I believe the federal government operates today (and has every increasingly for the past 100 years), vastly outside their constitutional parameters because of legislative and executive abuses that have not been thwarted because of judicial activism.I have little to no confidence that the federal government (legislature, executive an judicial branches) is going to correct their over reach of power without the use of the escape clause the founders left the states in Article V of the Constitution. At this point, Article V is the only way federal abuses of their power will be curbed allowing the states to reign in their continual unconstitutional abuses of power.The Article V escape clause exists for the states, themselves, to rein in abject federal over reach when the federal government won’t do it themselves.The proposals below won’t solve all our problems but they will provide additional mechanisms that rein in abject federal government overreach and I believe the several proposed ideas below could accomplish such a goal without creating extraordinary havoc other than on the concentration of power that the federal government has absorbed without the constitutional permission to do so.Flat Tax (FT) Amendment - Rescind the 16th Amendment essentially abolishing the progressive tax structure it established while concurrently creating an alternative flat tax set somewhere between 3% and 5% for individuals and businesses alike. It is critical the tax rate is spelled out explicitly in the amendment in order to avoid politicians ever using the tax rates and codes against the American people again.Federal Maximum Spending Amendment. This limits federal spending to 15% of GDP or collected tax receipts from the prior year, whichever is smaller. Should a catastrophe occur, the federal government could seek a 2 year hiatus from the federal maximum spending requirements, only with the approval from 3/4 of the states — limiting the excess spending to an extra 30% during those subsequent two years. This amendment would have to include a carve out of 20% of collected government revenues to be set aside for paying off debt principle (they would still have to pay interest from the general operating fund) — which means federal spending would actually be limited only to 80% of their revenue stream for spending until all federal deficits were paid in full. This Amendment ensures the federal government must operate within the same spending constraints as the American people.Repeal the 17th Amendment - Repeal the 17th Amendment so that Senators are once again appointed by the legislatures or governors of their states (each state will choose how they appoint their federal legislators). This will restore the critical balance of power in the federal legislature to ensure states once again have a voice during the law making process.Congressional Term Limits — 3 terms for the House and 2 terms for the Senate.Congressional Housing Requirement - This amendment requires that congressional members and their staff live and spend 95% of their time in their home districts. No budgets will be allocated for an office anywhere other than in the district they represent. This would allocate up to 18 calendar days to get their business done in Washington DC, leaving little time for corruption and outside lobbying efforts.SCOTUS term limits to 12 years - Every presidential term would nominate and replace 3 members of the Supreme Court.State or Congressional Lead Overriding of SCOTUS Decisions.State legislatures would have 2 years to reverse any SCOTUS decision should 3/4 of all state legislatures vote down a SCOTUS decision.Congress would have 2 years to reverse / over ride any SCOTUS decision should 3/4 of each chamber independently vote down a SCOTUS decision.Deregulation - All federal laws and regulations will automatically sunset after 8 years. In order to be reinstated, they must be passes again through the normal legislative process.Any regulation coming from any regulatory agency that has an economic burden of $50M or more, must pass through the normal legislative process before it is enacted.Application of Law - all laws and regulations, apply equally to all elected Representatives and their staff.
