PDF Editor FAQ
At what point can we determine if marijuana legalization in Colorado and Washington is considered a success or failure?
From a financial perspective, it is a success. According to a recent article I wrote, The high life: opportunities in the marijuana economy, "Following the legislation of marijuana usage, cannabis sales in Colorado are growing rapidly. Legal marijuana was a $700 million dollar industry in 2014 according to a Washington Post analysis of tax data. In 2014, Colorado retailers sold $386 million of medical marijuana and $313 million for purely recreational purposes. The two segments of the market generated $63 million in tax revenue, with an additional $13 million collected in licenses and fees."
Is a business legally allowed to cover the sales tax and other taxes for its customers, so the customers don't have to pay for it? I'm only wondering because there is a business near me that does this practice.
A business absorbing sales tax is actually breaking the law in quite a few states in the U. S. Many states tax the consumer (consumer excise or sales tax) rather than the retailer (seller or vendor privilege tax). In consumer sales tax states, retailers collect the tax for the state and typically can’t interfere with the state’s taxation of the consumer. It can make audits more challenging (determining actual sales price and actual exemptions). For sure, it is unlawful for businesses to absorb sales tax in the following states (with statute):Alabama (810-6-4-.20)Arizona (42-5165)California ( 3, Article 1, Section 6205)Colorado (information bulletin)Connecticut (law)District of Columbia ( 47–2014)Florida (07)Iowa (24)Kansas (information bulletin, p 11)Kentucky (KRS 139.220)Nebraska (REG-1-039)Nevada (NRS 372.115)North Dakota (newsletter)Ohio (29)Oklahoma (710:65-1-5)Texas (106)Vermont (9708)West Virginia (vendor responsibilities)
What has been the experience of states that legalized cannabis? Was the tax revenue as high as predicted? Were there unforeseen circumstances?
I live in Colorado where all marijuana has been legal for over 5 years now. Many cities place moratoriums on retail marijuana stores for fear the government would charge them with money laundering, but now most cities have allowed retail marijuana stores, as they have witnessed how much tax revenue they are losing. Marijuana added over 28,000 jobs to Colorado and in 2017 Colorado had marijuana sales of 1.507 billion dollars, and to date since legalization from 1/1/2014 to 10/31/18 sales are 5.781 billion dollars, which earned the state $883,885,907 million dollars in tax revenue. All that money that used to go to the black market are now all being taxed for income and sales tax. Our state is in the top 5 economically and many companies are moving here. Legalization was definitely a win-win situation.
