PDF Editor FAQ

What's the difference between a CDO and a mortgage?

Regarding the alleged “mortgages” which are backing MBS (mortgage backed securities), CDS ( collateralized debt obligations), or used to bet against via CDS ( credit default swaps):The entire process by which these vehicles were set up was/is regulated ( and I hi use that term loosely) by the SEC, IRC, NY and DELAWARE Trust law, GAAP, FASB, TILA, the US Code, UCC, well as others. However, no one paid any attention AT ALL to any laws, rules, or regulations for any number of reasons. And everything for the 2008 meltdown ( erroneously called a mortgage crisis, subprime loan crisis, housing crisis, toxic asset crisis, etc) was blamed squarely on homeowners/borrowers who were “deadbeats” and “bought too much house” and “used their houses like ATMs”. Sound familiar? It was a concerted effort by the media as well as our elected/appointed/hired officials to imbed this phrasing into the minds of everyone in the US. Josef Goebbels, Hitler’s minister of propaganda, was correct that “if you repeat a lie often enough it becomes the truth”.So we as Americans are conditioned to respond to foreclosures as “well they bought too much house, couldn’t pay, and now they are “losing” their home”, or similar. But I would guess that no one here has spent any time in a courtroom listening to “deadbeat borrowers” trying to save their home. 96% of the people just walk away, they are conditioned also: we couldn’t pay, are ashamed, and have to “give the house back to the bank”. Boy are they conditioned by the government propaganda machine. In no particular order, bear in mind the following:foreclosures are brought by servicers, who really don’t service anything. Their records and payments are kept and paid by Black Knight’s Loan Sphere desktop software program, to whom they pay a fee for usage..Almost all property taxes are paid by Corelogic. When the servicers mention a bank, the bank is paid a fee for use of their name. They are not otherwise involved, and have absolutely no idea that they are in court. ( go ahead , call and ask them, at different times of the day so you get different people answering the phone, and see what they say) If it wasn’t so disgusting it would be hilarious.Any loan made to anyone must appear on the lender’s balance sheet. Debits and credits to the loan must appear on the lender’s ledger. That is any loan from anyone to anyone else. Not one foreclosure I’ve ever studied or witnessed in a courtroom has had a balance sheet submitted by a lender or other foreclosing entity: if an attorney requests those records and files a motion to compel, the servicer’s attorneys will stall the proceedings for years and decades, with the cooperation of the judiciary.( this alone requires a blackboard and an afternoon to present). SO: if a loan absolutely requires it be recorded on a balance sheet as are all loans, to be a loan, under all applicable laws, rules, and regulations, and there is NO ENTRY on a balance sheet, then it simply, legally, technically cannot be a loan.6. So if it’s not a loan, then what is it? Think this over and ask more questions, thanks-
