It’s now being swept after that flagrant violation of security policy.Rep. Chris Stewart (R-UT) gave away the game afterward: "This may be within House rules. That's not the question. The question is, is it a good idea to impeach the President in secret hearings."The rules don’t matter to them. Only what they want matters. The President isn’t being impeached in these hearings. The impeachment will happen in public using the evidence gathered in the closed (not secret) hearings. And one of the reasons the hearings are closed is because they’re discussing information that is classified. Classified by the executive branch.Apparently (according to the GOP) you can’t have closed committee hearings (never mind that 102 of the 103 witnesses to the Benghazi hearings testified in closed session). And you can’t discuss classified material except in a closed session.So…if there’s classified material that implicates the President?¯\_(ツ)_/¯

However, that power doesn’t at all translate to declaring war in secret.Following a closed session of Congress, any votes taken in closed sessions are made part of the public record, even if the debate is not - so the secret would get out pretty fast.Moreover, it’s impossible to imagine that Congress could meet in a closed session without everybody knowing that they were meeting in a closed session in the first place - because that’s a pretty big deal - and somebody would leak something. A senior aide, a Member of Congress who wasn’t keen on the war, whatever. It would get out.Moreover moreover, the Constitution forbids Congress from meeting in official business outside of the capital without each other’s consent, which has to be made public. So it’s not like Congress could just pretend to go home, only to meet at some mountain resort and commit the nation to war.So just on procedure alone it’s impossible to imagine a war being secretly declared.However, and beating out the procedural problems, unless the President also consented to this declaration of war, nothing would happen, as Congress has no direct authority over military operations.But even if the President and Congress were in agreement on the necessity of war, an invasion of another country doesn’t just happen at the drop of the hat. Troops and supplies need to be moved into position, and it wouldn’t be very difficult for a foreign intelligence service to detect the sudden pooling of American military might, regardless of any official denials from Washington.So yeah, sure, Congress could technically, secretly declare war on another nation, but it would be supremely stupid, unlikely to actually stay a secret, and offer no benefit towards launching a surprise attack.
