Wow Luke… just Wow!You are the reason I absolutely love Quora dude.I am going to assume that you are a writer and you are looking for insights into a character you are drafting — even if that is not the case let’s assume it is.But of course someone is going to look this question up because they have an active warrant and want instructions for how to get a fake ID an move to Belize where they can live a life of luxury and tell the ‘coppers’ to go to Hell.I know a few who have done it but it is not exactly easy and the reader isn’t that ‘good’ so the question actually leads to a number of other questions.A: What do you mean by ‘run’?B: Do you ‘love’ anyone or are you a psychotic loner?C: What is the cost compared to benefit here?So for “A”: One can ‘elude’ a police officer either by driving a vehicle at high speeds (or in certain ways as I will explain) - one can ‘run’ and escape while in custody or one can run away and hide before being taken into custody or … and this is by far the most common - one can ‘jump bail” and fail to appear in court and be issued a warrant for arrest.This is typically either a standard or standing bench warrant or a nightcap (MN).The difference is very big.So we look at the ‘eluding’ an officer first:Unless specific planning exists which include other ‘blocking’ pursuit, a preplanned route and ‘obstructive interference’, and the intent is to avoid penalties far exceeding the sometimes felony charges for evasion of arrest via vehicle etc the actual charge for ‘eluding an officer and or obstructing legal process’ is not given to those who tried to escape but who tried to do something else. And you can forget about the dramatic high speed chases seen in the movies bro.So this “individual” had some issues and in fact still does with following the rules concerning the ‘privilege’ of driving in Minnesota… so much so that since 2014 if a vehicle is stopped while being driven by.. this person the plates that are on that vehicle will be impounded - which means the vehicle will be forfeited and impounded.This means that the police will be ‘forced’ to do what is called an “inventory search” meaning that they do not need a search warrant because they are simply making an ‘inventory’ of the contents of the vehicle.But of course because they will be ‘forced’ to inventory any vehicle this person is driving if they do find anything that would be considered evidence of a crime or of course contraband material which is a crime in itself to possess such as well… drugs let us say - then they can charge this person because it was found in the course of their required duties because they were forced to impound the vehicle.Needless to say that every cop in a certain area of the state keep an eye out hoping they will see this person driving because snatching vehicles to be sold by the county sheriff is big business now a days.So… whenever this person is spotted in whatever vehicle at the time there is going to be a charge of ‘eluding via vehicle’ but that so called chase is typically going to be under whatever the posted speed limit is.so in the case above (which is only one of very many) they got a 2001 Eclipse GT which was customized to the extreme (don’t bother looking up the vin and plate number because this person has not registered a vehicle in this persons name since the 90s and you would only find the name of the person who sold the vehicle before 5/29/2017 not the person being discussed here).And of course the ‘recipient refused to sign’ only a very stupid criminal would sign anything ever.But you will note that this time the ‘recipient’ was asked to sign while in the Mill Lacs County Jail because the ‘recipient’ was accused of evading a police officer AND throwing drugs out of the window.Of course the ‘recipient’ had no problem sitting for a night in jail because prison time and all other time was avoided by doing so.So here is where irony comes into play and things get sort of funny when it comes to the law.Even though any and every vehicle this person is found to be driving will be impounded and the plates from the vehicle seized in theory… unless drugs are found or the individual is drunk the vehicle might be retained by the person who is still on the title of the vehicle because it will not automatically be forfeited to the county BUT it will every time anyway because and here is the ‘kicker’…Yep… the officers can and do seize and pronounce forfeited any vehicle that they accuse anyone of using to flee from them.They noted drugs being thrown out the window so they could also seize this:This is because they know that even if they found a pound of drugs lying in the street after the incredibly stress-filled chase this person will get to court and say that well… whatever might have been found in a public roadway or related ditch was not found to be in the physical or in material or assumed possession of any individual who may or may not have been accused of at one time possession said thing found…Now I want you to read the following very carefully -What she does is ignore the lights and and the siren and drives at about 25 miles per hour yet somehow “swerved quickly into a driveway” then gives herself up.She knows they will see her holding her arm out the window and they will look for baggies of drugs along the path she takes and they will try to claim that the drugs found along that path were dropped by her but unfortunately the officers fail to understand that even the best camera system in a squad car is not going to provide enough accuracy to show a jury that the 2 by 2 inch plastic packages found by the officers were in fact dropped by the accused and she is going to claim that she was only trying to wave away the annoying teenagers she had assumed were behind her with bright lights on when she stuck her left arm out the window “OH and of course that time I was trying to remember if that is the right signal for a left turn or a right turn whatever… I was trying to signal a turn that time… “And occasionally some well meaning but very stupid officer will alter the timeline or declare that he personally was able to view a baggie or blah blah blah being dropped from the hand of the defendant