fodder scam, the CBI framed charges against Lalu Yadav and others. They were all convicted by a Patna CBI court in 2013, a judgment that Lalu Yadav contested. The conviction also disqualified and barred him from contesting any election for 11 years. This article will be very long but it's important to understand the entire back drop.Opportunist and Vote bank politics won in Bihar against a potential Development oriented politics.Nitish is the prime factor in this win of Mahagathbandhan.Just because Namo became PM of India he broke away from the JDU-BJP combine which was ruling in Bihar just to safe guard his vote bank.The same voting bloc grew for Nitish and his strategy worked as far as vote bank politics is concerned.Nitish also became a support Pillar for RJD chief Lalu Prasad Yadav. Lalu another seasoned vote bank politics champion, who was already vouching for a formidable allie and he got Nitish's support as a shot in his arm. As he still holds the MY vote banks with him.To add to all this INC and SP also joined the band wagon. This made the Mahagathbandhan possible.On the flip side, BJP fought the battle well, but they didn't had the answer against the Solid Mahagathbandan.Because, BJP during the campaign continued with its Loksabha style of public meetings. Today's voters especially voters from UP and Bihar are much-much-much aware of the difference between the Loksabha/Vidhansabha/Local Body elections.They are smart enough to compare parties and their candidates plus the vote blocks they belong to.Mahagathbandahan leaders when they were doing rallies in Bihar, they had people from Bihar and local politicians who addressed the leaders and rallies.Whereas BJP had very few Local leaders alongside Amit Shah. Local leaders from Bihar were given very less screen space in the Electronic media and in the Print media too. People should be made aware that who are the State leaders from BJP representing these states including Bihar.The above was just a dry analysis of the trends and results.I as a neutral person, fail to understand the mind set of the voters as well, especially from the states of Bihar, UP and West Bengal.If you take last 15-20 years sample data of the governments elected by these states,they have always elected a govt which is other than the party ruling at the Center.Bihar:Last 20 years:3 Cheif Ministers: Lalu Prasad Yadav & Rabri Devi (15 years) and Nitish Kumar (5 years).All these govts were different from the political group or party ruling the Central govt.Under Lalu and Rabri Bihar became Maha Bimaru state and reached epitome of lawlessness and corruption.Under Nitish Kumar with Support of BJP, Bihar started to come on track slowly but not at good pace because, JDU was not an allie in UPA which ruled central govt during that tenure.And the irony continues, again Bihar have elected Mahagathbandhan which is non-allie with the NDA which is ruling the Central govt now.What I am trying the highlight here is, Whichever states have same party govt in State and Center have prospered well.Highlights of Lalu Yadav and Rabri Devi as CM:Fodder ScamIn 1996, Yadav was accused in the "Fodder Scam" in which about Rs.4.50 billion (US $111.85 million) were siphoned off from the animal husbandry department, albeit the probe itself was ordered by him. Several reports of alleged embezzlement of money withdrawn from animal husbandry department were tabled from 1990-95. In January 1996, a raid conducted on Chaibasa treasury indicated the siphoning off of funds by non-existent companies. Yadav then ordered an inquiry to probe the alleged irregularities. However, after a public interest litigation, the Bihar High Court in March 1996 ordered the case to be handed over to the CBI. In June 1997, CBI filed the charge sheet in the case and made Yadav an accused. The fodder scam forced Yadav to resign from the office of Chief Minister and he appointed his wife, Rabri Devi, his successor as the state's Chief Minister. In 2001, Supreme Court transferred the scam cases to newly formed Jharkhand and trial began in a special court in Ranchi in 2002. In August 2013, Yadav tried to get the trial court judge transferred, but his plea was rejected by Supreme Court of India. Yadav has been an accused in many of the 53-odd cases filed. He has been remanded to custody on multiple occasions because of the number of cases. Over 64 people were convicted in the case. Yadav was first sent to "Judicial remand" (Bihar Military Police guest house, Patna) on 30 July 1997, for 134 days. On 28 October 1998, he was again sent to the same guest house for 73 days. When the Supreme Court of India took exception to his guest house stay, he wasmoved to the Beur jail in Patna. On 26 November 2001, Yadav was again remanded, in a case related to the fodder scam. Yadav accused the NDA of creating a conspiracy against him. On 1 October 2004, the Supreme Court of India served a notice to Yadav and his wife, Rabri Devi, on the fodder scam. This was in response to a petition which alleged that they have been interfering with the investigation.Conviction and Arrest for Corruption:Laloo Prasad Yadav, along with 44 other accused, was convicted on 30 September 2013, by Central Bureau of Investigation court at Ranchi, after being found guilty