The above verses are poorly translated by the New American Standard Bible as they are in most other translations.So let’s pick this passage apart.“Whoever sends his wife away (apoluo)…” Apoluo means “to send away” and is correctly translated here.“let him give her a certificate of divorce (apostasion)…” Apostasion is also correctly translated as a “certificate of divorce.”“but I say to you that everyone who divorces (apoluo) his wife…” Here we run into a problem. It should read “everyone who sends his wife away.” That meaning is given in a footnote, but the footnote meaning should be the actual translation.“whoever marries a divorced (apoluo) woman commits adultery.” Here again it should read “whoever marries a sent away woman” and once again the correct meaning is given in a footnote instead of being included in the actual text. The implication is that the woman is sent away without the apostasion.The fact that the woman is sent away without a written certificate of divorce should have been understood by everyone listening to Jesus. They all knew the Mosaic law on the subject.The NASB translators twisted the following passage into pretzel shapes trying to force it to conform to what Jesus apparently said because of faulty translations. The law, as given to Moses, appears in Deuteronomy 24:1-4…1 When a man takes a wife and marries her, and it happens that she finds no favor in his eyes because he has found some indecency in her, and he writes her a certificate of divorce and puts it in her hand and sends her out from his house,2 and she leaves his house and goes and becomes another man’s wife,3 and if the latter husband turns against her and writes her a certificate of divorce and puts it in her hand and sends her out of his house, or if the latter husband dies who took her to be his wife,4 then her former husband who sent her away is not allowed to take her again to be his wife, since she has been defiled…The King James Version of the first verse is a much better translation…1 When a man hath taken a wife, and married her, and it come to pass that she find no favour in his eyes, because he hath found some uncleanness in her: then let him write her a bill of divorcement, and give it in her hand, and send her out of his house.Here there is no beating around the bush until verse 4 as there is in the NASB translation. Here we get from when to then in one verse.THE PROBLEM WITH VERBAL DIVORCESMoses’ purpose was to correct a serious injustice that could potentially fall upon a woman who was divorced. In those days the common practice was to follow the ancient law of Hammurabi (i.e., Nimrod). A woman could be divorced with a verbal statement, “I repudiate her,” which was stated three times.This is mentioned on page 120 of the book, The Laws of Moses and the Code of Hammurabi, by Stanley A. Cook, where the author quotes paragraph 141 of the Hammurabi Code:“…and if her husband formally divorces her with the words ‘I repudiate her’ (e-si-ib-sa), she goes her own way and receives no uzubu.”The problem with a verbal divorce is that the woman was sent out of the house with no written proof of her divorce. And so, if she were to remarry, her former husband might become jealous or vindictive and accuse her of adultery. And so God, through Moses, demanded that she be given a written bill of divorce. She could not be sent out of the house until that written bill of divorce had been placed into her hand.Chapter 1: Divorce and RemarriageTo sum up, Jesus wasn’t saying a divorced person can’t remarry because if they do it’s adultery. When the verses in Matthew 5 are properly translated, Jesus was in agreement with Moses, saying that the wife could indeed legally be sent away, legally divorced, but only after she had that written certificate of divorce in her hand.The part that comes after Jesus’ words, “but I say to you…” is where He illuminates the Mosaic law, so that His listeners could understand why she had to have that written document.Sending the wife away with no written proof of the divorce “[made] her commit adultery,” and also the man who married her afterwards, because it was an illegal divorce which would have been treated as no divorce at all.The Mosaic law insisted on the certificate of divorce but never explained — as Jesus did — that the lack of it would result in charges of adultery.This removes the heavy legalistic burden from people who have believed the improperly translated verses of Matthew 5. They can indeed remarry with no fear of committing adultery, as long as there’s written proof of the divorce.EDIT:It seems a few people have misunderstood this answer. What God has joined together, let no one separate. That is not in dispute.The point of this answer is this: Jesus insisted that—except for the one reason of infidelity—every man should abide by the Mosaic law and give his wife a certificate of divorce when sending her away.They weren’t doing that. They were sending their wives away, forcing them to leave, and not providing them with that document, and by so doing, leaving them open to charges of adultery.Jesus was saying the only time they could do that—send the wife away without the certificate of divorce—was in the case of infidelity.Under the Mosaic law, the sending away is not the divorce unless it is accompanied by the certificate of divorce (apostasion).Dismissing someone from a marriage, sending them away and making them commit adultery because they haven’t been given a certificate of divorce—this is what Jesus is speaking of. Only in cases of infidelity could that be allowed to happen. Why? Because the one being sent away was already an adulterer, so if they were charged with adultery because they had been sent out of the marriage without a certificate of divorce, the charge was already true anyway.As for divorce itself, Jesus said Moses permitted it “because of your hardness of heart.” For that reason, Moses didn’t forbid divorce, but he did provide guidelines on how to implement it so that women (or even men, for that matter) would not be victimized by their situation after they were sent away/dismissed.As long as we human beings are in this state of imperfection divorce will be a fact of life. It shouldn’t be done at all, but if it has to be done, at least do it according to the guidelines that God provided and Jesus reinforced.