and typically that will eventually fall apart and all charges will be dismissed but you see by avoiding being in physical possession of cocaine or meth or anything she is saving a fortune and staying out of prison and jail for that matter.The high speed chases are always initiated by very stupid criminals who deserve additional charges because they are not in control.BTW if you are a criminal reading this and think I just gave you a ‘get out of prison card’ think again.When you try it you will fail.It really is that simple because the only reason why she can pull it off is decades of training in not only not telling the police how to trip her up but in what she can and does say that causes them to fail on the witness stand.That level of skill is not something that one can pick up without years of torturous 36 hour sessions in the hands of individuals who will hurt you very badly if you fail because their livelihoods and - futures - depend upon your ability to talk to the police when every other person should not.In the life she is known as a ‘gabber’ in some circles.A ‘gabber’ convolutes an investigation to such an extent by acting drunk or just plain crazy and police officers love both of those sorts because they are checking off boxes and think they are learning all sorts of secretive criminal activities when in fact they are hearing a carefully practice explanation of who Keyser Soze is and why he isn’t one of the ‘usual suspects’.So if you are arrogant enough to try it expect to fail.We then come to ‘the run’ or an escape from custody.Writers should note that this too has been subjected to way too much HollyWood and not enough reality.I created the above to send to a defense attorney and a prosecutor with a request that they provide the judge with a copy as sending something to a judge now-a-days can create ‘ex-parte communication’ so never send anything directly to the judge but instead ALWAYS send anything you want the judge to see to BOTH sides at the same time. If it is something that the defense attorney can handle then simply provide it to the defense and rely on the legal council to distribute it in the best way. Unfortunately THIS particular transaction had to be done this way because my cousin was firing her lawyer on the first scheduled day of trial which is pretty much unheard of but was granted due to her assigned legal council also being the legal council of one of the disclosed witnesses for the same event who was offered a plea bargain to testify against my cousin - insane really but not all that uncommon in overworked state appointed council systems.I am required to place an important disclaimer here: I am not a lawyer and I did not send anything but instead the defendant simply requested that I assist her in typing it up (and that may have been a mistake because there are a number of typos… possibly intentionally but possibly not, I never asked her if she edited it for content) and then the defendant approved the content and the submission.It is illegal to practice law without a license in most of the states and I never practice law but in this specific case offered assistance to a relative who was being railroaded into charges.You should note that in this case the ‘informant’ was an ‘escapee’ who upon arrest and knowing that he was being sent away and would never recover HIS drugs he grabbed an agent and told a story about where HIS drugs would be found and that they were not HIS but someone else’s drugs.He chose my cousin because she was the only female who lived in the apartment complex so she would be the one who was most likely at home and or in the public laundry area doing laundry.It was a somewhat smart scam but fell apart rather quickly when presented properly to the court.Anyway let’s discuss why this so-called informant was an ‘escapee’.He didn’t ‘crawl through a river of filth and come out clean on the other side” to quote a very good movie. In fact he ‘escaped’ just as the vast majority do in America - he requested to be released in order to have dental work done then simply didn’t come back!Although my brother Gary was involved in a few ‘hair-raising movie thrilling escape plans and sequences’ (for example when the warden went to inform him our brother Rodney had been shot and killed while unarmed on Christmas Eve in 2004 - a fabricated dummy was found in his bunk so the warden claimed he was attempting ‘another’ escape - this time to avenge the death of his brother. When the fact is he used that dummy all of the time to go down to the welding stations in the shop and get high. Rodney’s death only broke the routine that allowed him to do this as often as he could - coincidental in that case) yet the fact remains that unless one is on death row and will never see the light of day (such as Gary was at the time having three life sentences placed on him) just about every prisoner can get out of confinement pretty easily for medical or even for the purposes of seeking employment ahead of being released.There are a number of reasons for this and one of them is actually commendable - politicians watch movies too and none of them want desperate criminals willing to die before returning to a cell again… why have the shootouts and the hostages and everything else involved when you can simply make the penalty severe enough to prevent ‘most’ inmates from even attempting to leave custody?Which brings us back to our previously mentioned ‘informant’ who simply didn’t return from the dentist because he knew he was going to be sent to another county and face another year in jail for ‘unauthorized use of a motor vehicle’ which is what stealing a car has become unless you take it by force.Why would he ‘risk’ escaping from custody when he would be getting an ‘additional’ year in jail and an ‘additional’ $3,000.00 fine?Well that is not a simple thing but not really hard to grasp.He had almost finished one year for the same crime in Blue Earth County which has … as odd as it is to say… a really nice jail system when compare to Olmsted county where he was about to be shipped to so he would much rather serve another year where he was for escape than to spend a year in the other county system. It