The following is general guidelines for the United Sates of America, and not intended to be legal advice.IMHO, it sounds like 2 separate issues, the first being non-payment of rent, the 2nd non-payment of water. You need to post a 3 or 5 day notice to Pay or Quit for the Rent AND a 3 or 5 day notice to Cure or Quit for the water bill.The notice to Pay or Quit/Cure is required in almost every state before the actual filing of an Unlawful Detainer suit. The number of days is determined by local jurisdiction, so make time to learn your local laws. If they do not pay rent, then post/mail a Notice of Lease Termination for Non-Payment of rent. Depending on local laws, you may be able to file the unlawful detainer suit the day after the notice to Pay or Quit expires. In other jurisdictions, there may be a waiting period. Regardless of Covid-19, file as quickly as possible to get a non payment suit on the calendar.Now, the tricky part, depending on how the water bill is referenced in your Lease, you may be able to evict based on defaulting on lease terms. Only non-payment of rent is covered under most States Covid-19 rules. By not paying the water(utility) bill, they have defaulted on the terms of the lease. After the expiration of the notice to Cure or Quit, mail/post a Notice of Lease Termination due to Default. A registered letter is not required.