in fraudulent withdrawal of Rs.37 crores from Chaibasa treasury. Several other politicians, IAS officers were also convicted in the case. Immediately after the verdict was pronounced, Laloo Prasad Yadav was arrested and taken to Birsa Munda Central Jail, located at Ranchi. Consequent upon his conviction, Mr. Yadav stands disqualified as MP and he will not be eligible to contest public election for next six years. He has been given a jail sentence of five years and a fine of 25 lakh rupees.Release:He was released on bail from Birsa Munda Central Jail, after he completed the bail formalities in a Special CBI court, two-and-a-half months after he was convicted in a fodder scam case.Disproportionate assets:In 1998, a disproportionate assets case was registered against Yadav and Rabri Devi. In April 2000, both were made co-assused in the charge-sheet and surrendered. While Rabri Devi got bail due to being CM of Bihar, Yadav was remanded for 11 days and sent to the Beur Jail.Summary:In last 20 years such ineffective and corrupt people ruled Bihar and did their best to keep the stae backward and downtrodden. Still they are getting re-elected.Same thing applies on UP and West-Bengal:UP last 20 years,CM's: Mulayam Singh Yadav (SP),Mayawati, Kalyan Singh(Bjp), Ram Prakash Gupta (Bjp), Rajnath Singh (Bjp),Akhilesh Yadav (SP)All these CM's had non allied State govts, although SP and BSP supported UPA for some time. But this support by BSP was for other reasons, so that CBI remains soft on them for TAJ corridors and other corruptions charges. Similarly SP supported UPA unconditionaly to avoid CBI, Curroption and Law & Order isssues. If people can re-collect SP govt under Mulkayam Yadav once stopped Rahul Gandhi from entering UP during UPA 1 in center.During the BJP tenure there was NDA govt of AB VAjpayee hence that's the only period when UP did quite well as far as Law & Order and state administration is concerned.Highlights of RajNath Singh as CM:In 2000, he became Chief Minister, he tried to rationalize the reservation structure in government jobs by introducing the most Backward Classes among the OBC and SC, so that the benefit of reservation can reach the lowest status of Society.In 2003, Singh was appointed as the Minister of Agriculture and subsequently for Food Processing in the NDA Government led by Atal Bihari Vajpayee, and was faced with the difficult task of maintaining one of the most volatile areas of India's economy. During this period he initiated a few epoch-making projects including the Kisan Call Centre and Farm Income Insurance Scheme. He brought down interest rates on Agriculture loans and also established Farmer Commission and initiated Farms Income Insurance Scheme.Highlights of Mulayam Singh Yadav as CM:Yadav and other members of the SP were criticized for conducting a festival during a crisis following riots in Muzzafarnagar, Uttar Pradesh. He and his party formed a pre-poll alliance for the 2014 Indian General Election that involved ten other parties. He was elected as a member of the 16th Lok Sabha in those elections from two constituencies - Azamgarh and Mainpuri - and subsequently resigned the latter seat.The crime of rape became a capital offense in India following the 2012 Delhi gang rape incident. Yadav has opposed this change in the law, saying that "Boys will be boys. Boys commit mistakes".In response to another notable rape case and Yadav's comments, UN Secretary-General Ban Ki-moon said “We say no to the dismissive, destructive attitude of, 'Boys will be boys'".On 19 August 2015, Yadav remarked that gang-rapes are impractical and rape-victims in those cases tend to lie. He was summonsed by the judicial magistrate of Kulpahar court in Uttar Pradesh for that remark.During the 2014 Lok Sabha election campaign, Yadav vowed to abolish use of the English language, computers and mechanized farming. He said that such technology creates unemployment.Highlights of Mayawati as CM:Mayawati's political career has attracted praise and controversy. She has been praised for her fundraising efforts on behalf of her party, and her birthdays were major media events as well as a symbol for her supporters. She was criticized for the grave corruption and lawlessness in UP during her rule.Taj corridor case :Central Bureau of Investigation (CBI) raided twelve residences, including Mayawati's. It had filed a First Information Report against her and seven others two days earlier.[49] The raid uncovered evidence of assets disproportionate to her known income.Birthdays Fund Raising:Her birthdays had become major media events at which she has appeared laden with diamonds. Her supporters have declared her birthday as Jan Kalyankari Diwas (People's Welfare Day). In 2009 the day was marked by the announcement of welfare schemes targeted towards poor and downtrodden people of the state and in 2010 by the launch of programmes with a value of over ₹ 7,312 crore. This money never reached the poor and downtrodden people.Disproportionate assets case:Mayawati's assets run into millions of dollars, with several properties to her name. In the 2007–08 assessment year, Mayawati paid an income tax of ₹ 26 crore, ranking among the top 20 taxpayers in the country. Earlier the CBI filed a case against her for