may be hard to believe but the truth is that depending upon the county wealth base and class system structure criminals have a very wide preference in what county jail they would rather serve time in. And Mr Cobb (that is his last name) knew that because he was serving one year in Blue Earth County and the maximum sentence for escape from a gross misdemeanor is not ‘one year and a day’ which places him in state prison but ‘up to one year’ which insured he would stay in Blue Earth County jail to serve that time.On the other hand had he not ‘escaped’ he would be sent to the much stricter Olmsted county which has a tendency to avoid the cost of housing inmates by adding that one extra day for car thieves and send the convicted to Stillwater prison. He also knew that all he would have to do if/when he was captured that all he had to do was grab one of the drug task force agents and offer up a story and that agent would ask the district attorney to allow him to serve the Olmsted county sentence at the same time as the sentence for the escape…so you see, by being an ‘informant’ Mr Cobb had absolutely nothing to lose by escaping and in fact quite a bit to lose if he didn’t walk away.He would do another year either way but by ‘escaping’ he insured that the year he did would be in the place of choice.You can always tell whether you live in a location with a jail that is ‘better’ than other jails as far as the inmates are concerned by the number of one or two day escapes.Somebody ‘escapes’ from the Blue Earth County jail and they are ‘caught’ the next day or a day or two after because they are still there in the same town as the jail they escaped from.Somebody escaped from Rochester MN (the county seat of Olmsted County) and they are still caught but it is months if not years later and typically in another state because they sure as Hell ain’t staying near that jail.And then we come to jumping bail: man this is getting long isn’t it?Well you asked the question dude.Remember when I told you this was the most common cause for being on the ‘run’ from the law?Well just go to your own county website and look for a link or do a search for “active warrants’ once.But be prepared for a bit of a shock if you think your local PD is on the ball.First of all don’t pay attention to the names this is just an example pulled as I type this and none of these individuals have been found guilty and very well may not even know they are wanted (often rescheduling of court dates without properly informing the defendant causes this) but instead I want you to pay attention to something else. The four to one ratio appears to hold pretty steady concerning felony wanted warrants verses misdemeanor wanted warrants.Why? Well it goes back to the expected penalties for escape from a misdemeanor or from a felony.Someone facing less than a year in jail is often offered a plea bargain that includes no jail time and even if that is not the case few want to double the year they are facing just to postpone the inevitable a short while.Yet there is sometimes a bigger thing at work: you will note that Jeremiah has two warrants out for him for apparently the same crime and may wonder why.Don’t because I will explain it.This is a better example because the warrant dates issued are different so they can not be for the same crime but instead are for different crimes.Mathew is my brother Rodney’s son - he was arrested and didn’t return for the 9/4 warrant but had another warrant issued on 1/24 (my birthday by coincidence) for another crime in which he was tentatively identified but not caught physically.When you see this it shows a couple of things: One is that ‘Matty’ isn’t that good at being a criminal since he was caught and then identified another time; his father would be ashamed - and the other is that while he might not be very good at his particular criminal activities he has remained in the area instead of splitting and so he is pretty hard to catch if nothing else.In my youth (before this craze called the Interweb or whatever) it was very rare to have more than one warrant in any given county but if someone had warrants in many different counties it usually meant they were “Going to the Bank” as my dad used to say.This indicated that the individual was caught ‘red-handed’ so to speak in the original criminal act. There was no way that a jury was going to find him not guilty and so he knew he was going for hard time one way or the other so… why go before you could raise money for your family to use while you were away?I am not sure at this moment but I believe my brother Rodney faced 143 counts when they finally caught him in 1984 or there-about.He knew that he would face a murder charge when he was finally caught so 142 theft charges didn’t concern him all that much and sure enough he was actually charged with only two counts when he went to court; murder and conspiracy to commit murder. The thefts were sort of swept aside in that situation and I have no idea how much cash he actually raised during the interval but I know it was more than $300,000.00 because I say him paid that amount in cash once.So his choice was show up for court on a theft (I actually think his first charge was some sort of insurance scam) and sit in a cell waiting for the informant to be revealed concerning the murder charges (he already had that info having paid an officer in Le Center (county seat of Le Sueur County) who showed him the statements recorded by the county sheriff) or… go balls to the wall and have money going in.Think about it… do you want to be poor in prison and beg relatives for cash to buy overpriced candy bars and bad coffee or do you want to have enough cash to buy everybody else’s candy bars and then demand favors in return?Of course that often leads to more criminal endeavors (Rodney made a lot more in prison than he ever did on the outside but his crimes became almost biblical. )So yea good question: hope this helps you with your writing skills etc etc…As for me… well I have never broken the law of course because I am a good moral upright American Citizen OR… so damn good I have never been caught.The truth is somewhere in between there as is often the case.
