Is it wrong for ICE to remove tens of thousands illegal aliens who unlawfully entered into the United States?
Hello there OP,Is it wrong for ICE to remove tens of thousands illegal migrants who found their way into the United States?Your question is illogical as it is be based upon false premises. The first is that ICE has the power to remove illegal aliens from the USA. They don’t. The Federal Immigration Courts[1] remove the illegals by deportation. The second is that enforcing the law when faced with illegal action could ever be considered wrong. There are very serious laws regarding illegally crossing the border and Immigration and Customs Enforcement is “a law enforcement agency of the federal government of the United States tasked to enforce the immigration laws of the United States and to investigate criminal and terrorist activity of transnational organizations and aliens within the United States.”[2]The third issue is “who found their way…” This makes the illegal premeditated. To say they found their way[3] here makes it sound like an accident. There was no element of chance in the illegals travelling through Mexico and crossing the US border. Beyond demonstrating that these illegal aliens aren't simply “finding their way” over the US border wall as they enter the country in this manner. They commit a voluntary act that is both unlawful and wrong. The picture below show illegal action taking place.Even though lacking logic, please let me try this.It is right for a law enforcement agency to enforce the law and detain illegal aliens. It is right for the Federal Courts to deport illegal aliens. It is wrong for aliens to illegally enter the USA.I hope this helps you.CiaoFootnotes[1] Executive Office for Immigration Review[2] U.S. Immigration and Customs Enforcement - Wikipedia[3] Finds its/their way definition and meaning | Collins English Dictionary
Why are US immigration courts under Congressional jurisdiction instead of being under the Justice Department?
Immigration Courts are under the Justice Department. They are under the Executive Office for Immigration Review, which is a division of the Department of Justice. Look way down at the lower right on this DOJ organization chart; second column from the right, second from the bottom:
Where are the asylum cases trialed in the USA? Can they be heard at any court or does the USCIS arrange a court for the hearing? Can an asylum claim be heard in any court?
“Where are the asylum cases trailed in the USA? Can they be heard at any court or does the USCIS arrange a court for the hearing? Can an asylum claim be heard in any court?”Petitions for asylum are adjudicated in the first instance by an administrative law judge serving within the Executive Office of Immigration Review, an agency of the Department of Justice, under the supervision of the Chief Immigration Judge. Requests for reviews of decisions made by immigration judges may be made to the Board of Immigration Appeals, another administrative agency within the Department of Justice. Decisions of the Board of Immigration Appeals are subject to judicial review by the Court of Appeal of the judicial circuit in which the original immigration court hearing was held, and then from there by the Supreme Court of the United States.Immigration courts are what are called “Article I” courts, which means that none of the due process rights that would apply in a federal court of general jurisdiction (an “Article III court”) apply. Immigration judges are ordinary employees of the Department of Justice, hired by the Attorney General. They do not enjoy the prerogatives of the judges serving on Article III courts. The federal district court of the federal judicial district in which a petitioner resides or is actually present will have concurrent jurisdiction over certain limited questions related to immigration, but for most matters related to asylum and other immigration issues, jurisdiction is exclusive to the immigration courts operated by and within the Department of Justice.USCIS has no role in adjudicating asylum requests, beyond the responsibility of Customs and Border Patrol (CBP) officers to conduct a “credible fear” determination at first contact. Aside from the initial credible fear determination, all adjudication of asylum claims is handled by officers of the Department of Justice’s Executive Office for Immigration Review and Board of Immigration Appeals.State courts have no jurisdiction to adjudicate asylum requests.