owning assets disproportionate to her known sources of income.Statues:In her tenures as a Chief Minister, Mayawati commissioned the production and public display of several statues representing Buddhist, Hindu, and Dalit icons and of herself. She claims that the expenditure was required because the past governments did not show respect towards Dalit leaders, in whose memory nothing had ever been built. She spent somewhere between ₹ 25 and 60 billion rupees (about US$500 million to US$1.3 billion) on projects in five parks and at memorials such as Dr. B.R. Ambedkar Samajik Parivartan Sthal and Manyavar Kanshiram Smarak Sthal, built in the name of B.R. Ambedkar, Ramabai Ambedkar, and Kanshi Ram in Lucknow between 2007 and 2009. In June 2009 the Supreme Court issued a stay against further building on the projects, until the Public Interest Litigation (PIL) questioning these expenditures was settled. The Comptroller and Auditor General of India reported that ₹ 66 crore (about US$12 million) in excessive costs had been incurred on the construction of the memorials.World Bank criticism:The World Bank loaned India funds for development, and Mayawati was to manage projects with this money in UP. The projects were pre-planned and on schedule, but the Mayawati government made changes which put the projects behind schedule, including rapidly transferring high-caste managers in and out of rural posts. The World Bank sent a letter of complaint on 1 August 2002 to India's central government stating, "We have now learnt that project managers have been replaced within three weeks of assuming office. The project coordinator of the Diversified Agriculture Support Project has been changed twice in quick succession and at the moment there is no project coordinator. In the forestry project, numerous changes have been made over the past six months ... Such developments do not augur well for these time-bound projects that require consistently good leadership. Mayawati initially responded by saying the letter was a fake and later said there had been a misunderstanding. The World Bank continued to criticise the level of corruption even after these measures had been implemented.WikiLeaks allegations:Diplomatic cables published in 2011 through WikiLeaks detailing the opinions of American civil servants asserted that Mayawati ran all governmental decisions through her small group of advisors and that she employed food tasters for security. The leaked messages also allege that she had sent a private jet to Mumbai to retrieve a pair of sandals.I wont elaborate further on West Bengal .. but its was under Communist Rule for not 5, 10 but 30 years. The same 30 years made West Bengal into a non-performing, unstable and lawless state.Chief Ministers of West Bengal in last 20 years: Jyoti Basu (CPI-M), Buddhadev Bhattacharya (CPI-M) and now Mamata Banerjee (TMC).The law and order situation is so grave because the state shares boundry with West-Bengal, that recently the NSA of India had to visit the State to handle the situations. The incident was Burdwan blast case.Its so pity that due to political reasons, TMC chief and CM of WB were not co-operating with the investigation agencies. Also TMC and its various leaders are involved in Sharda Chit Fund case.The above summary is given just to highlight the pointers, on the work, for which political parties and their leaders were known in the last 20 years.Apart from few, none of the leaders are involved in serious work, every one is involved in pity politics, corruption, vote bank politics, Vision lessness and lawlessness, anti-development, criticized by World bodies like UN Chief and World Bank.Despite all this glaring loss to the people and to the States mentioned above, people of this country are not able to think above the caste, community and religion based vote bank politics. By and large, if you combine the population of UP, Bihar and WB 40 crore plus people reside in these states and the same people have been victim of mis-governance, corruption and no development at all. This has been the case with the entire country but these 3 states are the most backward sates.The major reason for this is the vote bank politics, caste based politics, religion based politics and only dirty politics.Its time that the youth of this country start taking politics seriously by applying their own minds and thinking long term when deciding to elect their governments.This includes every state including Bihar.Just imagine just like the Western and Southern corridors, if the eastern corridor too starts running with full steam, India can register a GDP growth of more than 10-15 % p.a. Which means more expenditure by the govt in the Industries, Infrastructure and Agriculture too. This will automatically elevate the per capita income of these big states.Like the major ports on the Western coast line from Gujarat to Kerala, Eastern coast line too has potential and Kolkata is one of the most strategic port city in India not only today but since ancient times. Wb to Orissa to Andhra to TN can turn the tide, if given proper development planning and a visionary political will.The Sea ports are just one indicator, there are many many more points which can have positive ramifications on the countries future.
